OBJECTIVE: Recommendation to approve the selection committee's ranking and authorize staff to enter into contract negotiations with Atkins North America, Inc., concerning RPS # 20-7677, "Upper Gordon River Weir Replacement Design Services," so that a proposed agreement can be brought back for the Board's consideration at a subsequent meeting. CONSIDERATIONS: On January 21, 2020, the Procurement Services Division publicly noticed RPS # 20-7677, "Upper Gordon River Weir Replacement Design Services." The County notified 9,526 firms, 89 interested firms downloaded the solicitation package, and the County received three (3) proposals by the March 5, 2020 deadline. A selection committee convened on April 10, 2020, scored each of the proposals, and short-listed the top three firms. On April 22, 2020, the selection committee reconvened for presentations and the committee ranked the firms as shown below. If staff is unable to reach an agreement with the number one ranked firm, staff will continue negotiating with the remaining firms in ranked order. FISCAL IMPACT: Funding is available in the Upper Gordon River project number 60102 with in the Stormwater Capital Projects Fund 325. The funding source is grants and transfers from the General Fund. GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated with this action. C-2 Naples, FL 34112 All proposals shall be submitted online via the Collier County Procurement Services Division Online Bidding System: hLtps://www.bidsync.com/bidsync-cas INTRODUCTION As requested by the Capital Project Planning, Impact Fees & Program Management Division (hereinafter, the "Division or Department"), the Collier County Board of County Commissioners Procurement Services Division (hereinafter, "County") has issued this Request for Professional Services (hereinafter, "RPS") with the intent of obtaining proposals from interested and qualified Consultants in accordance with the terms, conditions and specifications stated or attached. The Consultant, at a minimum, must achieve the requirements of the Specifications or Scope of Work stated. This project scope will consist of professional engineering design, permitting, and Engineer -of -Record services related to the replacement of the weir facility which lies within the Upper Gordon River. The structure is located on the south side of Golden Gate Parkway approximately one-half mile east of the intersection of Golden Gate Parkway and Goodlette Road, just west of the Bears Paw development, in Naples, Florida. The structure consists of two Amil gates which control the discharge of surface water from the Gordon River into the tidally influenced receiving water of the lower portion of the Gordon River. A location map is attached as Exhibit "A". BACKGROUND The weir structure is over 40 years old and is in dilapidated condition. Engineering and hydraulic evaluations conducted by the Collier County Government (hereinafter the "COUNTY") have recommended replacement of the structure by an efficiently operable gated structure. Currently, a stopgap measure project is being performed to refurbish the existing weir gates to a level of operability that will enable them to continue to function properly for protection of surface water resources in the interim until the replacement is built. The COUNTY is seeking to replace this facility subsequent to the temporary emergency repair. The chosen engineer/designer (hereinafter the `ENGINEER") will be tasked with design of a plan to remove the existing facility and create plans & specs for construction of a replacement weir. The objective of the contract is to develop final hydraulic and structural design of the structure with construction plans and specifications, obtain all required regulatory permits and provide Engineer -of -Record services during construction for replacement of the Gordon River Weir. TERM OF CONTRACT County reserves the right to modify this scope during negotiations for budgetary reasons. The contract term, if an award is made, is intended to be for 35 months, and will commence on the date of the Notice to Proceed. Prices shall remain firm for the term of the awarded contract. Surcharges will not be accepted in conjunction with this award, and such charges should be incorporated into the pricing structure. DETAILED SCOPE OF WORK Task A. Assess Site Task Al. Survey Collect vertical and horizontal survey data sufficient to create plans for, facilitate ingress and egress to, and appropriately manage property use during construction and subsequent operation and maintenance of the structure. This should include but not be limited to establishment of linework, and verification of ownership of all affected property, along with identification of details of surface and underground utilities at site, stormwater outlets, including elements such as culvert size, type and invert elevation, extent of concrete slabs, water surface, fencing, trees, and any topography changes such as c m E a) U ca 0. d L L m c 0 L O CO) 00 N N 0 ns 2 0 Cn ti co ti 0 N _ d E t n: Q grade breaks (top of bank, toe of slope, etc.). Bathymetry of the nearby channel should also be obtained, Packet Pg. 577 16.A.12.d cross -sections 100 feet upstream and up to 100 feet downstream (depending on necessity) of the weir, every 25 fee laterally as far as possible to a maximum of 25 feet beyond top of bank. The horizontal datum shall be NAD83, and the vertical datum shall be NAVD88. 