EXECUTIVE SUMMARY
Recommendation to authorize the electronic submission of the County Incentive Grant Program
(CIGP) Application with the Florida Department of Transportation to fund a phase of Vanderbilt
Beach Road from 16th Street NE to Everglades Blvd in the amount of $21,000,000.
OBJECTIVE: To receive authorization from the Board of County Commissioners (Board) to submit a
County Incentive Grant Program (CIGP) application to the Florida Department of Transportation (FDOT)
for a phase of Vanderbilt Beach Road from 16th Street NE to Everglades Blvd in the amount of
$21,000,000.
CONSIDERATION: On January 30, 2020, Collier County was informed that FDOT was requesting
projects for CIGP priorities for fiscal year 2025/26. FDOT will consider projects su bmitted before July 1,
2020, for CIGP funding. CIGP funds are awarded to projects which relieve congestion on the State
Highway System and are consistent with established plans in the area. The construction of Vanderbilt
Beach Road from 16th Street NE to Everglades Blvd. is eligible for CIGP funding.
Collier County will extend Vanderbilt Beach Road from 16th Street NE to Everglades Blvd. This is an
approximate 2-mile extension of the existing roadway farther east-west into Golden Gate Estates. The
earlier phase of the proposed road will extend eastward from the existing section of Vanderbilt Beach
Road (VBR) and veer northward and continue east, between 10th Avenue Northwest and 12th Avenue
Northwest. This phase will continue from 16th Street Northeast and terminate at Everglades Blvd. The
entire project is approximately 2 miles in length. The VBR extension project is divided into several
phases and sections. This project will be a two-lane facility.
The proposed project will improve the multimodal connection inside the County’s urbanized area. The
corridor will relieve traffic congestion on the State Highway System (SHS) (US41 and I-75) and provide
for the efficient movement of people, goods and services. The additional capacity will provide for a more
efficient connection between many community assets including existing neighborhoods, a library,
churches, a nearby hospital and commercial businesses.
The construction of the project is in the Collier MPO’s 2040 Long Range Transportation Plan Cost
Feasible Plan without funding and will likely be in the 2045 LRTP Cost Feasible Plan approved in
December 2020, with funding. The design, ROW, mitigation and advanced construction of Vanderbilt
Beach Road Extension (VBR Ext) from 16th St. NE to Everglades Blvd. is currently in the County’s
FY20-FY24 Five Year Work Program which is tied to the County’s Capital Improvement Element (CIE).
The project will meet all applicable federal, state and local requirements, including Americans with
Disabilities Act (ADA) requirements.
Approval of this item will authorize the Department Head of Growth Management to electronically submit
all required documents.
FISCAL IMPACT: The projected construction and construction engineering and inspection costs are
estimated at $21,000,000. The Project is currently in the County’s FY2020/2024 5 Year Capital Work
Program. The grant amount requested is $10,500,000 or 50% of the project costs for the construction
phase. The County is required to provide a local match of $10,500,000 (50%) from one or more of the
following sources: impact fees, gas taxes, sales tax and/or general fund revenues. Source of funds will be
determined at the time of the award and budget amendments will be brought to the Board for approval.
GROWTH MANAGEMENT IMPACT: This project is consistent with the County’s Growth
Management Plan and the MPO’s Long Range Transportation Plan.

This letter is in response to the request for Collier County CIGP priorities for fiscal years
2025/2026. We believe that the completion of Vanderbilt Beach Road from 16th Street NE to
Everglades Blvd., approximately 2 miles, is an excellent candidate for CIGP funding.

Collier County will extend Vanderbilt Beach Road from 16th Street NE to Everglades Blvd.
This is an approximate 2-mile extension of the existing roadway farther east-west into Golden
Gate Estates. The earlier phase of the proposed road will extend eastward from the existing

