EXECUTIVE SUMMARY
Recommendation to accept a Federal grant with the U.S. Department of the Interior through U.S.
Fish and Wildlife Service, and additional funding from Florida Department of Environmental
Protection for a total amount of $294,353.41, for the removal of eligible debris from mangroves,
shorelines and open waters as a result of Hurricane Irma and authorize any necessary budget
amendments.
OBJECTIVE: To accept a Federal grant with the U.S. Department of the Interior through U.S. Fish
and Wildlife Service, and additional funding from Florida Department of Environmental Protection for
a total amount of $294,353.41, for the removal of eligible debris from mangroves, shorelines and open
waters as a result of Hurricane Irma and authorize any necessary budget amendments.
CONSIDERATIONS: On September 9, 2019, Collier County Capital Project Planning, Impact Fees
and Program Management was notified that additional funds became available through the U.S.
Department of Interior to facilitate marine debris removal.
As a result of Irma’s extensive size and intensity many homes, buildings, docks, and man -made
structures were damaged or destroyed resulting in wind and water-blown debris that was deposited onto
mangroves, shorelines, and open water throughout the Rookery Bay National Estuarine Research
Reserve “RBNERR” and Collier County but particularly into areas near Goodland, Marco Island, Isles
of Capri, Henderson Creek, and Haldeman Creek. This storm debris consists of wood, metal, foam,
fiberglass insulation, plastic, and other materials found as part of buildings, docks, and other built
structures. Although much storm-related debris has already been identified and mapped, mapping
efforts are ongoing to identify the location and type of debris still spread throughout RBNERR and the
County and continues to disperse over time due to wind and tidal movement.
As part of this effort, the U.S. Department of the Interior, Fish and Wildlife Service, Florida
Department of Environmental Protection, and Collier County would be collaborating to fund and direct
the debris removal project, as a result of Hurricane Irma. Marine debris removal activities would be
limited to marine debris that poses a threat to human health and safety and/or natural resources (flora,
fauna, and their habitats), such as, but not limited to derelict vessels, derelict fishing gear, and various
construction/demolition debris related to Hurricane Irma.
On January 28, 2020, (Item 16.A.9), the Collier County Board of County Commissioners approved U.S.
Department of Interior Grant application and associated documents as part of a Cooperative Agreement
between the U.S. Department of the Interior, U.S. Fish, and Wildlife Service, Florida Department of
Environmental Protection, and Collier County to facilitate marine debris removal on Land Units of Ten
Thousand Island National Wildlife Refuge, Collier County and State of Florida.
An agreement is not required to accept this award. The terms and conditions of the application and
award letter apply.
FISCAL IMPACT: Budget Amendments will be required to appropriate federal grant funding from
US Department of the Interior/ U.S. Fish and Wildlife Service, in the amount of $190,003.41 within
GMD Grant Fund 711, Project No. 33700 and to appropriate addi tional funding from the Florida
Department of Environmental Protection, in the amount of $104,350.00, within Stormwater Capital
Fund 325, Project No. 33700.

Your organization’s application for Federal financial assistance titled “Marine Debris Removal”
submitted to the U.S. Fish and Wildlife Service (Service)’s CFDA Program 15.654 is approved.
This award is made under the authority of: the Fish and Wildlife Act of 1956, as amended, 16
U.S.C. (742f (a)(4); Fish and Wildlife Coordination Act, as amended, 16 U.S.C. 661.; Fish and
Wildlife Improvement Act of 1978, as amended (16 U.S.C. 753), Endangered Species Act of
1973 (16 U.S.C. 1531-1543). For a complete list of this program’s authorizing legislation, go to
https://beta.sam.gov/and search by the CFDA Program number. This award is made based on
approval of your organization’s proposal signed on 07/24/2019, hereby incorporated by reference
into this award. Funds under this award are to be used to clear hurricane debris from the lands
and waters within the Ten Thousand Islands National Wildlife Refuge in Collier County, Florida.
This Cooperative Agreement is being implemented in order to facilitate a multi-jurisdictional
marine debris removal on Land Units of Ten Thousand Island National Wildlife Refuge, Collier
County and State of Florida.
Under this agreement, the Service will participate in a task force working group with Collier
County and Rookery Bay National Estuarine Research Reserve to identify priority locations for
debris removal. Service staff will assist the development of contract scope of work, development

