EXECUTIVE SUMMARY
Recommendation to approve a Termination of Coordination Agreement between Collier County, as
Community Transportation Coordinator, and the David Lawrence Mental Health Center, Inc.
OBJECTIVE: To terminate the Coordination Agreement between Collier County, the Community
Transportation Coordinator (CTC), and the David Lawrence Mental Health Center, Inc. (DLC)
CONSIDERATION: On February 22, 2005, the Board of County Commissioners (Board) acting in their
role as the CTC, entered into an Agreement with DLC to support their submittal of an application to the
State of Florida Department of Transportation (FDOT) for a Section 5310 Program Grant application to
purchase two (2) vehicles for the purpose of transporting individuals who have been determined to be
disabled. Collier County has no ownership interest in the vehicles, however, as the CTC, monitors the
activity related to the use of the vehicles and in turn, DLC must report ridership and vehicle maintenance
information to Collier County for reporting into the National Transit Database (NTD). The vehicles have
been utilized solely in the manner set forth in the grant application (for the PATH Program and Supported
Employment by this agency) and in accordance with all applicable lawful requirements for the last 10
years. Since that initial Grant award, FDOT has transferred the title of the vehicles over to DLC and they
currently have the ownership.
In accordance with Section 13 of the Agreement, a representative from the DLC provided noti fication to
the County that, due to state budget cuts, the vehicles are no longer utilized in the manner set forth in the
Grant Application. The PATH Program is now run by another agency and, although DLC case workers
will continue to assist their clients in finding gainful employment, DLC will no longer be utilizing a
dedicated staff member in the Supported Employment role. The County has been notified that the vehicles
have been retired.
The subject vehicles are over ten (10) years old and have no value for the provision of trips to the
coordinated system. Based on this fact and that DLC complied in good faith with the Agreement, staff is
recommending terminating the existing Agreement and any further obligation to report or offer the
vehicles for use to transport qualified disabled individuals within Collier County to the CTC.
FISCAL IMPACT: There is no Fiscal impact associated with this Executive Summary.
GROWTH MANAGEMENT IMPACT: Consistent with Objective 12 of the Transportation Element of
the Growth Management Plan.
LEGAL CONSIDERATIONS: This Item is approved for form and legality and requires a majority vote
for Board action. -JAB
RECOMMENDATION: To terminate the existing Coordination Agreement between Collier County, as
Community Transportation Coordinator, and the David Lawrence Mental Health Center, Inc.
