Agenda 06/09/2020 Item #16A15 (Resolution - CR 92 Culvert Relocation w/SFWMD)06/09/2020 EXECUTIVE SUMMARY Recommendation to adopt a resolution approving a relocation agreement, the conveyance of a temporary work area easement and a perpetual flowage, occasional flowage and culvert easement to the South Florida Water Management District, required for construction of a culvert under CR 92 for the Picayune Strand Restoration Project, as part of the Comprehensive Everglades Restoration Plan. Estimated fiscal impact: Minimal maintenance costs only. OBJECTIVE: To convey temporary and permanent easements to the South Florida Water Management District (the District), needed for construction of a culvert under CR 92 for the Picayune Strand Restoration Project (the Project), as part of the Comprehensive Everglades Restoration Plan. CONSIDERATIONS: The United States Army Corps of Engineers (the Army Corps), in partnership with the District, wishes to construct a concrete box culvert under CR 92, approximately 2,400 feet west of its intersection with US 41, as part of the Project. The Project improvements are intended to restore and enhance wetlands within public lands and improve water quality of coastal estuaries. The District has applied to Collier County for conveyance of a temporary work area easement (duration 36 months) and a perpetual flowage, occasional flowage and culvert easement. These easements are needed for construction of the culvert and the establishment of a second permanent flow way under CR 92. The location of the easements is graphically depicted on the attached aerial map. The attached agreement sets forth the rights and obligations of the County, the District and the United States Army Corps of Engineers. The permanent easement will only be executed once construction is completed and after the County has inspected and approved the culvert and related improvements. The Army Corps and the District will comply with all Florida Department of Transportation and Collier County Maintenance of Traffic requirements during construction of the Project. Collier County will maintain the culvert in perpetuity as part of the maintenance of CR 92. FISCAL IMPACT: The improvements will be constructed at no cost to the County. The District will pay the costs of recording the easements. Incremental maintenance costs for the culvert are estimated at $3,300 per year for cleaning and clearing, vegetation spray treatment, weed eating and mowing. These incremental costs will be funded within Stormwater Operating Fund (103). GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the Long-Range Transportation Plan and the Collier County Growth Management Plan. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. - JAB RECOMMENDATION: To approve and authorize the Chairman to execute: 1. The Resolution and the referenced Relocation Agreement that are back-up to this item; 2. The easement instruments set forth in Exhibits “A” and “B” to the Relocation Agreement; and 3. Any such other closing documents needed to effectuate transfer, after approval by the Office of the County Attorney.
