Resolution 2006-223 RESOLUTION NO. 2006 _ 223 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, ESTABLISHING A SPECIAL MASTER REVIEW BOARD PURSUANT TO SECTION SIX OF ORDINANCE 2004- 46, ENTITLED THE "COLLIER COUNTY CODE ENFORCEMENT SPECIAL MASTER ORDINANCE," CODIFIED IN SECTION 2-1136 OF THE COLLIER COUNTY CODE OF LAWS AND ORDINANCES. WHEREAS, Chapter 162, Florida Statutes, the "Local Government Code Enforcement Boards Act," authorizes a county to establish local code enforcement special masters; and WHEREAS, pursuant to Chapter 162, Florida Statutes, the Board of County Commissioners (Board) adopted Ordinance 2004-46, entitled the "Collier County Code Enforcement Special Master Ordinance," in order to create a code enforcement special master process as an additional means for the enforcement of its codes and ordinances; and WHEREAS, Section Five of Ordinance 2004-46, codified as Section 2-1135(a)(3) of the Collier County Code of Laws and Ordinances, provides in relevant part that "Special master appointment shall be for a two year term. Upon recommendation of the review board, any special master may be reappointed at the discretion of the commission;" and WHEREAS, the initial two year term of the special master will expire September 27, 2006; and WHEREAS, there is presently no review board to make the required recommendation to the Board; and WHEREAS, Section Six of Ordinance 2004-46, codified as Section 2- 1136 of the Collier County Code of Laws and Ordinances, requires the Board to "create a special master review board, comprised of two members of the code enforcement department; one member from the Office of the Collier County Attorney; and two sitting members of the Code Enforcement Board. The duty of the review board shall be to recommend appointment for the special master(s) and review, on an annual basis, the performance of the special master(s) in order to recommend the removal or reappointment of said special master(s) to the commission." NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: SECTION ONE: Creation and Purpose of the Special Master Review Board. The Board of County Commissioners, in accordance with Section Six of Ordinance 2004- 46, as may be amended, hereby establishes the Collier County Special Master Review Board (Review Board) to recommend appointment for the special master(s) and review, on an annual basis, the performance of the special master(s) in order to recommend the removal or reappointment of said special master(s) to the Board. SECTION TWO: Membership. The Review Board shall be comprised of the following members: I) Two members of the Code Enforcement Department, as selected by the County Manager or his designee; 2) One member from the Office of the County Attorney, as selected by the County Attorney or his designee; and 3) Two sitting members of the Code Enforcement Board, as selected by the Code Enforcement Board Chairman. SECTION THREE: Officers; Quorum; and Compensation The County Manager shall appoint the Chair and Vice-Chair of the Review Board. The presence of a majority of the members shall constitute a quorum. The Review Board shall adopt rules and procedures for the transaction of business and shall keep records and minutes of meetings, findings and determinations. The members of the Review Board who are not currently part of the County staff shall serve without compensation, but may be reimbursed for travel, mileage and/or per diem expenses only if approved in advance by the County Manager. It is intended that this Review Board meet once per year, and that its members be appointed on an annual basis.