complete but it anticipated to be similar to Phase 1.
3. Detailed description of how the project would reduce congestion on the state highway
system:
Phase 1 of this Project is one of the highest priority projects in Collier County and the only
fully funded construction project in the first 5-year block of Collier MPO’s 2040 LRTP. This
indicates that there is a considerable need for transportation infrastructure improvements in
this area. The proposed project is a phased approach in which the additional eastern segments
in Phase 2 are being pursued almost simultaneously.
New road alignments, more bridge connections, and improved access to Interstate 75 are all
needed in order for the Estates’ transportation network to function at a reasonable level.
Keeping Immokalee Road and Golden Gate Boulevard as the only two major east-west arteries
serving the Estates is problematic - creating a strong likelihood that these roads will experience
level of service (LOS) F, or complete failure, during peak travel times. An improved road
network is not only needed for commuting purposes, but also critical to improve access for
emergency responders including fire departments, medical services and law enforcement.
Previous traffic models show a six-lane road is needed to meet the travel demand in the year
2040 and beyond. In order to address anticipated “build-out” conditions beyond 2040+, the
County is planning to acquire enough right of way to build six lanes, if needed. The interim
plan is to build a 4-lane facility expandable to 6-lanes when funding becomes available.
VBR Ext. will provide Estates residents access to Collier Blvd., Livingston Rd, Airport Rd,
and US 41 without vehicles having to access I-75 and the Immokalee Rd. interchange. This

interchange exit causes extreme delay and congestion on the state highway system that could
use VBR Ext. when it is constructed. In many cases, the project will reduce vehicle miles
traveled by providing a more direct route.
In addition, Collier County has been interested in the potential new interchange onto I-75 in
the vicinity of Everglades Blvd. Collier County is aware that the approval of a new interchange
is more likely if additional local road improvements and new alignments are being
implemented, rather than relying on the Interstate Highway System to meet local needs. The
congestion on I-75 in this region is a continuing concern, and the VBR Ext. is considered a
long-term solution to the Estates traffic congestion issues as it is the only new alignment project
which will relieve I-75.
The proposed project will improve the multimodal connection inside the County’s urbanized

and I-75) and provide for the efficient movement of people, goods and services. The additional
capacity will provide for a more efficient connection between many community assets
including existing neighborhoods, a library, churches, a nearby hospital and commercial

VBR is classified as a Major Collector on the Federal Functional Classification map approved
by FHWA on January 23, 2014. While it is not on the State Highway System, the road is
Federal Aid Eligible, as referenced in the FDOT map below dated March 2, 2020. When the
road is extended and complete, it is envisioned to change classifications to an Arterial, as it is
designed to move higher volumes of traffic at higher speeds and with limited access.
This facility will improve travel reliability by decreasing travel times, reducing vehicle miles
traveled, reducing congestion and reducing emissions from idling vehicles.
This project will provide safety benefits to all modes of transportation by creating bike lanes
and sidewalks and reducing traffic congestion. Creating better alternatives to cars will help
encourage a mode shift. Reducing the number of cars on the road not only lowers road
maintenance, it also constructs a safer intermodal transportation system. The addition of more
modal opportunities within the existing right-of-way minimizes the network lifecycle costs and
environmental impact. The project also completes the pedestrian and bicycle network as well
as a gap along a regional shared use pathway. The lack of existing pedestrian and bicycle
facilities is the contributing cause to a high cyclist fatality rate within the project limits.

Besides the added capacity by reducing delays, there will also be a reduced need for road
maintenance. Reduced vehicle miles traveled on the roads means less maintenance, operations
and improvement costs to the parallel facilities. The project will also help reduce crashes
resulting in injuries by providing sidewalks for bicyclists and pedestrians and thereby
improving overall traffic operations.
Between January 10, 2005 and April 24, 2020 there have been 585 crashes along VBR from
Collier Blvd. to its current termini. Of those crashes, 2 have been fatal and 61 have had serious
injuries. This includes 3 incidents involving bicyclists and 3 involving pedestrians. Below is
a map indicating the crash locations on VBR in the project location. It is important to note that
this data is only for the portion of VBR which exists today, most of the proposed 7-mile project

is currently not a road. The data was made available from the Collier County Crash Data
Management software.

The figure above represents the location of all crashes on parallel facilities – Immokalee Road,
Golden Gate Blvd. and I-75. Since 2005, there have been 5,627 crashes on parallel facilities,
as seen on Figure 10 above. Those crashes resulted in 48 fatalities and 971 injuries.
The proposed project will improve the multimodal connection inside the County’s urbanized
area. The corridor will relieve traffic congestion on the State’s designated SIS facility (I-75)
and SHS (US41) and provide for the efficient movement of people, goods and services. The
additional capacity will provide for a more efficient connection between many community
assets including existing neighborhoods, schools and commercial businesses.
Without State assistance, the County will be required to wait until enough local funding is
collected to fund the project in full. This would further delay the traffic congestion relief of I-
75.

6. Cost estimate:
The projected construction and construction engineering and inspection costs are estimated at
$21,000,000. The Project is currently in the County’s FY2020/2024 5 Year Work Program. The grant
amount requested is up to 50% of the project costs for the construction phase.
For these improvements to VBR Ext. we are requesting funding in any amount up to the
50% match of the construction phase as appropriate.

