EXECUTIVE SUMMARY
Recommendation to accept a Quit Claim Deed from Dixie Sky Corp for approximately 13.56 acres
of lands for right-of-way purposes, with no responsibility for maintenance.
OBJECTIVE: To ensure that lands which provide access to privately owned properties and are owned
by Dixie Sky Corp, are conveyed to Collier County. County ownership in these lands will prevent any
access issues and/or disputes that could arise should these lands be acquired by a private entity. A private
entity could claim trespassing and potentially block access to the 13.56 acres of roadways that provide
access to various properties.
CONSIDERATIONS: Dixie Sky Corp, via its attorney, offered the lands shown on the attached sketch
and aerial photo at no cost to Collier County. The County is willing to accept the Dixie Sky Corp lands
however, with no intention of maintaining the lands being conveyed. The Quit Claim Deed has been
reviewed and approved by the County Attorney’s Office and has been signed by Dixie Sky Corp’s
president.
FISCAL IMPACT: The land is being conveyed at no cost to the County. The cost to record the Quit
Claim Deed will not exceed $35.50 and will be paid by Dixie Sky Corp. Past due taxes for 2016 and
2018 and taxes currently due for 2019 and prorated taxes for 2020 will be paid by Dixie Sky Corp prior to
closing.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority
vote for Board approval. -JAB
GROWTH MANAGEMENT IMPACT: This transaction is consistent with the County’s Growth
Management Plan.
RECOMMENDATION: That the Board:
1. Accept the Quit Claim Deed from Dixie Sky Corp for the lands described in the attached legal
description and sketch with no maintenance responsibility.
2. Direct the County Manager or his designee to proceed to acquire the Property and to follow all
appropriate closing procedures, and to record any and all necessary documents (once approved by
the County Attorney’s Office) in the Public Records of Collier County, Florida.
