Agenda 05/26/2020 Item #16A 6 (Resolution - CR951 Conveyance)05/26/2020 EXECUTIVE SUMMARY Recommendation to approve a resolution authorizing the conveyance of portions of the right-of- way on Collier Boulevard (CR 951) and other Collier County real property interests to the State of Florida Department of Transportation. OBJECTIVE: To convey to the State of Florida Department of Transportation, the right -of-way and other real property interests needed from Collier County for the construction of improvements to the I 75/Collier Boulevard Interchange. CONSIDERATIONS: The State of Florida Department of Transportation (FDOT) is planning to construct significant improvements to the I 75/Collier Boulevard (CR 951) Interchange (the Project). Project improvements include the construction of two elevated ramps, the one being a ramp from Collier Boulevard North over Beck Boulevard and on to I 75 for northbound vehicles and the other being a ramp from I 75 South over Davis Boulevard and on to Collier Boulevard for southbound vehicles. FDOT has applied to Collier County for conveyance of the following right-of-way and easement parcels needed for construction of the Project: 1) Parcel 102, a deed quitclaiming the County’s interest in a portion of a lake, drainage, maintenance and access easement to FDOT, approximately 4,039 square feet in extent; 2) Parcel 109, being approximately 20,144 square feet of right-of-way; 3) Parcel 111, being two segments of limited access right-of-way totaling approximately 5,356 square feet; 4) Parcel 700, a temporary construction easement, approximately 20,525 square feet in extent and terminating on completion of the Project, but no later than September 24th, 2028; and 5) Parcel 800, a perpetual easement for air rights, approximately 377 square feet in extent. The location of these parcels is graphically depicted on the attached Aerial Map. On July 1st, 2019, and before a substantial reduction in size of Parcel 111, FDOT submitted written offers to purchase the aforementioned parcels (excluding Parcel 102) from Collier County for the total sum of $849,850. Subsequently, staff informed FDOT that they would be recommending the donation of these parcels. Parcel 111 has since been substantially reduced. If FDOT had adjusted its offer to account for the reduction in the size of Parcel 111, the reduced offer would have been substantially less. Considerations are the following: 1) All parcels, except for Parcels 109 and 700, were acquired by the County without monetary payment. (Parcels 111 and 800 were, in fact, previously acquired by the County from FDOT as part of larger parcels.) 2) Parcels 109 and 700 make up portions of a larger parcel purchased by the County from Walmart in 2004 for $881,000 or $10.25 per square foot. 3) The Project will result in increased capacity at the general location of this interchange and will benefit the County at no cost to the County. 4) After completion of the Project, right-of-way no longer needed by FDOT will be conveyed back to the County. Refer in this regard to FDOT’s attached letter dated April 10 th, 2020, and the map enclosed therewith. These parcels will be needed by the County for future maintenance of the Henderson Canal. During construction, FDOT will maintain the portion of the Henderson Canal located within the Project limits. 5) All right-of-way and other real property interests required by FDOT will continue to be put to public use for transportation and stormwater management purposes. 6) Historically, FDOT has not required payment from the County for conveyances of right-of-way to the County, nor has the County required payment for conveyances to FDOT. Staff accordingly recommends the donation of all parcels to FDOT. FISCAL IMPACT: Donation of the parcels will result in the County foregoing monetary payment of approximately $580,000. However, it is viewed the lack of consideration will be more than offset by the future benefits derived from construction of the Project improvements by FDOT, who will also be responsible for all recording and other related costs. 16.A.6 Packet Pg. 187 05/26/2020 GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the Long-Range Transportation Plan and the Collier County Growth Management Plan. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. - JAB RECOMMENDATION: 1. Adopt the attached Resolution; 2. Authorize the Board of County Commissioners (Board) Chairman to execute the deeds and other conveyance instruments set forth in Exhibit “A” to the Resolution on behalf of the Board at no additional cost to the State of Florida Department of Transportation; and 3. Authorize the Board’s Chairman to execute any such other closing documents needed to effectuate transfer, after approval by the Office of the County Attorney.