• Improved response times for fire and EMS
• In Estates area (east of CR 951), will relieve traffic on Immokalee Rd and Golden Gate
Blvd.
• Will relieve traffic on Immokalee Rd and Pine Ridge Rd west of CR 951.
• Will relieve traffic on various segments of CR 951, which suffers due to Golden Gate
Blvd dead-ending into it.
• Will provide access to a widened Vanderbilt Beach Road (under construction, to 6 lanes)
which can get vehicles to Livingston Rd, Airport Rd, and US 41 without suffering
through interchange related delays at I-75.
• In many cases, will reduce vehicle miles traveled by providing a more direct route.
• Improves the chances of getting the potential Everglades Blvd/I-75 interchange approved
by the Federal Highway Administration and Florida DOT. In principle, approval of a
new interchange is more likely if additional local road improvements and new alignments
are being implemented, rather than relying on the Interstate Highway System to meet
local needs.

Project Summary
This permit authorizes Conceptual Approval of a stormwater management (SWM)system serving
a 307.50-acre roadway project known as Vanderbilt Beach Road Extension.
The proposed road will extend eastward from the existing section of Vanderbilt Beach Road (VBR)
and veer northward and continue east,between 10th Avenue Northwest and 12th Avenue
Northwest,to the proposed terminus at 16th Street Northeast.The entire project is 7.01 miles in
length.The VBR extension project is divided into two sections and is planned for
phased construction.The first section is a proposed urban typical section from Collier Boulevard to
Wilson Boulevard (approximately 4.98 miles).The second section is a proposed urban typical
section from Wilson Boulevard to 16th Street Northeast (approximately 2.03 miles).The first
section from Collier Boulevard to Wilson Boulevard will have two phases,which will consist of an
interim four-lane (Phase I)urban facility with an ultimate six-lane (Phase II)build out.The second
section from Wilson Boulevard to 16th Street Northeast will have three phases.Phase I is a
modified two-lane facility,Phase II is a four-lane facility and Phase III is an ultimate six-lane
facility.
The SWM system has been divided into sixteen (16)drainage basins,and each basin includes a
stormwater pond designed to provide water quality treatment and attenuation.The proposed
design provides six (6)dry retention ponds and eleven (11) wet detention ponds for water quality
treatment prior to discharging to adjacent canals.All ponds were placed adjacent to the project
right-of-way and discharge via a closed storm drain system to their respective outfalls.Site plans
and details are attached as Exhibit No.2.0.As part of the proposed project,11,000 LF of the

Cypress Canal will be relocated along the south side of the proposed roadway.
Issuance of this permit constitutes certification of compliance with state water quality standards in
accordance with Rule 62-330.062, F.A.C..
Site Description
The proposed project extends east from Collier Boulevard to 16th Street Northeast in Collier
County, Florida. Refer to Exhibit No. 1.0 for a location map.
The existing condition consists of a two-lane roadway with cross drains and roadway ditches
discharging to the Collier Boulevard Canal and Cypress Canal.The remaining portion of the
project consists of developed and undeveloped land discharging to the Cypress Canal,Curry
Canal,Corkscrew Canal,and Orange Tree Canal.There are eleven (11)existing cross drains
along VBR within the project.
For information on wetlands and surface water impacts,please see the Wetlands and Other
Surface Waters section of this permit.
Ownership, Operation and Maintenance
The Collier County Board of County Commissioners is currently working to acquire real property
interest in the proposed project area.Prior to commencement of construction of any phase of
construction,documentation of ownership must be submitted to the Agency.If the property is
conveyed to an entity other than the permittee, a permit transfer will be required.
Perpetual operation and maintenance of the SWM system will be the responsibility of the Collier
County Board of County Commissioners.Upon conveyance or division of ownership or control of
the property or the system,the permittee must notify the Agency in writing within 30 days,and the
new owner must request transfer of the permit.
Engineering Evaluation:
Land Use
Refer to Exhibit No. 2.1 for the land use breakdown per basin.
Water Quality
Water quality treatment will be provided in wet detention lakes and dry retention ponds.The
project will provide the required 37.61 ac-ft of water quality treatment volume based on 2.5 inches
times the percentage of impervious. Refer to Exhibit No.2.2 for information of the required and
provided water quality volumes per basin.
Pursuant to Appendix E of Environmental Resource Permit Applicant's Handbook Volume II,the
provided water quality treatment includes an additional 50%treatment volume above the
requirements in Section 4.2 of Volume II as reasonable assurance that the project will not have an
adverse impact on the downstream waterbody.
The project is located within the watershed of FDEP WBID No.3278S,North Golden Gate Canal,
an impaired basin for Dissolved Oxygen.
In addition to the required water quality treatment volume,the applicant provided site specific
pollutant loading calculations demonstrating that the SWM system reduces the post development
loading of pollutants to levels less than the loadings generated under the pre-development
condition.The pollutant loading calculations are based upon the removal characteristics
associated with the system.
The project includes implementation of a Storm Water Pollution Prevention Plan or Turbidity and
Erosion Control Plan (Exhibit 2.0,pages 187-190)as additional reasonable assurance of
compliance with water quality criteria during construction and operation.