2. Should temporary easements be required, sketch -and -legal (S&L) descriptions will be part of the scope. It will be up to the ENGINEER to make such a determination. Estimated scope price should be for three S&Ls. Task A2. Geotechnical Assessment Perform Geotech site work sufficient with which to base weir design. It is anticipated that approximately five soil borings, to approximately 20 feet below the depth of the bottom of the canal, or at least to solid rock, will be needed. A Geotechnical Report is to be submitted, with necessary information about subsurface conditions which can include but not be limited to that published by United States Geological Survey (USGS), and United States Department of Agriculture (USDA)Natural Resources Conservation Service (MRCS). The soils encountered should be classified according to the Unified Soil Classification System (USCS). Task B. Weir Design Process Task BL Establish plan to remove existing Amil Gate The ENGINEER will create a plan to dismantle and remove the Ami1 Gate facility as it exists at the start of the design work. This plan will be part of the bid package for the contractor to bid on. The channel bottom will be left in a condition to match the surrounding subsurface area after removal of the gate structure. Task B2. Design new weir U The weir is to be a straight standard weir with two slide gates. The hydraulic design parameters — design flow, control elevation, gate sizes, and seasonal operating criteria recommended in the preliminary engineering study (Agnoli, Barber and Brundage, Inc.; December 2018) will be verified to achieve the desired levels of flood protection under a 25-year, 3-day design storm. Incorporation of a Sea Level Rise consideration shall be part of the design, based on a currently accepted moderate prediction of conditions in the year 2050. a`) 1. The weir is to be fully automated, and specifically shall have: 1) mechanized gate actuation, 2) sensing for gate status and W water levels, upstream and downstream, 3) remote monitoring, 4) remote operation, and an RTU backup control program. c This system (known as "Supervisor Controlled Automatic Data Acquisition" or SCADA) will be designed to be '0 L. compatible with the remote monitoring and operating systems currently used by the South Florida Water Management District (SFWMD). 2. A subsurface sheet pile wall to prevent seepage under the weir is to be part of the design. A seepage analysis shall be done M N to determine size and specifications of the wall. N 3. The new weir should also have a catwalk for maintenance access, hand rails for safety, and chain link fencing and/or gates c at entrances for security. It also will need a backup generator system. W M 4. The area around the weir will be assessed for design of a new entrance off Golden Gate Parkway and a new parking area .2 for maintenance and other vehicles, and materials and equipment. The entrance is to be appropriately designed for i0 convenience and safety, with proper signage, railing, fencing, etc. 5. A constructability review of the plan set is to be accomplished by staff other than the lead design engineer, preferably staff ti ti members who have field experience with construction. c N Task B3. Permitting The ENGINEER shall ensure all pertinent permitting agencies are informed of this project and will inquire and negotiate with these m t agencies regarding the necessity of Permits. The ENGINEER will meet with the COUNTY to discuss and then accomplish all procedures to procure necessary State (SFWMD, FDEP) and Federal (USAGE) Permits if needed. Q Additionally, the ENGINEER will apply for and procure a basic dewatering permit to be provided to the contractor for possible modification, to enable contractor's construction plans, means and methods. Task C. Bidding Services The ENGINEER will be available to assist the COUNTY through the construction bidding period, when tasks such as clarifications regarding plans and specifications are needed, or to provide input / approval on contractor selection. The entire Bidding Process typically takes three to five months in Collier County; it begins with preparation of the entire bid package and continues through to the Board of County Commissioners meeting at which the lowest qualified bidder is awarded the contract. Task D. Construction Assistance The ENGINEER will be available to assist the COUNTY through the construction period for shop drawing review and approval, submittal review, plan clarification or inconsequential field changes to plans, and other tasks that will need input from the Engineer -of -Record. Record drawings will be required as well. PROJECT SCHEDULE - Once the contract has been awarded to the ENGINEER, the design work herein must be completed in eighteen (18 Packet Pg. 578 Bidding is expected to last up to approximately five months, and construction services provided by the ENGINEER should 1 16.A.12.d year (Construction itself is expected to be of a shorter duration). Location 1 is an assessment of potential stormwater benefits related to this future segment of the Legacy Trail, along with providing an alternative analysis report. Location 2 is an assessment of ditches along the trail with regard to flooding concerns and providing a technical report. Location 3 involved updating the existing ICPR model, providing design and permitting documents for stormwater improvements, and developing 100% construction documents. Location 4 involved the evaluation of erosion concerns along approximately 1,000 linear feet of Legacy Trail north of Hatchett Creek and develop a drainage assessment report. Bull Frog Creek/Wolf Branch Watershed Management Plan Update, Hillsborough County, FL. Deputy project manager and H&H engineer involved in the H&H computer modeling for this project. The goal of this project was to update the WMP for the 70-square-mile watershed. Along with converting the model from HCSWMM4 to HC-SWMM5.1, model updates included those related to land use and stormwater system changes, as well as the changes necessary to make the model consistent with SWFWMD Watershed Management Program G&S. The project includes a review of previous master plan recommendations and identification of new recommended actions to meet flood protection levels of service criteria. Project manager on this project to alleviate flooding on the roadway and adjacent properties by upgrading the drainage system in the vicinity of Rawls Road and Hutchison Road, which is within the Rocky/Brushy Creek watershed. Project tasks included site analysis, H&H modeling, roadway analysis, and