Agenda 06/09/2020 Item #16D10 (Waiving Contractual Payment Obligations for Parks & Rec)06/09/2020 EXECUTIVE SUMMARY Recommendation to waive contractual payment obligations for Parks and Recreation concessionaires from March 1 through May 31, 2020 due to the COVID-19 Pandemic. OBJECTIVE: To avoid additional financial distress on Parks and Recreation concessionaires as a result of the COVID-19 Pandemic. CONSIDERATIONS: On March 12, 2020, Governor Ron DeSantis issued Executive Order #20-52, declaring a State of Emergency exists in the State of Florida. On March 16, 2020, the Board of County Commissioners (Board) declared a local State of Emergency Resolution No. 2020 -50. Shortly thereafter, the Parks and Recreation Division (Division) began closing most amenities within both the regional and community parks. The Division has a variety of concessionaire agreements including, but not limited to Marina, Pickleball and Tennis operations, food and beverage services, beach concessions with rental of umbrellas, paddleboards, cabanas, beach chairs, sales of beach-related sundries, caps, shirts, and other like services. Concessionaire revenues are due by the 15th of each month for the preceding month. As outlined in the table below, the Division received $43,413.27 in contractual revenue for February with $7,452.01 in revenue still outstanding from concessionaires from sales and rentals. Additionally, staff recommends that the Board waive collection of the May 2020 concession revenues to further assist each concessionaire in getting their businesses more financially stable. Concession revenues historically average $35,000 in the 16.D.10 Packet Pg. 1247 06/09/2020 month of May. FISCAL IMPACT: Staff estimates that waiving concession revenues for the months of March, April and May would result in a total loss of between $70,000 and $75,000 in operating revenue budgeted in individual cost centers within the Parks and Recreation Division General Fund (001) and the MSTD General Fund (111) budget. GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan from this action. LEGAL CONSIDERATIONS: This Item has been reviewed by the County Attorney, is approved as to form and legality and requires majority vote for approval. By approving this Item, the Board would be finding as a public purpose that financially assisting our longstanding concessionaires, many of whom are in financial distress as a result of our closing Collier County’s parks and beaches, is in the public’s interest, falls within the Board’s general economic development powers, and is little different from the many grants now being issued to help businesses adversely affected by the pandemic. -JAK RECOMMENDATION: To waive contractual payment obligations for Parks and Recreation concessionaires from March 1 - May 31, 2020, due to the COVID-19 Pandemic.