Water Quantity
Refer to Exhibit No.2.3 for the pre-development and post-development discharge rates per basin.
This exhibit also includes the peak stages for the 25 year/3 day and 100 year/3 day storm events,
FEMA elevation, and proposed top of berm and pavement elevations per basin.
Refer to Exhibit No. 2.4 for information on the configuration of each future control structure.
Discharge
The project discharge is within the allowable limit for the area, 0.06 cfs/acre.
Road Design
Minimum road center line elevations have been set at or above the calculated design storm flood
elevation.
Offsite Flows
Stormwater runoff from offsite areas will bypass the proposed SWM system via proposed ditches
and/or pipe outfall.
Flood Plain/Compensating Storage
The permittee submitted a floodplain analysis for the proposed project. The analysis
demonstrated that compensating storage of surface water is not required under post development
conditions.
Certification, Operation, and Maintenance:
Pursuant to Chapter 62-330.310,F.A.C.,Individual Permits will not be converted from the
construction phase to the operation phase until construction completion certification of the project
is submitted to and accepted by the District.This includes compliance with all permit conditions,
except for any long term maintenance and monitoring requirements.It is suggested that the
permittee retain the services of an appropriate professional registered in the State of Florida for
periodic observation of construction of the project.
For projects permitted with an operating entity that is different from the permittee,it should be
noted that until the construction completion certification is accepted by the District and the permit
is transferred to an acceptable operating entity pursuant to Sections 12.1-12.3 of the Applicant's
Handbook Volume I and Section 62-330.310,F.A.C.,the permittee is liable for operation and
maintenance in compliance with the terms and conditions of this permit.
In accordance with Section 373.416(2),F.S.,unless revoked or abandoned,all SWM systems and
works permitted under Part IV of Chapter 373,F.S.,must be operated and maintained in
perpetuity.
The efficiency of SWM systems,dams,impoundments,and most other project components will
decrease over time without periodic maintenance.The operation and maintenance entity must
perform periodic inspections to identify if there are any deficiencies in structural integrity,
degradation due to insufficient maintenance,or improper operation of projects that may endanger
public health,safety,or welfare,or the water resources.If deficiencies are found,the operation
and maintenance entity is responsible for correcting the deficiencies in a timely manner to prevent
compromises to flood protection and water quality.See Section 12.4 of the Applicant's Handbook
Volume I for Minimum Operation and Maintenance Standards.