maintenance considerations with a goal to develop a preliminary engineering report (PER) to provide the County with two alternatives and associated cost estimates. Providence Road Culvert Replacement, Hillsborough County, FL. Project manager of this culvert replacement project located in the Delaney Creek watershed. The objective was to replace the three existing corrugated metal pipes under Providence Road and in poor condition with three elliptical reinforced concrete pipes. Utilized the conceptual plans, surveys, and maps provided by the County and supplemented with additional data to develop final plans, permitting, specifications, and cost estimates. As senior ecologist, tasks included development and application of landscape -level, GIS- based methods to compare pre -development and current ecological conditions in seven watersheds totaling over 1,200 square miles, to assist Collier County to prioritize and select watershed restoration projects. Collier County subsequently implemented several of the recommended projects based on this analysis and ranking. This included evaluation of submerged aquatic vegetation, other benthic resources, mangroves and other shoreline wetlands, and development of up -front seagrass mitigation alternatives to reduce cost, risk, and uncertainty of future project construction. SR 542, from Buckeye Loop to US 27 Widening and Reconstruction Design Services, FDOT, District One, Winter Haven, FL. Senior ecological scientist/task manager responsible for sand skink surveys, wetland delineations, seasonal highwater level determination, pond siting evaluations, and environmental permits. Sunshine Lake/Sunrise Waterway Management Plan, Charlotte County, FL. Project manager. This project included the detailed assessment of both surface and groundwater contributions to the Sunshine Lake/Sunrise Waterway which had undergone a rapid degradation in water quality. The project initially identified sources of degradation through water quality monitoring component, including nutrients, dissolved oxygen, fecal coliform, and other parameters. The results led to development of several management actions, which have been implemented and resulted in significantly improved water quality. Upper Peninsula Drainage Improvement, City of Tampa, FL. Environmental permitting manager. Atkins engineers in collaboration with a construction contractor designed and constructed an extensive system of upgraded drainage culverts to reduce flooding at key commercial and residential intersections in south Tampa. Permits included an Individual ERP from SWFWMD for the drainage culverts, minor works permit from Hillsborough County Environmental Protection Commission, and dredge permit from USACE for the outfall into Old Tampa Bay. After PER efforts concluded the pump station was not hydraulically feasible, a gravity outfall system was recommended. South Mobley Road Drainage Improvements, Hillsborough County, Tampa, FL. Serving as project manager to determine solutions to alleviate the flooding that occurs across South Mobley Road between the intersection of Lake Maurine Drive and 9153 Tillinghast Drive. The scope involved preparing a PER and conceptual plans for review by the County. Analysis work included investigating the flooding, generating alternatives, and providing recommendations to reduce or alleviate the flooding, through modeling and County model updates. The PER concluded that reestablishing an existing pipe connection, discovered during the analysis and located under South Mobley Road, to Lake Maurine would alleviate the flooding. 43rd Street Drainage Improvements, Hillsborough County, FL. Engineer of record for this drainage project to alleviate flooding at the intersection of 43rd Street and Bruce B. Downs Boulevard by upgrading the drainage system in the area. The scope involved preparing contract documents including plans, specifications, supporting engineering analysis, calculations, required permits, and other technical documents in accordance with Hillsborough County policies, procedures, and requirements. The project included coordination with SWFWMD and FDOT to add an inlet and flume on the intersection radius returns to direct runoff that ponded in low points of the returns to the existing drainage system along Bruce B. Downs. Fox Creek Wetland Mitigation Site, Sarasota County, FL. Provided hydrologic modeling and design for the 140-acre regional wetland mitigation/filter marsh site. Work included modifying the Cow Pen Slough regional watershed model to analyze effects of routing water through the site. The site also provided compensation for scrub -jay habitat impacts. Lorraine Road Extension, Sarasota County, FL. The project is located east of Interstate 75 from Fruitville Road to the southern boundary of Lakewood Ranch (approximately 1.28 miles). The project included the drainage design and permitting of the Lorraine Road 4 lane divided urban roadway with sidewalks and bike lanes. Jeffords Street Stormwater Outfall Improvements, City of Clearwater, FL. Served as a technical advisor on this urban residential stormwater and roadway reconstruction project that was cooperatively funded by SWFWMD. This project consisted of designing approximately 2,000 linear feet of stormwater improvements, 1,200 linear feet of sanitary relocation and design, several utility relocations, and 0.5 mile of roadway through a highly influential neighborhood. Tis watershed management plan update involved adding detail and updates to the model, based on new development and 2007 LiDAR data. The resulting data is to be used to submit an MT-2 application for the physical map revision of the watershed flood -plain and floodway. Orient Park Ditch Erosion Drainage Improvements, Hillsborough County, FL Project manager for the Preliminary Engineering Report (PER). The objective of this project was to alleviate ditch erosion while potentially providing additional flood relief within the stormwater drainage network in Orient Park near Spillers