Recommendation to approve Petition VAC-PL20200000468, to disclaim, renounce and vacate the County and the public interest in a portion of the Sanitary Force Main Utility Easement as recorded in Official Record Book 2706, Page 2637 of the public records of Collier County, Florida, located on the south side of Golden Gate Parkway, approximately 0.4 miles west of Livingston Road, in Section 25, Township 49 South, Range 25 East, Collier County, Florida. OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in a portion of the Sanitary Force Main Utility Easement as recorded in Official Record Book 2706, Page 2637 of the public records of Collier County, Florida, located on the south side of Golden Gate Parkway, approximately 0.4 miles west of Livingston Road in Section 25, Township 49 South, Range 25 East, Collier County, Florida, being more specifically shown in Exhibit A. CONSIDERATIONS: Petition VAC-PL20200000468 has been received by the Development Review Division, Growth Management Department from Ray Piacente of Stantec Consulting Services, Inc., as agent for the property owner, to vacate a portion of the Sanitary Force Main Utility Easement as recorded in Official Record Book 2706, Page 2637 of the public records of Collier County, Florida, located on the south side of Golden Gate Parkway, approximately 0.4 miles west of Livingston Road, in Section 25, Township 49 South, Range 25 East, Collier County, Florida. The property owner (LB Naples Grande, LLC) for the Moorings Park at Grande Lake (MPGL) (F.K.A. Naples Grande) project has filed a petition to Collier County requesting a portion of an existing Collier County utility easement to be vacated from their property. The existing Collier County Sanitary Force Main Utility Easement (Utility Easement), recorded under OR Book 2706, was initially designed to accommodate a wastewater system that would support the Project and be entirely owned and maintained by Collier County. However, over time, the proposed development for this project has changed. As a result, the majority of the wastewater system that supports the MPGL project is privately owned and maintained. Considering only a portion of the wastewater system will be owned and maintained by Collier County, the required utility easement located within MPGL property can be reduced in size, and to only encompass the existing Collier County force main that serves this project and other projects upstream. The remaining easement will provide the required width for access and maintenance considerations, as specified within the Collier County Water-Sewer Standards Manual. Vacating this portion of the easement will eliminate the unnecessary encroachment into the subject property and its impact on the future building development area for the MPGL project. Furthermore, the proposed vacation will not pose any adverse impacts to the adjacent property owners, the public or the City of Naples and Collier County operations in maintaining, repairing or replacing any public infrastructure that is encompassed by the remaining Collier County utility easement. The Development Review Division has reviewed this petition and found no reason for objection. FISCAL IMPACT: Growth Management Department, Development Review Division staff, has collected a $2,000 “Petition to Vacate” fee from the petitioner, which covers the County’s cost of recording and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this action. 17.G Packet Pg. 2120 06/09/2020 LEGAL CONSIDERATIONS: Petitioner is requesting to vacate a portion of the Sanitary Force Main Utility easement as recorded in Official Record Book 2706, Page 2637 of the public records of Collier County, Florida, located on the south side of Golden Gate Parkway, approximately 0.4 miles west of Livingston Road in Section 24, Township 50 South, Range 25 East, Collier County, Florida, as further described in Exhibit A to the attached Resolution. Pursuant to Resolution 2013-166 and Florida Statutes Sections 125.01 and 125.37, the Board may adopt resolutions to extinguish, vacate, abandon, discontinue, and close any easements, or any portion thereof, granted to the County or public by any instrument recorded in the public records of Collier County and to renounce and disclaim any right of the County and the public in and to any land in connection therewith; when such interest is granted to the County or public by any instrument recorded in the public records other than on a subdivision plat, when the following criteria are met: 1. Public benefit is established, or no public detriment is established. 2. The existing Collier County Sanitary Force Main Utility Easement (Utility Easement), recorded under OR Book 2706, was originally designed to accommodate a wastewater system that would support the Project and be entirely owned and maintained by Collier County. However, over a period of time, the proposed development for this project has changed; and as a result, a portion of the wastewater system that supports the Moorings Park at Grande Lake project is privately owned and maintained. Since only a portion of the wastewater system will be owned and maintained by Collier County, the required utility easement located within Moorings Park at Grande Lake property can be reduced in size, and to only encompass the existing Collier County force main that serves this project and other projects upstream. The remaining easement will provide the required width for access and maintenance considerations as specified within the Collier County Water-Sewer Standards Manual. Vacating this portion of the easement will eliminate the unnecessary encroachment into the subject property and its impact with the future building development area for the Moorings Park at Grande Lake project. As part of the formal procedure for this easement vacation petition, Collier County requires a Letter of No Objection from your office.