Environmental Evaluation:
Wetlands and Other Surface Waters
The project site contains 13.09 acres of wetlands and 12.34 acres of other surface waters (OSW),
totaling 25.43 acres.Please see Exhibit 3.0 for wetland and OSW locations.The wetlands can
generally be described as cypress, cypress/pine/cabbage palm and freshwater marsh,while the
OSW can be described as canals.Additional wetland descriptions are available in the ePermitting
file.The project will result in 13.09 acres of direct wetland impacts,2.55 acres of secondary
wetland impacts and 12.34 acres of OSW impacts,as described in the table below.Exhibit
3.1 identifies the locations of the wetlands and OSW being impacted and contains a table that
depicts the wetland area with associated acreages.Being that this is a linear road project,the
wetlands within the project area are 100%directly impacted,with the secondary wetland impacts
extending off-site.
Pursuant to Section 10.2.1 of Applicant's Handbook Volume I (Volume I),the applicant performed
a corridor study in 2006 to determine the viability of the project.The original study extended to
Desoto Boulevard.However,the project was later reduced in size and the current terminus is 16th
Street Northeast.The planning process involved developing five segment alternatives.The viable
alternatives were developed with consideration for the presence of wetlands,protected species
and other natural resources.The current alignment was the most viable alternative.The quality of
the wetlands within the project site is low due to their hydrologic condition, vegetative composition,
wildlife utilization and position within the landscape.Given the constraints involved with developing
a viable road alignment and the condition of the onsite wetlands,the applicant meets the reduction
and elimination of wetland impacts criteria in Section 10.2.1,Volume I.The proposed offsite
mitigation at a mitigation bank will provide greater long-term ecological value than the areas of
wetlands to be impacted by the project.
To mitigate for the direct and secondary wetland impacts,the applicant will purchase 6.42
freshwater forested mitigation bank credits from Panther Island Mitigation Bank,as depicted in
Exhibits 3.2.Of the 13.09 acres of direct wetland impacts,0.50 acres consists of five,isolated
wetland areas of less than 0.50 acres each (W-01,W-05,W-06,W-07 and W-09).Therefore,
mitigation is not required for these areas and these areas were not included in the mitigation
calculation.These five areas were included in the table with the OSW impacts,Activities in
Wetlands or Other Surface Waters,Not Including Mitigation at a Bank.The amount of required
mitigation was determined using the Uniform Mitigation Assessment Method in Chapter 62-345,
F.A.C..The final scores can be found in the ePermitting file.The proposed mitigation is located
within the same basin as the impacts,therefore pursuant to Section 10.2.8 of Volume I,the project
will not result in unacceptable cumulative impacts to the West Collier Basin.
Fish, Wildlife, and Listed Species
The wetlands or surface waters to be impacted have the potential to provide habitat for wetland-
dependent species including Florida bonneted bat,red-cockaded woodpecker,Big Cypress Fox
Squirrel and Florida panther.A Listed Species Survey was conducted in May of 2019.No wetland-
dependent endangered or threatened species or species of special concern were observed onsite.
No aquatic or wetland-dependent listed species or species having special protection were
observed to be using the uplands within the project for nesting or denning.The proposed
mitigation will provide or improve habitat for wetland-dependent and aquatic species.Submitted
information indicates that potential use of the site by such species is minimal.The permittee will
be required to conduct pre-construction surveys for the Florida bonneted bat and the Big Cypress
Fox Squirrel per Special Condition No. 11 herein.
This permit does not relieve the applicant from complying with all applicable rules and any other
agencies'requirements if,in the future,endangered or threatened species or species of special
concern are discovered on the site.

Water Use Permit Status
The applicant has indicated that a source for irrigation water may not be needed for the project.If
it is determined that a Water Use permit is needed,an irrigation application will be submitted with
the construction application and will be reviewed concurrently for this project.
The applicant has indicated that dewatering is required for construction of this project.A Water
Use application for dewatering will be submitted with the construction application and will be
reviewed concurrently for this project.
This permit does not release the permittee from obtaining all necessary Water Use
authorization(s)prior to the commencement of activities which will require such authorization,
including construction dewatering and irrigation.
Historical/ Archeological Resources
On August 29,2019,the District received a letter from the Florida Department of State,Division of
Historical Resources (DHR) requesting the applicant to perform a systematic,professional
archaeological and historical survey.The applicant performed the requested archaeological and
historical survey for the property.The District has subsequently received correspondence from
DHR,dated January 13,2020,indicating that the project is unlikely to affect significant
archaeological or historical resources.
This permit does not release the permittee from complying with any other agencies'requirements
in the event that historical and/or archaeological resources are found on the site.
Right of Way Permit
District Right-of-Way Permits will be required for the three (3)bridges and 13 culvert connections
and associated access features to the District's canals.Refer to Exhibit No.1.1 for the location of
the three future bridges and associated access features.
Third Party Interest
The District has been contacted by a third party with concerns about this application and they will
be copied on this permit.

