The subject property is located on the south side of Terrace Avenue, approximately 200-feet west of Airport Pulling Road, in Section 2, Township 50 South, Range 25 East, Collier County, Florida. (PL20180002229) _____________________________________________________________________________________ OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in the 15-foot utility easement as described in the order of taking, Case No. 89-0957-CA-01-HDH, recorded in Official Record Book 1472, page 1618 of the public records of Collier County, Florida, located on the east side of Lot 35, Block A, Rock Creek Park, recorded in Plat Book 1, page 79, of the public records of Collier County, Florida, in Section 2, Township 50 South, Range 25 East, Collier County, Florida, being more specifically shown in Exhibit A. CONSIDERATIONS: Petition VAC-PL20180002229 has been received by the Development Review Division, Growth Management Department from Kristina M. Johnson, P.E., of J.R. Evans Engineering, P.A., as agent for the Petitioner, to request the County vacate its interest in the 15-foot utility easement as described in the order of taking, Case No. 89-0957-CA-01-HDH, recorded in Official Record Book 1472, page 1618 of the public records of Collier County, Florida, located on the east side of Lot 35, Block A, Rock Creek Park, recorded in Plat Book 1, page 79, of the public records of Collier County, Florida, in Section 2, Township 50 South, Range 25 East, Collier County, Florida. According to the Property Appraiser’s website, the Petitioner, TT of Tamiami, Inc., is fee simple owner of the portion of Lot 35, wherein this easement is located. The Porsche Naples site is currently permitted for the construction of a Porsche Dealership, parking garage, and supportive infrastructure. This application includes the modification to the site that resulted in an additional corner lot for parking, a drive-through car wash with additional detail bays, and supportive infrastructure, which is being permitted concurrent with this application under PL20190001474. The County originally acquired the easement via Order of Taking, Case No. 89-0957-CA-01-HDH, recorded in Official Record Book 1472, page 1618 of the public records of Collier County, Florida. The easement was formerly serving a gravity main to a nearby office building. That office building has since been demolished, and the property is now owned by the applicant. The gravity main, including the sewer facilities located under the easement and within the right-of-way, will be removed by the applicant as part of SDP PL20190001474, and the easement will no longer be needed. There are no proposed modifications to the existing utilities serving adjacent properties. The vacation of the easement will not interrupt the water, sewer, cable, internet, and/or telephone services to adjacent properties. Further, the Petitioner has requested that the County quitclaim its interest in the subject easement in order to create a clean title for ownership transfer by removing encumbrances that are affecting the property. A quitclaim deed conveys whatever title or interest a grantor has in the described real estate. The instrument operates as a release of the grantor’s title or interest in the property. A quitclaim deed contains no covenants of title or warranty, and it does not purport to convey any particular type of estate. The form’s main use is to clear possible clouds on the property’s title. Further, this quitclaim deed will only act to release the County’s interest in this easement. Any additional private rights created or affected by third 17.H Packet Pg. 2176 06/09/2020 parties, if any, over this utility easement must be separately terminated. There is no public detriment to this vacation because the County no longer requires the facilities in the easement; therefore, the easement is not needed. The Development Review Division has reviewed this Petition and found no reason for objection. FISCAL IMPACT: Growth Management Department, Development Review Division staff, has collected a $2,000 “Petition to Vacate” fee from the Petitioner, which covers the County’s cost of recording and processing the Petition. LEGAL CONSIDERATIONS: Petitioner is requesting to vacate the County and the public interest in its interest in the 15-foot utility easement as described in the order of taking, Case No. 89 -0957-CA-01- HDH, recorded in Official Record Book 1472, page 1618 of the public records of Collier County, Florida, located on the east side of Lot 35, Block A, Rock Creek Park, recorded in Plat Book 1, page 79, of the public records of Collier County, Florida, in Section 2, Township 50 South, Range 25 East, Collier County, Florida, as further described in Exhibit A to the attached Resolution. Pursuant to Resolution 2013-166 and Florida Statutes Sections 125.01 and 125.37, the Board may adopt resolutions to extinguish, vacate, abandon, discontinue, and close any easements, or any portion thereof, granted to the County or public by any instrument recorded in the public records of Collier County and to renounce and disclaim any right of the County and the public in and to any land in connection therewith; when such interest is granted to the County or public by any instrument recorded in the public records other than on a subdivision plat when the following criteria are met: 1. Public benefit is established, or no public detriment is established. 2. The Petitioner owns the fee simple title to the whole or that part of the parcel on which a public or County dedicated easement is sought to be extinguished This item has been approved as to form and legality, and requires a majority vote for Board approval -- SAA GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this action. RECOMMENDATION: To approve the attached Resolution, relating to Petition VAC-PL20180002229, which will vacate the County and the public interest in the 15-foot utility easement as described in the order of taking, Case No. 89-0957-CA-01-HDH, recorded in Official Record Book 1472, page 1618 of the public records of Collier County, Florida, in Section 2, Township 50 South, Range 25 East, Collier County, Florida, and directs the Clerk to the Board to record a certified copy of the Resolution in the public records.