of best management practices and insure contractors adhere to refuge rules and regulations while
working on refuge lands and waters.
Terms of Acceptance:
Service grant and cooperative agreement awards are made based on the application submitted to
and approved by the Service, and are subject to the terms and conditions incorporated into the
Notice of Award either by direct citation or by reference to Federal regulations; program
legislation or regulation; and special award terms and conditions. Recipients indicate their
acceptance of an award by starting work, drawing down funds, or accepting the award via
electronic means. Recipient acceptance of an award from the Service carries with it the
responsibility to be aware of and comply with all terms and conditions applicable to the award.
The Federal regulations applicable to Service recipients and their subrecipients and contractors
are listed by recipient type in the Service’s Financial Assistance Award Terms and Conditions.
The “Department of the Interior (DOI) Award Provisions” attached to this Notice of Award also
apply (Attachment A). If you do not have access to the Internet and require a printed copy of the
award terms and conditions, contact the Service Project Officer identified in the Project Contacts
section.
The recipient can initiate termination of award by sending written notice to the Service Project
Officer stating the reasons for termination, the effective date, and in the case of partial
termination, the portion to be terminated. For applicable award termination regulations and
procedures, see 2 CFR 200.339.
The performance period of this award is September 30, 2019 through September 30, 2022. Only
allowable costs resulting from obligations incurred during the performance period may be
charged to this award. Liquidate all obligations incurred under the award no later than 90
calendar days after the end of the performance period, unless the Service approves a final
financial reporting period extension (see Reporting Requirements section below). If you need
more time to complete project activities, you must submit a written request to the Service Project
Officer identified in the Project Contacts section below before the end of the stated performance
period (See the Period of Performance Extensions section below).

award, your organization must maintain an active SAM registration at www.SAM.gov until the
final financial report is submitted or final payment is received, whichever is later. If your
organization’s SAM registration expires during the required period, the Service will suspend

Special Conditions and Provisions:
Davis-Bacon Act
Davis-Bacon Act requirements apply to this award. All construction contracts in excess of
$2,000 awarded by the recipient and all subrecipients under this award must include the Davis-
Bacon Act provision in the contract provisions required in 2 CFR 200, Appendix II-Contract
Provisions for Non-Federal Entity Contracts Under Federal Awards.
Executive Order (E.O.) 13658, Establishing a Minimum Wage for Contractors
Executive Order 13658, “Establishing a Minimum Wage for Contractors” applies to this
award. The Recipient and all subrecipients must include the Minimum Wage Contract
Clause attached to and hereby incorporated into this award in all construction contracts
awarded in excess of $2,000.
Inadvertent Archeological or Historical Discoveries
In the event any archaeological or historic materials are encountered during project activity,
work in the immediate area must stop and the following actions taken:
1. Implement reasonable measures to protect the discovery site, including any
appropriate stabilization or covering;
2. Take reasonable steps to ensure the confidentiality of the discovery sites; and
3. Take reasonable steps to restrict access to the site of discovery.
The recipient must notify the concerned Tribes and all appropriate county, state, and federal
agencies, including the State Historic Preservation Office. Agencies and the Tribe(s) will
discuss the possible measures to remove or avoid cultural material, and will reach an agreement
with the recipient regarding actions to be taken and disposition of material. If Human remains
are uncovered, appropriate law enforcement agencies must be notified first, and the above steps
followed. If the remains are determined to be Native, consultation with the affected Tribe(s) will
take place in order to mitigate the final disposition of said remains.
Payments:
Your organization has completed enrollment in U.S. Treasury’s Automated Standard Application
for Payment (ASAP) system. When requesting payment in ASAP, your Payment Requestor will

Performance reports must contain: 1) a comparison of actual accomplishments with the goals and

relevant to the project results. Please include the award number provided in the subject line of
this letter on all reports.
Financial and performance reporting due dates may be extended by upon receipt of a written
request addressed to the Service Project Officer identifying the type of report to be extended, the
requested revised due date, and a justification for the extension. The Service Project Officer may
approve an additional extension if justified by a catastrophe that significantly impairs the
Recipient’s operations. Requests for reporting due date extensions must be received by the
Service Project Officer before the original reporting due date.