Avenue and Rhode Island Drive by stabilizing the channel banks in the area. As part of the PER, an analysis was completed looking at various options to provide a permanent solution to stabilize the channel banks. The hydraulics were analyzed using the Hillsborough River/Tampa Bypass Canal Watershed model developed in SWMM and refined for site specific survey data. Clewis Avenue Drainage Improvements, Hillsborough County, FL. Project manager for the PER. The existing drainage system in the area consists of roadside swales, and a 38" x 57" arch corrugated metal pipe (CMP) crossing Clewis Avenue to the west. This arch CMP connects to a ditch that runs west to a control structure and outfalls through a 42" HDPE to the Tampa Bypass Canal. The objective of the project was to replace the 38" x 57" CMP and alleviate erosion concerns along the drainage ditch. As part of the PER, we analyzed several solutions using the Hillsborough River/Tampa Bypass Canal Watershed model developed in SWMM. Atkins reviewed several alternatives during development of the basis of design report (BODR). In addition, the ? team conducted a study to evaluate the ~ effects of various sea level rise (SLR) scenarios on weir gate operations, based on available existing stage level gage data and the scenario horizons. The final design incorporated a weir sill elevation that provided extra flood protection from SLR effects for hundreds of homes. In addition to providing a tidal barrier and salinity barrier for Haldeman Creek and maximizing flood control for upstream properties, the weir structure was designed for easy operations and maintenance by County staff. Atkins economized the permitting of this project through research and successful negotiation of a minor compliance -modification of the existing SFWMD ERP permit. This included ecological review of site conditions, engineering calculations demonstrating no adverse change in hydrological characteristics, and meeting with SFWMD staff. As a result, SFWMD authorized the ERP permit 35 days after submittal of the application package, with no request for additional information (RAI). Atkins also obtained the dewatering permit for construction of the project with no RAI less than 30 days after application submittal. Our sucessful approach on these permits enabled Collier County to let and construct the project in a short time frame, with no permitting delays. The project is located entirely within the City of Tampa along a 8,100-linear- foot corridor which starts at the Estrella Street outfall to Hillsborough Bay and ends at the intersection of Dale Mabry Highway and Watrous Avenue. The project includes design, construction, public involvement, and survey services to construct a new major stormwater trunk line that runs the length of the project corridor. Project design includes the replacement of impacted roadways and utilities; maintaining existing traffic throughout the project limits; structural design for a new seawall near the outfall; design of sustainable/green infrastructure; a formal tree survey; and a detailed update to the existing XPSWMM hydrologic and hydraulic model to verify sizing and design of the stormwater trunkline needed to meet service level requirements. To successfully deliver the roadway and stormwater improvements, there were several key challenges to overcome starting with the public involvement component, as the project corridor spans both residential and commercial areas including two elementary schools, one middle school, and three churches. The goals of the new systems are to improve flooding conditions, and to enhance water quality before discharge to Clearwater Harbor. The design, which also included approximately 1,200 linear feet of sanitary relocation and improvements, was located almost entirely within a residential and local business roadway corridor. In addition, the design incorporated a baffle box in the overall storm system layout, located just before the outfall, to maximize water quality benefits. The project included complete reconstruction of all local roadways within the project area, along with construction of Americans with Disabilities Act (ADA)-compliant sidewalks and ramps. Pedestrian safety was a high priority, due to the significant volume of pedestrian traffic in the project area. Utility coordination was also key —with both the multiple City departments involved and with other stakeholders such as Verizon, Duke Energy, WOW, and Morton Plant Hospital. Atkins services included field survey, geotechnical survey, subsurface utility exploration, landscape architecture, signing, full storm and sanitary sewer design, and post - construction design. Atkins is currently assessing potential hydrologic restoration alternatives for restoring natural hydrologic conditions that would allow for the natural recruitment of additional mangrove and seagrass resources within the bayou. In May 2019, Atkins completed a circulation study to analyze the viability of several restoration alternatives for their potential to improve water quality and consequently restore historical seagrass populations within and outside of Cooper's Bayou. The analysis included preparation of a hydrodynamic coastal model to demonstrate reductions in residence time in response to these alternatives. Models identified an alternative that includes the baseline scenario of dredging Cooper's Bayou and improvement of the mangrove channel, plus a cut through the eastern portion of the peninsula, combined with a 400-foot cut under the causeway. This alternative provides consistent reductions in residence time across all portions of the proposed restoration site, including a 37% reduction within middle Cooper's Bayou and nearly 80% reduction in adjacent portions of Old Tampa Bay. In July 2019, Atkins performed a baseline environmental survey order to assess potential ecological lift to mangrove swamp habitat due to the proposed hydrologic improvements included in the Circulation Study. Atkins reviewed the