General Conditions for Conceptual Permits
1. This permit does not authorize any construction,alteration,maintenance,operation,removal,or
abandonment,except where such activities are specifically authorized as the first phase of an
individual permit or are authorized to occur in accordance with a general permit or exemption
under Chapter 62-330, F.A.C.
2. This permit does not:
(a)Convey to the permittee any property rights or privileges,or any other rights or privileges
other than those specified herein or in Chapter 62-330, F.A.C.;
(b) Convey to the permittee or create in the permittee any interest in real property;
(c)Relieve the permittee from the need to obtain and comply with any other required federal,
state, and local authorization, law, rule, or ordinance; or
(d)Authorize any entrance upon or work on property that is not owned,held in easement,or
controlled by the permittee.
3. The permittee shall notify the Agency in writing:
(a) Immediately if any previously submitted information is discovered to be inaccurate; and
(b)Within 30 days of any conveyance or division of ownership or control of the property or the
system, the name and contact information for the new owner.
4. Upon reasonable notice to the permittee,Agency staff with proper identification shall have
permission to enter,inspect,sample,and test the project site to ensure conformity with the
permit.
5. Any delineation of the extent of a wetland or other surface water submitted as part of the permit
application,including plans or other supporting documentation,shall not be considered binding
unless a specific condition of this permit or a formal determination under Rule 62-330.201,
F.A.C., provides otherwise.
6. This conceptual approval permit only authorizes design concepts for a master or future plan to
construct,alter,operate,maintain,remove,or abandon projects that require a permit under Part
IV of Chapter 373,F.S.It does not authorize any construction,alteration,operation,
maintenance,removal,or abandonment,or the establishment and operation of a mitigation
bank, or relieve the permit holder of any requirements to obtain such permits.
7. Subsequent applications to construct and operate activities shall be prepared and submitted
using the applicable procedures in Rules 62-330.052,62-330.054,62-330.060,and 62-330.402
F.A.C.,and sections 4.2.2,4.2.3,4.3,and 4.4 of Volume I.An application for conceptual
approval for a mitigation bank shall also include the materials required by Chapter 62-342,
F.A.C.
8. Issuance of this conceptual approval permit is a determination,within the level of detail provided
in the application,that the activities approved in this permit are consistent with applicable rules
at the time of issuance.This permit provides the conceptual approval permit holder with a
rebuttable presumption,during the duration of this permit,that the engineering design and
scientific principles upon which the conceptual approval permit approved herein are likely to
meet applicable rule criteria for issuance of permits for subsequent phases of the project,
provided all of the following are met at the time of receipt of a complete application to construct
and operate the future phases:
(a)The application to construct and operate the future phases remains consistent with the
designs and conditions of this permit.Primary areas for consistency comparisons include the
size,location,and extent of the activities proposed,the type and nature of the activities,percent
imperviousness,allowable discharge and points of discharge,location and extent of wetland

and other surface water impacts,mitigation plans implemented or proposed,control elevations,
extent of stormwater reuse, detention and retention volumes, and the extent of flood elevations.
If an application for construction of any portion of the land area covered by this permit is
inconsistent with the design concepts and conditions approved herein,the application will be
reviewed to determine the extent to which the inconsistency will affect the designs and
conditions for the remainder of the lands contained in this permit.If the inconsistency will
materially affect those designs and conditions,then the applicant must demonstrate that the
holder of this permit agrees to that inconsistency.In such a case,the holder of the conceptual
approval permit may:
1. Modify the conceptual approval permit to conform to the revised design;
2. Abandon reliance on the conceptual approval permit; or
3.Rely on those portions of the conceptual approval permit for only those areas that were not
affected by the inconsistency.
(b)There are no changes to state water quality standards that would be affected by activities
authorized in the conceptual approval permit that have not already been authorized for
construction or operation.
(c)There have been no amendments to Florida law governing special basin criteria that would
affect future activities authorized by the conceptual approval permit that have not already been
authorized for construction.
(d)There are no substantive changes in the site characteristics that would affect whether the
design concepts approved in the conceptual approval permit can continue to be reasonably
expected to meet the conditions for authorizing construction of future phases.This shall include
such things as changes in the designation of listed species,and changes to nesting,denning,
and critical designation status of listed species that exist within the lands served by the project
area.
9. If changes are proposed to the design of existing or future phases,or where there have been
changes to state water quality standards,special basins,or site characteristics as described in
conditions (3)(a)through (d),above,during the duration of this permit,the applicant must modify
this permit if it wishes to continue to rely on this permit as a basis that reasonable assurance
exists for the Agency to issue future construction or operation permits under the terms and
conditions of this permit.If the permittee fails to do this,this conceptual approval permit can no
longer be relied upon as a basis,in part or whole,under which permits to construct or operate
future phases will be issued,and the Agency will reevaluate the terms and conditions of this
permit at the time a permit application is received to construct the next phase of activities,or at
the next requested extension of this permit’s duration in accordance with subsection
62-330.056(11), F.A.C., whichever occurs first.

