EXECUTIVE SUMMARY
Recommendation to approve the documents necessary to terminate a portion of an existing Collier
County Utility Easement to Watermark at Naples FL, LLC, a Delaware limited liability company,
associated with the development at Edge 75 at Watermark.
OBJECTIVE: To terminate the utility easement which had previously been conveyed for sanitary sewer
utility facilities to the County.
CONSIDERATIONS: On December 18, 1990, Agenda Item #9A3, the Board accepted the water and
sewer facilities to serve the 951 Commerce Center which is now known as Edge 75 at Watermark. The
Utility Facility Warranty Deed was recorded on June 4, 1991, in Official Records Book 1621, Page 308,
which conveyed sanitary sewer utility facilities located within the 951 Commerce Center to the Board of
County Commissioners of Collier County, Florida, as the Governing Board of the Collier County Water -
Sewer District (County).
These conveyance documents were recorded after preliminary acceptance of the utility facilities fo r the
project, in accordance with the Utility Facility Standards and Procedures Ordinance No. 2004-31. The
purpose of the attached Termination of Easement is to reconvey back to the current property owner,
Watermark at Naples FL, LLC, a Delaware limited liability company (Watermark), the County’s interest
in any sanitary sewer utility facilities that may exist within the subject property so Watermark can
develop their property and relocate the existing sewer utility facilities.
FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for Board approval - JAB
RECOMMENDATION: To approve and authorize the Chairman to sign the Termination of Easement
and Bill of Sale between County and Watermark in order to reconvey to Watermark, the County’s interest
in any sanitary sewer utility facilities and utility easements associated with the development at Edge 75 at
Watermark project, which were previously conveyed to the County.
