Resolution 1998-115 1 ;. ~ 2 ~. RESOLUTION NO. 98-~ RELATING TO PETITION NUMBER V-98-4, FOR A VARIANCE ON PROPERTY HEREINAFTER DESCRIBED IN COLLIER COUNTY, FLORIDA. WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes, has conferred on all counties in Florida the power to establish, coordinate and enforce zoning and such business regulati0ns as are necessary for the protection of the public: and WHEREAS, the County pursuant thereto has adopted a Land Development Code (Ordinance No. 91-102) which establishes regulations for the zoning of particular geographic divisions of the County, among which is the granting of variances: and WHERE~S, the Board of Zoning Appeals, being the duly elected constitut~d Soard of the area hereby affected, has held a public hearing after notice as in said regulations made and provided, and has considered the advisability of a 3D-foot variance from the required 30 foot setback to 0 feet from a common perimeter property line as shown on the attached plot plan, Exhibit "A", in a PUD zone for the property hereinafter described, and has found as a matter of fact that satisfactory provision and arrangement have been made concerning all applicable matters required hy said regulatioi.s and in accordance with Section 2.7.5 of the Zoning Regulations of said Land Development Code for the unincorporated area of Collier County; and WHEREAS, all interested parties have been given opportunity to be heard by this Board in public meeting assembled, and the Board having considered all matters presented; NOW THEREFORE BE IT ?,ESOLVED B'{ THE BOARD OF ZOnING APPEALS of Collier County, rl~rida, that: The Petition V-98-4 filed by Robert L. Duane of Hole, Montes , Associates, Inc., representing Naples Community Hospital, with res~ect to the property hereinafter described as: The western perimeter property boundary of Lot 7, of the North Naples Medical Park Subdivision as recorded in Plat Book 26, Pages 46-47 and the eastern perimeter property boundary of Tract C, of the Collier Health Park subdivision as recorded iT. Plat Book 17, Pages 50-51, of the Public Records of Collier County, Florija. " ~. 5 A 2. ~. be and the same tereby is approved for a 3D-foot variance from the required 30 foot setback to 0 feet from a common perimeter property line as shown on the attached plot plan, Exhibit "A", of the PUD zoning district wherein said property is located, s\lbject to the following conditions: 1. Property owner is subject to the County's platting requirem~nts should three (3) or more parcels (from either p~rent parcel) be created, 2. North Naples Medical Park shall record and relinquish its interest in the ten (10) foot platted landscape buffer easement along the western perimeter boundary of lot 7. BE IT RESOLVED that this Resolution relating to Petition Numb~r V-98-4 be recorded in the minutes of this Board, This Resolution adopted after motion, second and majority vote.
