Agenda 05/26/2020 Item #11F (Tolling NIM Requirements)05/26/2020 EXECUTIVE SUMMARY Recommendation to toll for six-months the requirement for a land-use applicant to hold a second Neighborhood Information Meeting (NIM) when their land use petition activity extends beyond one year from the date the first NIM. OBJECTIVE: To toll for six months, the requirement for a land-use applicant to hold a second NIM when the petition activity extends beyond one year from the date of the first NIM due to the COVID-19 emergency. CONSIDERATIONS: Executive Order 20-52 issued by Governor DeSantis on March 9, 2020, declared a state of emergency for the State of Florida. The Board of County Commissioners (Board) canceled the Collier County Planning Commission (CCPC) meetings from March 5, 2020, to June 4, 2020, resulting in rescheduling land use petitions and triggering the requirement for some of the land use applicants to hold a second NIM. The intent of Chapter 8B (3) of the Collier County Administrative Code for Land Development is to consolidate and identify the specific procedures for conducting a NIM in order to facilitate public participation. This provision specifies when an applicant’s petition activity extends beyond one year from the date of the first NIM, a second NIM will be required and shall be noticed in accordance with the provisions of the Collier County Land Development Code Section 10.03.05. To further promote economic recovery while adhering to CDC social distancing guidelines, staff is requesting the Board approve the toll, for six months, of the requirement for an applicant to hold a second NIM when their land use petition activity extends beyond one year from the date of the first NIM. The intent is to facilitate the rescheduling of land use petitions to the future CCPC hearing dates that have been approved b y the Board without requiring the applicant to spend additional time and expense of holding a second NIM and causing further delays in scheduling the CCPC meeting during the tolling period. This tolling of NIMs provides relief to approximately eight petitions with NIMs that could potentially expire during the tolling period (see attached list). FISCAL IMPACT: There is no Fiscal Impact associated with this action. GROWTH MANAGEMENT PLAN IMPACT: There is no Growth Management Impact associated with this action. LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires a majority vote for Board approval.
