EXECUTIVE SUMMARY
Recommendation to approve Agreement No. 20-7721-WV for legal and non-legal advertisements as
exempted procurements and authorize the Chairman to sign the agreement with Desk Spinco, LLC,
d/b/a Naples Daily News.
OBJECTIVE: To provide legal and non-legal advertisements and broadcast information to the public
for County business, programs and initiatives.
CONSIDERATIONS: Currently, the County has an active contract (Agreement No. 19-7576-WV) with
the Desk Spinco, LLC, d/b/a Naples Daily News (“Naples Daily News”) approved by the Board on
February 26, 2019 (Item 16.E.4), which establishes discounted rates for advertisements. Those
advertisements are used in the daily operation of the County to promote various community programs,
legal advertisements for issues such as impact fees, solicitations, ordinances, public meetings, and any
other public advertisements required by the Florida statutes. Agreement No. 19-7576-WV expires on
February 28, 2020.
Staff has negotiated reduced rates for the publication of legal and non-legal advertisement with the Naples
Daily News under the new attached proposed Agreement No. 20-7721-WV. The rate for non-legal
advertisements, also referred to as “run of paper,” is $39.69 per column inch, per day, including color.
The Naples Daily News is honoring our last year's rates, due to the new ad sizing. The Collier Citizen
and Marco Eagle will be billed at the same rate as last year as well. Digital rates have also been included.
Legal advertisements remain at the rate of $3.50 per line, (the vendor’s regular established commercial
rate) with a 15% discount for second and subsequent runs in compliance with Florida Statute § 50.061(3)
for government official public notices and legal advertisements.
Staff negotiated the attached proposed Agreement as authorized by Section 8.4 of Collier County
Procurement Ordinance No. 2017-08, which recognizes advertisements as a category of procurement
eligible for an exemption from the competitive process based upon a lack of available competition and a
determination that such an exemption is in the best interest of the County. The Naples Daily News is the
only area publication that can provide these services. The staff approved exemption form is attached for
the Board’s consideration.
The attached agreement is for a one-year term (commencing on February 29, 2020) and will be used
county-wide. Growth Management's Operations & Regulatory Management Division will serve as the
administrator of the agreement.
FISCAL IMPACT: Funds are budgeted in the Divisions’ Cost Centers that require advertising and
broadcast services for County programs and events. Historically, County Divisions have spent
approximately $300,000 annually on legal and non-legal advertisement in the Naples Daily News (Desk
Spinco).
GROWTH MANAGEMENT IMPACT: There are no Growth Management Impacts associated with
this action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote
for Board approval. -SRT
RECOMMENDATION: To approve the Agreement with Desk Spinco, LLC, d/b/a Naples Daily News
for legal and non-legal advertisements as exempted procurements and authorize the Chairman to sign the
Agreement No. 20-7721-WV.