condition within and adjacent to the existing mosquito ditches to quantify potential ecological lift from potential use of ditch blocks and hydroblasting of spoil piles, determined typical dimensions of the dredge spoil piles in order to quantify the area available/suitable for mangrove recruitment following hydroblasting, identified areas of Brazilian pepper, assessed mangrove swamp holistically for characterization of community structure for use in completion of UMAMs, and assessed potential area of seagrass coverage within middle and lower bayou segments. Project Approach, Willingness to Meet Time and Budget Requirements The Gordon River watershed is 4,432 acres and located in west -central Collier County. The Upper Gordon River Amil gate weir structure is located just south of Golden Gate Parkway at Gordon River Greenway Park and is the salinity barrier for this riverine system A feasibility study has been conducted for the Gordon River watershed and will be used as guidance for design of the new structure. The weir structure is to be fully automated and use SCADA to remotely operate it. It should be designed such that it can be easily accessed, will function as a salinity barrier, is Existing Upper Gordon River Weir easily operated and maintained by County staff, and minimizes upstream water level fluctuations while maximizing flood control for adjacent properties. For purposes of this discussion, the approach is broken down into 4 major tasks/phases: Data Collection, Design, Permitting, and Construction Services. Data Collection This task will be led and managed by our project manager, Mark Erwin, and will encompass the collection of all information that is required for project design, as well as, any data that will assist in understanding of the river system, how it functions and how the weir can be designed to best meet the County's goals, while minimizing associated project costs, be it, consultant fees, County coordination, County maintenance efforts or construction costs. The three primary datasets to be collected for project design are geotechnical information, topographic survey, and subsurface utilities. Once the Notice -to -Proceed (NTP) has been issued, GCGE and E.F. Gaines will be contracted collect geotechnical and topographic survey data respectively. Both companies are ready to start work immediately upon the NTP. Geotechnical Exploration Atkins will instruct GCGE to get borings at various locations at the new weir site. Near -surface, naturally occurring limestone is commonly encountered in Collier County. Occasionally an upper layer of limestone, colloquially known as "caprock", is present. Caprock can be very hard material to excavate into and through. Specialized equipment such as punches or augers may be required to install the anticipated sheet pile substructure. Additionally, limestone can be very porous and difficult to dewater. A review of the USDA NRCS Web Soil Survey indicates the presence of Durbin-Wulfert Mucks. Muck, if encountered, is not suitable material to build on and will require removal. Muck is also not suitable for backfill material. The soil survey indicates Durbin-Wulfert Mucks can be on the order of 5 feet in depth. It will be critical to get borings in the near vicinity of the new weir structure. These borings will indicate some the above -mentioned conditions and allow Atkins to best plan for them. Avoiding hard caprock is preferred and moving the weir structure slightly north or south may avoid issues later in the project in dewatering (sheetpile cofferdams) and sheetpile installations for the seepage walls. A full geotechnical report that includes a seepage analysis will submitted by the geotechnical Engineer of Record (EOR). Topographic Survey Survey will be needed for the existing and new weir site, but it will be also necessary for the locations of the future maintenance access point for the site. Identifying the permanent access location to the site will be one of the first decisions to be made in conjunction with County staff. This way we can minimize survey and only survey the areas we need to develop the conceptual site plan. Verification of property boundaries will also be conducted to determine the need for permanent or temporary construction easements. If required, EF Gaines will develop Sketch & Legal (S&L) descriptions for the required easements. COLLIER COUNTY-UPPERGORDON RIVER WEIR REPLACEMENT DESIGN SERVICES 41 ATKINS, A MEMBER OF THE SNC-LAVALIN GROUP Subsurface Utility Exploration (SUE) Collection of SUE data will be conducted by T2 (if necessary). As part of the preliminary design of the project (discussed later), a desktop analysis and Sunshine Dig ticket will be conducted by Atkins to determine the location of utilities within the area. Based on the results of this research and the location of the new weir structure relative to the facilities, it will be determined if conducting SUE is necessary. This will be determined early in the preliminary design process so if SUE is needed, the data can be collected and still meet our overall design and project schedules. Design The design for this project will be accomplished in three phases: preliminary design (Preliminary Engineering Report (PER) & 30% plans), 60% plans, 100% (final) plans. Each of these phases will require specific deliverables that are critical to the next phase of the project. With direction from our project manager Mark Erwin, PE, Richard Uptegraff, PE will lead the design efforts for this project. Coordination with the County, and between the stormwater design engineers, electrical engineers, structural engineers, surveyors, and geotechnical will be critical to quickly develop a weir and site concept that meets all the County's goals, and optimizes cost, hydraulic efficiency, and available resources. Preliminary Design/30% Plans The preliminary design will encompass developing the overall concept for the weir and weir site, including site access. Along with submitting 30% plans, a PER will be