Resolution 1998-002 1 6A 7 RESOLUTION 98-~ A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, PURSUANT TO SECTION 2.7.3.4 Or- Tim COLLIER County LAND DEVELOPMENT CODE AFFECTING ORDINANCE 91- 55 M,sO KNOWN AS SADDLEBROOK VILLAGE PUD, EXTENDING THE CURRENT pun APPROVAL TO DECEMBER 9, 1999; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Saddlebrook Village PUD, Ordinance 91-55 adopted on June 25, 1991, is subject to the provisions of Section 2.7.3.~., oE the Land Devel~pment Code (LDC} , Time Limits for ApprOV0d PUD 20ning DistrIcts together with their respective Master Plans; ~nd WHEREAS, the PUD was adopted consistent with and under the provisions of the Collier County Growth Management Plan; and WHEREAS, the Board of County Commissioners has reviewed the pun and determined to extend the current PUD Zoning for two years, until Cecember 9, 1999; and NOW, THEREFORE BE IT RESOLVED, by the Board of Zoning Appeals of Collier County, Florida that: 1. The above r.ecitals are adopted herein by reference as if fully set forth herein. 2. This Resolution shall constitute evidence of compliance with th~ review requirements of Section 2.7.3.4 of the LOr.'. 3. Pursuant to said section of the LDC, the current PUD approval is hereby extended to December 9, 1999; at the end of which time the owner shall submit to the procedures in LDC Section 2.7.3.4, subject further to the following conditions: a. Phases I and II of the PUD shall be constructed in compliance with all applicable, existing Land Development Code requirements. b. Phase I shall be developed for 100% affordable units as provided in the new Affordable Housing Density Bonus Agreement approved by the Board of County Commissioners on December 9, 199/. Phase II shall also be developed as provided in the new Agreement. c. Prior to expiration of the 2 year extension period, a PUD amendment shall be filed with the County to formally incorporate the applicable Land Development Code standards in the PUD document. -1- .........~~---.......IIF! .,...~ .., 1 6A 7 d. Architectural elevations for Phase I shall be constructed in compliance with the architectural elevations attached hereto as Exhibit A consisting of two pages. This Resolution supersedes and replaces Resolution 97-55 as corrected by Scrivener's Error Resolution 97-453. This Resolution shall become effective immediately upon its approval. BE IT FURTHER RESOLVED that this Resolution be recorded in the mInutes of this Board and in the records of the Petition for which the extensiC::il is granted.