Significant Developments Reports (see 2 CFR 200.328(d)):
Events may occur between the scheduled performance reporting dates that have significant
impact upon the supported activity. In such cases, recipients are required to notify the Service in
writing as soon as the recipient becomes aware of any problems, delays, or adverse conditions
that will materially impair the ability to meet the objective of the Federal award. This disclosure
must include a statement of any corrective action(s) taken or contemplated, and any assistance
needed to resolve the situation. The recipient should also notify the Service in writing of any

Conflict of Interest Disclosures:
Recipients are responsible for notifying the Service Project Officer in writing of any conflicts of
interest that arise during the life of this award, including those reported to them by any
subrecipient under the award. Conflicts of interest include any relationship or matter that might
place the recipient, including their employees and subrecipients, in a position of conflict, real or
apparent, between their responsibilities under the award and any other outside interests. Conflicts
of interest include direct or indirect financial interests; close personal relationships; positions of
trust in outside organizations; consideration of future employment arrangements with a different
organization; and decision-making authority related to the proposed project. Conflicts of interest
are those circumstances real or perceived that would cause a reasonable person with knowledge
of the relevant facts to question the impartiality of the recipient, or the recipient’s employees or
subrecipients, in matters pertaining to the award. Recipients must notify the Service in writing if
any employees, including subrecipient and contractor personnel, are related to, married to, or
have a close personal relationship with any Federal employee within the Federal program issuing
this award. The term employee means any individual engaged in the performance of work under
the Federal award. Recipients may not have a former Federal employee as a key project official,
or in any other substantial role related to their award, whose participation put them out of
compliance with the legal authorities addressing post-Government employment restrictions. See
the U.S. Office of Government Ethics website at https://oge.gov/ for more information on these
restrictions. The Service will examine each conflict of interest disclosure based on its particular
facts and the nature of the project and will determine if a significant potential conflict exists. If it

Other Mandatory Disclosures:
Recipients of Federal awards must disclose, in a timely manner, in writing to the Federal
awarding agency or pass-through entity all violations of Federal criminal law involving fraud,
bribery, or gratuity violations potentially affecting the Federal award. Non-Federal entities that
receive a Federal award including the term and condition outlined in 2 CFR 200, Appendix
XII—Award Term and Condition for Recipient Integrity and Performance Matters are required

IMPORTANT NOTE: The Florida Department of Environmental Protection (DEP) is participating with the Florida Department of Management

PUBLIC RECORDS.
A. Contractor shall comply with Florida Public Records law under Chapter 119, F.S. Records made or received in conjunction with this
Contract are public records under Florida law, as defined in Section 119.011(12), F.S. Contractor shall keep and maintain public records
required by the Department to perform the services under this Contract.
B. This Contract may be unilaterally canceled by the Department for refusal by the Contractor to either provide to the Department upon
request, or to allow inspection and copying of all public records made or received by the Contractor in conjunction with this Contract and
subject to disclosure under Chapter 119, F.S., and Section 24(a), Article I, Florida Constitution.
C. If Contractor meets the definition of “Contractor” found in Section 119.0701(1)(a), F.S.; [i.e., an individual, partnership, corporation, or
business entity that enters into a contract for services with a public agency and is acting on behalf of the public agency], then the following
requirements apply:
1. Pursuant to Section 119.0701, F.S., a request to inspect or copy public records relating to this Contract for services must be made directly
to the Department. If the Department does not possess the requested records, the Department shall immediately notify the Contractor of the
request, and the Contractor must provide the records to the Department or allow the records to be inspected or copied within a reasonable
time. If Contractor fails to provide the public records to the Department within a reasonable time, the Contractor may be subject to penalties
under s. 119.10, F.S.
2. Upon request from the Department’s custodian of public records, Contractor shall provide the Department with a copy of the requested
records or allow the records to be inspected or copied within a reasonable time at a cost that does not exceed the cost provided in Chapter
119, Florida Statutes, or as otherwise provided by law.
3. Contractor shall identify and ensure that all public records that are exempt or confidential and exempt from public records disclosure
requirements are not disclosed except as authorized by law for the duration of the Contract term and following completion of the Contract if
the Contractor does not transfer the records to the Department.
4. Upon completion of the Contract, Contractor shall transfer, at no cost to Department, all public records in possession of Contractor or keep
and maintain public records required by the Department to perform the services under this Contract. If the Contractor transfers all public
records to the Department upon completion of the Contract, the Contractor shall destroy any duplicate public records that are exempt or
confidential and exempt from public disclosure requirements. If the Contractor keeps and maintains public records upon completion of the
Contract, the Contractor shall meet all applicable requirements for retaining public records. All records that are stored electronically must be
provided to Department, upon request from the Department’s custodian of public records, in a format that is accessible by and compatible with
the information technology systems of Department.
D. IF THE CONTRACTOR HAS QUESTIONS REGARDING THE APPLICATION OF CHAPTER 119, F.S., TO THE CONTRACTOR’S DUTY
TO PROVIDE PUBLIC RECORDS RELATING TO THIS CONTRACT, CONTACT THE DEPARTMENT’S CUSTODIAN OF PUBLIC
