Agenda 07/14/2020 Item #16A40 (FDEP Grant - Mangroves & Shorline Clean-up)07/14/2020 EXECUTIVE SUMMARY Recommendation to accept a Federal grant with the U.S. Department of the Interior through U.S. Fish and Wildlife Service, and additional funding from Florida Department of Environmental Protection for a total amount of $294,353.41, for the removal of eligible debris from mangroves, shorelines and open waters as a result of Hurricane Irma and authorize any necessary budget amendments. OBJECTIVE: To accept a Federal grant with the U.S. Department of the Interior through U.S. Fish and Wildlife Service, and additional funding from Florida Department of Environmental Protection for a total amount of $294,353.41, for the removal of eligible debris from mangroves, shorelines and open waters as a result of Hurricane Irma and authorize any necessary budget amendments. CONSIDERATIONS: On September 9, 2019, Collier County Capital Project Planning, Impact Fees and Program Management was notified that additional funds became available through the U.S. Department of Interior to facilitate marine debris removal. As a result of Irma’s extensive size and intensity many homes, buildings, docks, and man -made structures were damaged or destroyed resulting in wind and water-blown debris that was deposited onto mangroves, shorelines, and open water throughout the Rookery Bay National Estuarine Research Reserve “RBNERR” and Collier County but particularly into areas near Goodland, Marco Island, Isles of Capri, Henderson Creek, and Haldeman Creek. This storm debris consists of wood, metal, foam, fiberglass insulation, plastic, and other materials found as part of buildings, docks, and other built structures. Although much storm-related debris has already been identified and mapped, mapping efforts are ongoing to identify the location and type of debris still spread throughout RBNERR and the County and continues to disperse over time due to wind and tidal movement. As part of this effort, the U.S. Department of the Interior, Fish and Wildlife Service, Florida Department of Environmental Protection, and Collier County would be collaborating to fund and direct the debris removal project, as a result of Hurricane Irma. Marine debris removal activities would be limited to marine debris that poses a threat to human health and safety and/or natural resources (flora, fauna, and their habitats), such as, but not limited to derelict vessels, derelict fishing gear, and various construction/demolition debris related to Hurricane Irma. On January 28, 2020, (Item 16.A.9), the Collier County Board of County Commissioners approved U.S. Department of Interior Grant application and associated documents as part of a Cooperative Agreement between the U.S. Department of the Interior, U.S. Fish, and Wildlife Service, Florida Department of Environmental Protection, and Collier County to facilitate marine debris removal on Land Units of Ten Thousand Island National Wildlife Refuge, Collier County and State of Florida. An agreement is not required to accept this award. The terms and conditions of the application and award letter apply. This Cooperative Agreement is being implemented in order to facilitate a multi-jurisdictional marine debris removal on Land Units of Ten Thousand Island National Wildlife Refuge, Collier County and State of Florida. Under this agreement, the Service will participate in a task force working group with Collier County and Rookery Bay National Estuarine Research Reserve to identify priority locations for debris removal. Terms of Acceptance: Service grant and cooperative agreement awards are made based on the application submitted to and approved by the Service, and are subject to the terms and conditions incorporated into the Notice of Award either by direct citation or by reference to Federal regulations; program legislation or regulation; and special award terms and conditions. Recipients indicate their acceptance of an award by starting work, drawing down funds, or accepting the award via electronic means. Recipient acceptance of an award from the Service carries with it the responsibility to be aware of and comply with all terms and conditions applicable to the award. Inadvertent Archeological or Historical Discoveries In the event any archaeological or historic materials are encountered during project activity, work in the immediate area must stop and the following actions taken: 1. Implement reasonable measures to protect the discovery site, including any appropriate stabilization or covering; 2. Take reasonable steps to ensure the confidentiality of the discovery sites; and 3. Take reasonable steps to restrict access to the site of discovery. The recipient must notify the concerned Tribes and all appropriate county, state, and federal agencies, including the State Historic Preservation Office. Agencies and the Tribe(s) will discuss the possible measures to remove or avoid cultural material, and will reach an agreement with the recipient regarding actions to be taken and disposition of material. If Human remains are uncovered, appropriate law enforcement agencies must be notified first, and the above steps followed. If the remains are determined to be Native, consultation with the affected Tribe(s) will take place in order to mitigate the final disposition of said remains. Significant Developments Reports (see 2 CFR 200.328(d)): Events may occur between the scheduled performance reporting dates that have significant impact upon the supported activity. In such cases, recipients are required to notify the Service in writing as soon as the recipient becomes aware of any problems, delays, or adverse conditions that will materially impair the ability to meet the objective of the Federal award. This disclosure must include a statement of any corrective action(s) taken or contemplated, and any assistance needed to resolve the situation. A. Contractor shall comply with Florida Public Records law under Chapter 119, F.S. Records made or received in conjunction with this Contract are public records under Florida law, as defined in Section 119.011(12), F.S. Contractor shall keep and maintain public records required by the Department to perform the services under this Contract. B. This Contract may be unilaterally canceled by the Department for refusal by the Contractor to either provide to the Department upon request, or to allow inspection and copying of all public records made or received by the Contractor in conjunction with this Contract and subject to disclosure under Chapter 119, F.S., and Section 24(a), Article I, Florida Constitution. C. If Contractor meets the definition of “Contractor” found in Section 119.0701(1)(a), F.S.; [i.e., an individual, partnership, corporation, or business entity that enters into a contract for services with a public agency and is acting on behalf of the public agency], then the following requirements apply: 1. Pursuant to Section 119.0701, F.S., a request to inspect or copy public records relating to this Contract for services must be made directly to the Department. If the Department does not possess the requested records, the Department shall immediately notify the Contractor of the request, and the Contractor must provide the records to the Department or allow the records to be inspected or copied within a reasonable time. If Contractor fails to provide the public records to the Department within a reasonable time, the Contractor may be subject to penalties under s. 119.10, F.S. 2. Upon request from the Department’s custodian of public records, Contractor shall provide the Department with a copy of the requested records or allow the records to be inspected or copied within a reasonable time at a cost that does not exceed the cost provided in Chapter 119, Florida Statutes, or as otherwise provided by law. 3. Contractor shall identify and ensure that all public records that are exempt or confidential and exempt from public records disclosure requirements are not disclosed except as authorized by law for the duration of the Contract term and following completion of the Contract if the Contractor does not transfer the records to the Department. 4. Upon completion of the Contract, Contractor shall transfer, at no cost to Department, all public records in possession of Contractor or keep and maintain public records required by the Department to perform the services under this Contract. If the Contractor transfers all public records to the Department upon completion of the Contract, the Contractor shall destroy any duplicate public records that are exempt or confidential and exempt from public disclosure requirements. If the Contractor keeps and maintains public records upon completion of the Contract, the Contractor shall meet all applicable requirements for retaining public records. All records that are stored electronically must be provided to Department, upon request from the Department’s custodian of public records, in a format that is accessible by and compatible with the information technology systems of Department.