developed and will include (at minimum) the following: > Site characterization > Preliminary utility investigation (determine if SUE is required) > Updated H&H modeling analysis > Tidal analysis to establish a weir that will prevent backfiow during high tidal events > Effects of SLR on the weir and upstream properties > Preliminary weir design > Identification and preliminary design of maintenance access > Gate operation schedules > Preliminary SCADA design of automated weir 60% Design At the 60% design stage, the project should be substantially designed with only structural and stormwater details remaining. Because Atkins has recently conducted two very similar weir projects for the County, Atkins understands the County's expectations. This will lead to reaching the 60% design level quickly and the ability to exceed the County's schedule expectations. At this stage both the SFWMD and the USACE permits will be submitted. Submission of the USACE permit in a timely manner is critical as these permits can take six or more months to obtain. At this stage deliverables will include a 60% plan set, engineer's opinion of probable cost, and documentation of utility coordination. A complete constructability review will also be conducted at this stage. This will be completed by a senior independent engineer with construction experience to determine any constructability issues of which the County should be aware. Once reviewed and approved by the County, the plans will be signed and sealed for County bid advertising. Permitting This task will be led by Ed Cronyn, PWS who has permitted many projects for Collier County including the Haldeman Creek Weir Replacement for Collier County. Based on the previous experience on this similar project and others, a SFWMD ERP (or exemption) and a USACE permit will be required for permitting of the Upper Gordon River Replacement Weir. Atkins will have in-house staff ready to coordinate on the permitting efforts during the preliminary design phase. Our project manager, Mark Erwin, will engage the requisite staff early in the process, as well as early coordination with the County and SFWMD so this process will go smoothly. For SFWMD permitting, it is likely that this project will qualify for an ERP exemption and the permitting should only take about 60 to 90 days. For this permit exemption, it will be required that the engineer demonstrate no adverse impacts upstream of downstream based on hydrologic & hydraulic (H&H) modeling. Based on a review of the feasibility study for the Gordon River, the existing model is in the XPSWMM model software. This software requires a proprietary model license, and Atkins has the necessary licensing and requisite model expertise needed to use, update and modify the model as needed to perform this task and will be included in the PER. The project will also require a USACE permit and will likely qualify for a Nationwide Permit No. 43 (Stormwater Management Facilities). This is provided no wetlands are substantially impacted and canal impacts are less than 0.5 acres. Unlike SFWMD permitting, the USACE permit will likely take longer to acquire than the SFWMD exemption/ERP. It will likely require about six months to secure even a nationwide permit. This permit will require quantifying environmental impacts, describing Atkins designed Pine Ridge Canal #1 Weir Structure the nature of the project and submitting data within the specific USACE formatting. Pre -permitting activities (pre - application meetings) will begin after the PER/30% plans are complete, and permits will be submitted at the 60% design level after County approval. A review for threatened or endangered species will be conducted as part of this task as well. Although no permits are likely necessary, this review should be accomplished to be sure these species are not impacted. A dewatering permit will also be acquired for this project. This will allow the contractor to quickly modify the existing permit when construction starts not holding up any construction efforts after contractor NTP. Construction Services The task will be led by Michael Ryan, PE, PMP. These services will encompass all post -design services including construction assistance, as well as project bidding assistance. This task actually begins during the project design by producing high quality plans and technical specifications. This will reduce the time and effort associated with questions by bidders. If requested, Atkins will attend the County bid meeting, although this is not always required. During the project bid advertisement, Atkins will make appropriate staff available to immediately respond to bid questions to limit the County's effort during this time. Once project bidding has closed, and all bids have been reviewed by County staff. Atkins will review the low bidder for quality and make the bid recommendation. Once project construction starts, Mr. Ryan will assign shop drawing reviews to the appropriate staff based on the type of review. These reviews will likely encompass drawings such as, concrete mixes, gate attachments, electrical components, and reinforcing bar bending diagrams. All reviews will be accomplished by a qualified engineer and returned to the County within a few days. A part of the construction assistance services, Atkins will also make periodic field trips to the site to review the overall construction, quality control or other specific construction activities. Construction reports will also be reviewed periodically to assess construction quality and adherence to plans and standards. Schedule Atkins understands that meeting project schedules is paramount while completing high -quality work in the least possible time. Atkins has proposed a schedule for the Upper Gordon River Weir Replacement, see Figure 3.1 on the following page. Because of our previous experience on this type of project, we know it is preferred that the County bid the project such that the construction occurs in the Florida dry season, and we have proposed