Agenda 03/24/2020 Item #16D 5 (Resolution - FDOT Agreement)03/24/2020 EXECUTIVE SUMMARY Recommendation to approve the Community Aesthetic Feature Agreement with the Florida Department of Transportation for Collier Area Transit to place identification markers at bus stops on Florida Department of Transportation owned Right-of-Ways and approve a Resolution authorizing the Chairman of the Board of County Commissioner to sign the agreement. OBJECTIVE: To enter into an agreement with the Florida Department of Transportation (FDOT) to allow Collier Area Transit (CAT) logos marking to identify bus stops. CONSIDERATIONS: As part of the bus stop improvement plan CAT implemented the painting of CATs’ yellow logo with green background on the curbs at bus stop locations. This is now implemented and added as part of the bus stop improvements. These markings are a safety enhancement to assist in identifying the boarding and alighting area to properly deploy the bus ramp for both the operators and passengers. County staff is currently working with FDOT on several ADA bus stop improvem ent projects and was notified that an agreement is required for all markings on the FDOT owned Right-of-Ways. The Community Aesthetic Feature Agreement will allow all current and planned future paintings of a yellow CAT logo with a green background at all bus stops on state roads as improvements are completed. CAT is responsible for the design, installation, and maintenance of all markings. FISCAL IMPACT: There is no Fiscal impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This Item has been reviewed by the County Attorney, is approved as to form and legality and requires majority vote for approval. -JAK GROWTH MANAGEMENT IMPACT: Consistent with Objective 10 and 12 of the Transportation Element of the Growth Management Plan. RECOMMENDATION: To approve entering into the Aesthetic Feature Agreement with the Florida Department of Transportation, authorize the Chairman to execute the agreement, and the attached Resolution. A RESOLUTION OF'THE BOARD OF'COUNTY COMMISSIONERS OF COLLIER COUNTY, F'LORIDA, APPROVING A COMMUNITY AESTHETIC FEATURE AGR"EEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT); APPROVING COUNTY FUNDING OF THE COST, DESIGN, INSTALLATION, AND MAINTENANCE OF THE PUBLIC ART PROJECT INVOLVING COUNTY IMPROVEMENTS TO COLLIER AREA TRANSIT (CAT) BUS STOPS LOCATED ON CERTAIN FDOT OWNED RIGHTS-OF-WAY. WHEREAS, the Board of County Commissioners ("County") has requested permission lrom FDOT, to install Public Art community aesthetic features on certain rights-of-way owned by FDOT, ("Project"), by painting the curbs at the CAT bus stops with the CAT bus logo to improve the boarding and alighting areas for the benefit of CAT bus passengers and drivers; and WHEREAS, FDOT and the County agree that transportation facilities enhanced by community aesthetic features can benefit the public, result in positive economic development, and increase tourism both locally and throughout Florida; and WHEREAS, FDOT and the County wish to enter into a Community Aesthetic Feature Agreement, that provides for Counlz funding ofthe Project, design and construction standards and required approvals; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: 2. 3. The Board ofCounty Commissioners approves and authorizes its Chairman to sign the attached Community Aesthetic Feature Agreement. The Board of County Commissioners approves the lunding of design, installation, and maintenance costs ofthe Project. The Collier County Clerk to the Board shall forward a certified copy of this Resolution to FDOT along with the attached Community Aesthetic Feature Agreement for execution by FDOT.