Special Conditions for Conceptual Permits
1.The Conceptual Approval shall expire on the date shown on page 2 of this permit,in accordance
with Rules 62-330.056(9) and (10), F.A.C.
2.Operation and maintenance of the stormwater management system shall be the responsibility of
the Collier County Board of County Commissioners.
3.Prior to any future construction and pursuant to Section 4.2.3(d)(3)of Applicant's Handbook
Volume I,the permittee shall demonstrate ownership of the project area to the District's
Environmental Resource Compliance staff.
4.Prior to any future construction,the permittee shall apply for and receive an Individual ERP.As
part of the permit application,the applicant for that phase shall provide documentation verifying
that the proposed construction is consistent with the design of the master stormwater
management system, including the land use and site grading assumptions.
5.This permit does not authorize the permittee to cause any adverse impact to or “take”of state
listed species and other regulated species of fish and wildlife.Compliance with state laws
regulating the take of fish and wildlife is the responsibility of the owner or applicant associated
with this project.Please refer to Chapter 68A-27 of the Florida Administrative Code for definitions
of “take”and a list of fish and wildlife species.If listed species are observed onsite,FWC staff
are available to provide decision support information or assist in obtaining the appropriate FWC
permits.Most marine endangered and threatened species are statutorily protected and a “take”
permit cannot be issued.Requests for further information or review can be sent to:
FWCConservationPlanningServices@MyFWC.com.
6.Prior to the commencement of construction,the perimeter of protected wetland areas shall be
staked/roped/fenced to prevent encroachment into the protected areas.Using Global Positioning
System (GPS)technology,the perimeter of the preserve area(s)shall be identified for future
reference.The data shall be differentially corrected and accurate to less than a meter (+/-one
meter or better).Electronic copies of the GPS data shall be provided to the District's
Environmental Resource Compliance staff.The permittee shall notify the District's Environmental
Resource Compliance staff in writing upon completion of staking/roping/fencing and schedule an
inspection of this work.The staking/roping/fencing shall be subject to District staff approval.The
permittee shall modify the staking/roping/fencing if District staff determines that it is insufficient or
is not in conformance with the intent of this permit.Staking/roping/fencing shall remain in place
until all adjacent construction activities are complete.
7.Endangered species,threatened species and/or species of special concern have been observed
onsite and/or the project contains suitable habitat for these species.It shall be the permittee's
responsibility to coordinate with the Florida Fish and Wildlife Conservation Commission and/or
the U.S.Fish and Wildlife Service for appropriate guidance,recommendations and/or necessary
permits to avoid impacts to listed species.
8.Prior to commencement of construction the permittee shall submit documentation from Panther
Island Mitigation Bank that 6.42 freshwater forested UMAM (Uniform Mitgation Assessment
Method)credits for this project have been paid for in full and deducted from the Panther Island
Mitigation Bank's official agency ledger.

9.(a)This conceptual approval permit only authorizes design concepts for a master or future plan

with applicable rules at the time of issuance.This permit provides the conceptual approval permit
holder with a rebuttable presumption,during the duration of this permit,that the engineering
design and environmental concepts upon which the designs approved herein are likely to meet
applicable rule criteria for issuance of permits for subsequent phases of the project,provided all
of the requirements of Rule 62-330.056(7)(a)through (d),F.A.C are met at the time of receipt of
a complete application to construct and operate the future phase(s).(d)If changes are proposed
to the design of existing or future phases,or where there have been changes to state water
quality standards,special basins,or site characteristics as described in rule 62-330.056(7)(a)
through (d),F.A.C,during the duration of this permit,the applicant must modify this permit if it
wishes to continue to rely on it as a basis that reasonable assurance exists for the Agency to
issue future construction or operation permits.If the permittee fails to do this,this conceptual
approval permit can no longer be relied upon as a basis,in part or whole,for permits to construct
or operate future phases,and the Agency will reevaluate the terms and conditions of this permit
at the time a permit application is received to construct the next phase of activities.(e)The
duration of this conceptual approval permit is 20 years,provided that,within five years of
issuance of this permit:1.The permittee applies for and receives an Individual Permit for the
initial phase of construction or alteration and 2.The authorized construction or alteration has
begun and the work remains in compliance with the terms and conditions of both the conceptual
approval permit and all permits authorizing construction or alteration,including required
operation.These time periods will be tolled if the Agency is notified,in writing,within five years of
issuance that administrative review under either of the following is pending:a.The project
approved by the conceptual approval permit is undergoing Development of Regional Impact
review pursuant to Section 380.06,F.S.,and an administrative appeal of that review has been
filed;or b.The issuance of the construction permit for the first phase is under administrative
review pursuant to Sections 120.569 or 120.57, F.S.
10.The permittee shall comply with the guidelines set forth by the Florida Fish and Wildlife
Conservation Commission for Big Cypress fox squirrel and Florida bonneted bat species
management.Within 60 days of initiating construction activities,the site shall be surveyed for
the presence of active Big Cypress fox squirrel nests and bonneted bat cavity trees.A copy of
the listed species survey shall be submitted to District staff for review.A 125 foot radius
undisturbed buffer must be maintained around all active nests and cavity trees.After
establishing the buffer,contact District Compliance Staff for an inspection.Following nesting
activities,the nesting tree may be removed following coordination with the Florida Fish and
Wildlife Conservation Commission and obtaining all required permits.Any modifications to this
program shall require prior written approval from District staff.

