Agenda 02/25/2020 Item #16D 3 (Amendment #3 to 2017 Agreement w/City of Naples)02/25/2020 EXECUTIVE SUMMARY Recommendation to approve Amendment No. 3 to the 2017 Agreement with the City of Naples grant application for the 8th Avenue South ADA (Americans with Disabilities Act) related improvements; extend it to August 29, 2020 and make a finding that this item promotes tourism. OBJECTIVE: To provide additional time to the City of Naples to complete their approved 2017 grant project. CONSIDERATIONS: On September 10, 2019, Amendment No. 2 to the City of Naples agreement was approved by the Board of County Commissioners (Board) and set to expire on February 29, 2020. The scope of the original agreement was to use Tourist Development Tax funding to install ADA access related improvements at the 8th Avenue South beach access point. The scope of the work has not changed, but due to several unforeseen delays in the permitting process and other extenuating circumstances, this project will not be completed by the deadline of February 29, 2020, as per the amendment. In order to complete this project, the City of Naples is requesting that this agreement be extended to August 29, 2020. FISCAL IMPACT: $200,000 is budgeted in Tourist Development Tax funded Beach Park Facilities Fund (183) for the 8th Avenue project (Project No. 80369). There is no additional fiscal impact associated with the requested action. LEGAL CONSIDERATIONS: This Item is approved as to form and legality and requires majority vote for approval. -CMG GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated with this action. RECOMMENDATION: To approve Amendment No. 3 to the 2017 Agreement with the City of Naples grant application for the South Beach Park Improvement; extend it to August 29, 2020 and make a finding that this Item promotes tourism.
