03/24/2020 EXECUTIVE SUMMARY Recommendation to approve an exemption from the competitive process and enter into Agreement No. 19-057-NS with Ferguson Enterprises, LLC d/b/a Ferguson Waterworks (“Ferguson”) to supply Mueller Systems, LLC (“Mueller”) small residential and commercial meters, automatic meter reading components, and an option to purchase advanced metering infrastructure. OBJECTIVE: To continue access to Mueller small residential and commercial meters and automatic meter reading (“AMR”) components, including meters, software, hardware and annual maintenance, with an option for the advanced metering infrastructure (“AMI”), from its only authorized distributor, Ferguson. The County approved, and has been installing, Mueller meters in our water distribution system since 2013 to ensure accuracy and reliability in our meter reading and utility billing system. CONSIDERATION: On September 10, 2013 (Agenda Item 11E), the Board approved Agreement No. 12-5968 with Ferguson providing for the purchase of Mueller small residential and commercial meters and automatic reading components for use throughout the Collier County Water -Sewer District. Over the last five years, approximately 71,610 Mueller meters have been installed in the County’s water distribution system (60,467 meter changeouts and 11,143 new services). The Mueller meters are covered by a ten-year warranty at 100% replacement, with a proportionate warranty percentage thereafter. On June 22, 2018, the County’s Procurement Services Division released Request for Proposal # 18-7401, “Automatic Meter Reading Systems,” to 7,337 vendors. Interested vendors downloaded one hundred thirty-six (136) bid packages, and the County received eight (8) proposals by the October 5, 2018 deadline. During a review of the proposals, staff came to the conclusion that it was premature to solicit proposals because in order to maximize the County’s current investment in meters/components and have access to the products and services necessary to maintain existing warranties and compatibility with the County’s existing water system, it was in the County’s best interest for staff to seek an exemption from the competitive process and extend the existing Agreement allowing for the future purchase of the Mueller meters and components. In conjunction with the recommended Agreement between the County and Ferguson, Mueller has entered into a Commitment Agreement with Ferguson, which guarantees the continued supply of materials to the County throughout the term of the attached proposed Agreement between the County and Ferguson, notwithstanding any change to the future business relationship between Mueller and Ferguson. (see Appendix D to the Agreement) In support of Staff’s recommendation to approve an exemption from the competitive process it shows: • Since the 2013, the County has purchased and installed over 70,000 water meters and AMR transmitters at a cost of over $17M. These meters and devices and have an estimated remaining useful life of more than 10 years. Extending the contract with Ferguson will allow the County to maximize the current investment and remaining useful life of the product. • The technology installed acquired from vendor Ferguson utilizes a communications platform that is only compatible with products from the same manufacturer. While the County can purchase meters and AMR devices from a different manufacturer, extending the contract with Ferguson will allow the County to continue to purchase and install compatible products. This will allow the County to avoid running multiple reading platforms in parallel that could incur increased cost for additional reading equipment, increased cost for additional software, and increased risks of missed reads or other errors. • As part of the previous contract, both the County and Ferguson extended significant 16.C.1 Packet Pg. 443 03/24/2020 effort with the development, testing, and deployment of a custom software interface between the meter reading system and the County’s customer information system. Extending the contract with Ferguson will help the County avoid additional costs associated with custom software development and testing of a new reading platform if the manufacturer changes. • Staff is already trained and familiar with the current software platform and meter reading system. Any change in the manufacture will require County staff to be trained on a new software platform and the use of new meter reading hardware as well as the maintenance and installation of any new water meters and transmitters. Staff would also have to be competent in both the current installed system as well as any new system. By maintaining the current system, the County avoids potential errors associated with running multiple platforms. • Ability to upgrade the existing system. Ferguson will supply the County with lat est generation of automated meter reading transmitters from the manufacturer through the contract extension. This latest generation of device is upgradeable to operation in an advanced metering infrastructure mode which was ranked as the highest rated solution in a separate RFP from the County. Extending the contract with Ferguson will allow the County to continue to maximize the current investment, maintain a unified reading system, and to upgrade to the latest technology at the County’s discretion. • Reduced lead times associated with local material availability. Ferguson is a qualified local vendor within the County and maintains on-hand inventory for the current manufacturer. Extending the contract with Ferguson will allow the County to benefit from reduced lead times and faster responses for new housing developments and service requests as well as reducing the amount of capital the County must invest for inventory. The Water Metering Section’s proposed plan is to continue utilizing Mueller meters over the next 5-10 years based on the current life of meters in the system, together with anticipated new connections primarily for residential installations and replacements, together with minimal commercial meters based off future anticipated development. The next five years of meter purchase estimates are summarized below: 2020 2021 2022 2023 2024 2,600 3,500 3,500 2,500 2,500 As set forth in Section 8, subsection 9 of the County Procurement Ordinance, the continued acquisition of the Mueller meters through Ferguson will provide both products and services necessary to maintain existing warranties and licenses as well as to maintain compatibility with the existing Water distribution system. Staff recommends that one-hundred eighty (180) days prior to the expiration of the initial five- year agreement term, the County perform a market analysis to determine current pricing available at that time for AMR and AMI meters to determine whether to exercise the proposed agreement’s 180-day extension period and re-solicit for new AMR and AMI meters compared to the cost-effectiveness and continuity of requesting another exemption from the competitive process and recommending a further five-year renewal of the attached agreement with Ferguson. FISCAL IMPACT: Funding is available in, and consistent with, the FY2020 Operating Budget approved by the Board on September 19, 2019. Anticipated costs in the fiscal year is approximately $900,000. The source of the funding is the Collier County Water-Sewer District Operating Fund (408) and Water Capital Fund (412). The exact fiscal impact will depend on the number of new requests for service connections, the number of meter failures, and the ongoing audit of all potable meters.