a schedule that does that. This 25-month schedule is aggressive, but can be achieved with proper coordination provided that County has the funding in place. We have made this assessment based upon our team's experience working on two nearly identical weir replacement projects for the County within the last five years for Haldeman Creek and Pine Ridge Canal. With no learning curve and applying the right technical expertise and lessons learned from m recent similar projects, our team will provide significant cost and time savings for the County on this project. Project Planning and Schedule Control As demonstrated on our numerous past projects for the County, Atkins is committed to meeting the County's schedules. In fact, due to our significant depth, resources, and expertise, we are at times able to deliver ahead of schedule. Atkins will develop a master schedule with comprehensive project controls at the outset of work efforts. We will create a project task schedule that breaks down each phase of the work by task and by assignment. The schedule is reviewed and updated at each phase of the project to reflect actual progress and anticipated needs, which will help manage cost control. Atkins will use our company -wide Oracle accounting software to track and evaluate performance of individual assignments. This method of measuring and evaluating performance, utilizing our Earned Value Tracking tool, enhances our ability to identify potential trouble spots at an early stage and to predict any possible impacts on the project. We then use this information to guide our development of corrective actions. Beyond controlling the budget for assigned work efforts, Atkins also strives to assist clients in controlling the overall budget for project programs. As such, we advocate frequent updates of project cost estimates and early communication of any significant changes to the County. COLLIER COUNTY-UPPERGORDON RIVER WEIR REPLACEMENT DESIGN SERVICES 45 ATKINS, A MEMBER OF THE SNC-LAVALIN GROUP Staffing Allocation and Manpower Planning Successful project delivery requires the assignment of staff with appropriate availability and expertise. While Atkins has a strong presence across Florida and nationwide, our greatest asset to the County is our local staff of approximately 200 employees —most of whom live in the greater Tampa Bay area. Mark Erwin, with the support of our principal -in -charge and task leads, will use his extensive knowledge of the County and Atkins staff capabilities to identify the most qualified professionals to complete the work foreach project task. He will then use Atkins' Manpower Planning software, in coordination with identified staff, to confirm appropriate availability of each team member for the duration of each work effort. Atkins' Manpower Planning software is a Microsoft Access database program that tracks manpower projections on individual project and employee levels. The main purpose of the software is to maximize the utilization of staff. The program, which identifies project commitments on a monthly basis for each employee, accounts for overhead, holiday, and vacation activities. Our Manpower Planning software helps to identify staff members who are either overloaded or underloaded, thereby enabling our project managers to confirm appropriate project staffing to maintain scheduled commitments. Quality Control A key component of Atkins' ability to deliver projects on time and within budget is our belief that quality work products are more likely to be achieved when supported by quality management practices. By specific corporate policy, as detailed in our Quality Control and Assurance for projects (QCAP) manual, every project deliverable prepared by Atkins must undergo a quality control review to verify development in accordance with accepted standards of professional practice and with all requirements of the contract. Our commitment to quality is such that our proposed team includes a highly experienced quality manager whose sole job will be to assure that independent quality reviews are conducted, by appropriate personnel, for all work products. Andrea Graves, PE, will serve as quality manager for this project. We have analyzed critical path schedules, our proposed staff's current and future workloads, and short- and long-term project assignments with our Manpower Planning software to confirm that our team has daily availability to begin work immediately. In fact, our current workload is far from full capacity; this fact, combined with our significant depth of resources, means the additional work associated with this contract will have no adverse effect on our ability to meet schedule and budget needs. Furthermore, our subconsultants have also analyzed their current and future workloads, and have the availability to meet your schedule as well. Although, if at any time during project execution, unforeseen circumstances arise and additional personnel are required to complete project tasks, Atkins can augment our team by drawing from our 200 Tampa office employees who offer an array of engineering, environmental science, GIS, survey, and other relevant services. Our staff also offers expertise in disciplines that may not have been anticipated at the time of the procurement process. Our principalin-charge, Charlotte Maddox, has appropriate authority and availability to monitor staff resources and allocate additional firmwide professionals as needed to meet established task deadlines. As noted above and depicted in Figure 4.1, our team has sufficient availability to commit to this project. As such, we are confident in our abilities to successfully complete the identified scope of services. Our project manager, Mark Erwin, PE, CFM, will continually coordinate with our proposed task leads and subconsultants to ensure the proper allocation of staff resources for all tasks. This plan will detail the technical, administrative, and procedural requirements for each project task. In the event of any violation of the