NOTICE OF RIGHTS
As required by Chapter 120,Florida Statutes,the following provides notice of the opportunities
which may be available for administrative hearing pursuant to Sections 120.569 and 120.57,
Florida Statutes,or judicial review pursuant to Section 120.68,Florida Statutes,when the
substantial interests of a party are determined by an agency. Please note that this Notice of
Rights is not intended to provide legal advice. Some of the legal proceedings detailed below
may not be applicable or appropriate for your situation. You may wish to consult an attorney
regarding your legal rights.
RIGHT TO REQUEST ADMINISTRATIVE HEARING
A person whose substantial interests are or may be affected by the South Florida Water
Management District’s (District)action has the right to request an administrative hearing on
that action pursuant to Sections 120.569 and 120.57,Florida Statutes. Persons seeking a
hearing on a District decision which affects or may affect their substantial interests shall file a
petition for hearing in accordance with the filing instructions set forth herein within 21 days of
receipt of written notice of the decision unless one of the following shorter time periods apply:
(1)within 14 days of the notice of consolidated intent to grant or deny concurrently reviewed
applications for environmental resource permits and use of sovereign submerged lands
pursuant to Section 373.427,Florida Statutes;or (2)within 14 days of service of an
Administrative Order pursuant to Section 373.119(1),Florida Statutes. "Receipt of written
notice of agency decision"means receipt of written notice through mail,electronic mail,posting,
or publication that the District has taken or intends to take final agency action. Any person who
receives written notice of a District decision and fails to file a written request for hearing within
the timeframe described above waives the right to request a hearing on that decision.
If the District takes final agency action that materially differs from the noticed intended agency
decision,persons who may be substantially affected shall,unless otherwise provided by law,
have an additional point of entry pursuant to Rule 28-106.111, Florida Administrative Code.
Any person to whom an emergency order is directed pursuant to Section 373.119(2),Florida
Statutes,shall comply therewith immediately,but on petition to the board shall be afforded a
hearing as soon as possible.
A person may file a request for an extension of time for filing a petition. The District may grant
the request for good cause. Requests for extension of time must be filed with the District prior
to the deadline for filing a petition for hearing. Such requests for extension shall contain a
certificate that the moving party has consulted with all other parties concerning the extension
and whether the District and any other parties agree to or oppose the extension. A timely
request for an extension of time shall toll the running of the time period for filing a petition until
the request is acted upon.
FILING INSTRUCTIONS
A petition for administrative hearing must be filed with the Office of the District Clerk. Filings
with the Office of the District Clerk may be made by mail,hand-delivery,or e-mail. Filings by
facsimile will not be accepted. A petition for administrative hearing or other document is
deemed filed upon receipt during normal business hours by the Office of the District Clerk at

Filings by hand-delivery must be delivered to the Office of the District Clerk. Delivery of a

INITIATION OF ADMINISTRATIVE HEARING

contends warrant reversal or modification of the District’s proposed action.
A statement of the specific rules or statutes the petitioner contends require reversal or7.
modification of the District’s proposed action.
If disputed issues of material fact exist,the statement must also include an explanation of8.
how the alleged facts relate to the specific rules or statutes.
A statement of the relief sought by the petitioner,stating precisely the action the petitioner9.
wishes the District to take with respect to the District’s proposed action.
MEDIATION
The procedures for pursuing mediation are set forth in Section 120.573,Florida Statutes,and
Rules 28-106.111 and 28-106.401–.405,Florida Administrative Code. The District is not
proposing mediation for this agency action under Section 120.573,Florida Statutes,at this
time.
RIGHT TO SEEK JUDICIAL REVIEW
Pursuant to Section 120.68,Florida Statutes,and in accordance with Florida Rule of Appellate
Procedure 9.110,a party who is adversely affected by final District action may seek judicial
review of the District's final decision by filing a notice of appeal with the Office of the District
