EXECUTIVE SUMMARY
Recommendation to ratify the approval of a Florida Power and Light (FPL) easement at the
Collier County Sports and Special Events Complex (the Complex) and authorize the County
Manager or his designee to sign future FPL easements and agreements associated with the
Complex.
OBJECTIVE: To expedite the Florida Power and Light (FPL) easement and agreement approval
process.
CONSIDERATION: The Collier County Sports and Special Events Complex is currently being
constructed utilizing a Construction Manager at Risk contract. The site is being developed and
constructed to meet the power requirements through FPL. The accelerated construction schedule and
some partnerships with FPL require easements and agreements to be executed prior to work being
scheduled or completed.
The complex has partnered with FPL to provide solar canopies, electric vehicle charging stations,
pedestrian lighting, street lighting, and parking lot lighting. These partnerships will require the approval
of ministerial agreements and easements for access and operating requirements. A Master easement plan
(attached) has been developed for the site. As each specific sketch and legal description is developed by
the County’s engineer and then approved by FPL they must be executed before FPL will release work to
implement the appurtenances.
These agreements and easements are typically ministerial and administrative. Due to the many unique
partnerships with FPL at the Complex, time constraints to opening the facility, and in an abundance of
transparency, staff is requesting Board approval to facilitate these agreement and easement approvals.
FISCAL IMPACT: There is no fiscal impact related to this action.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan related to
this action.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -JAK
RECOMMENDATION: That the Board of County Commissioners ratifies the attached easement
agreement and authorizes the County Manager or his designee to sign the FPL easements and agreements
associated with the Collier County Sports and Special Events Complex.