clause set forth in paragraph (1) of this section the contractor and any subcontractor responsible therefor shall be liable for the unpaid wages. Contracting with Small and Minority Businesses, Women's Business Enterprises, and Labor Surplus Area Firms: §200.321 (a) The Solicitor must take all necessary affirmative steps to assure that minority businesses, women's business enterprises, and labor surplus area firms are used whenever possible. The contractor shall comply with 18 U.S.C. § 874, 40 U.S.C. § 3145, and the requirements of 29 C.F.R. pt. 3 as may be applicable, which are incorporated by reference into this contract. b. Subcontracts. The contractor or subcontractor shall insert in any subcontracts the clause above and such other clauses as FEMA may by appropriate instructions require, and also a clause requiring the subcontractors to include these clauses in any lower tier subcontracts. The prime contractor shall be responsible for the compliance by any subcontractor or lower tier subcontractor with all of these contract clauses. c. Breach. In the event of the contractor's non-compliance with the nondiscrimination clauses of this contract or with any of such rules, regulations, or orders, this contract may be canceled, terminated or suspended in whole or in part and the contractor may be declared ineligible for further Government contracts in accordance with procedures authorized in Executive Order 11246 of September 24, 1965, and such other sanctions may be imposed and remedies invoked as provided in Executive Order 11246 of September 24, 1965, or by rule, regulation, or order of the Secretary of Labor, or as otherwise provided by law. No Obligation by Federal Government: The Federal Government is not a party to this contract and is not subject to any obligations or liabilities to the non -Federal entity, contractor, or any other party pertaining to any matter resulting from the contract. Procurement of Recovered Materials (§200.322): Requirements: The requirements of Section 6002 include procuring only items designated in guidelines of the EPA at 40 C.F.R. Part 247 that contain the highest percentage of recovered materials practicable, consistent with maintaining a satisfactory level of competition, where the purchase price of the item exceeds $10,000 or the value of the quantity acquired by the preceding fiscal year exceeded $10,000; procuring solid waste management services in a manner that maximizes energy and resource recovery; and establishing an affirmative procurement program for procurement of recovered materials identified in the EPA guidelines. (1) In the performance of this contract, the Contractor shall make maximum use of products containing recovered materials that are EPA designated items unless the product cannot be acquired (i) Competitively within a timeframe providing for compliance with the contract performance schedule; (ii) Meeting contract performance requirements; or (iii) At a reasonable price. (3) The Contractor also agrees to comply with all other applicable requirements of Section 6002 of the Solid Waste Disposal Act. Program Fraud and False or Fraudulent Statements or Related Acts: The contractor acknowledges that 31 U.S.C. Chap. 38 (Administrative Remedies for False Claims and Statements) applies to the contractor's actions pertaining to this contract. Reporting: The contractor will provide any information required to comply with the grantor agency requirements and regulations pertaining to reporting. It is important that the contractor is aware of the reporting requirements of the County, as the Federal or State granting agency may require the contractor to provide certain information, documentation, and other reporting in order to satisfy reporting requirements to the granting agency. FCP-5 EXH. 1.A FEDERAL GRANT CONTRACT PROVISIONS Termination for Cause and Convenience: Applies to all contracts >$10,000, Should the Contractor be found to have failed to perform his services in a manner satisfactory to the County as per this Agreement, the County may terminate said Agreement for cause; further the County may terminate this Agreement for convenience with a thirty (30) day written notice. The County shall be sole judge of non- performance. In the event that the County terminates this Agreement, Contractor's recovery against the County shall be limited to that portion of the Agreement Amount earned through the date of termination. The Contractor shall not be entitled to any other or further recovery against the County, including, but not limited to, any damages or any anticipated profit on portions of the services not performed. STATE PROVISIONS Convicted Vendor and Discriminatory Vendors List: Those who have been placed on the convicted vendor list following a conviction for a public entity crime or on the discriminatory vendor list may not submit a bid on a contract to provide any goods or services to a public entity, may not submit a bid on a contract with a public entity for the construction or repair of a public building or public work, may not submit bids on leases of real property to a public entity, may not be awarded or perform work as a contractor, supplier, subcontractor, or consultant under a contract with a public entity, and may not transact business with any public entity in excess of $25,000.00 for a period of 36 months from the date of being placed on the convicted vendor list or on the discriminatory vendor list. Public Records: The mere receipt of public funds by a private entity, standing alone, is insufficient to bring that entity within the ambit of the public record requirements. However, when a public entity delegates a public function to a private entity, the records generated by the private entity's performance of that duty become public records. Thus, the nature and scope of the services provided by a private entity determine whether that entity is acting on behalf of a public agency and is therefore subject to the requirements of Florida's Public Records Law.
