Agenda 02/25/2020 Item #16A 5 (Release of Liens) - Code Enforcement)02/25/2020 EXECUTIVE SUMMARY Recommendation to approve the release of three code enforcement liens with a value of $41,209.20 for payment of $3,000 in the code enforcement actions entitled Board of County Commissioners v. Jessica Nicole Thompson and Jennifer Diane Thompson, relating to property located at 843 94th Ave. North, Collier County, Florida. OBJECTIVE: For the Board of County Commissioners to accept an offer to release three code enforcement liens, with an accrued value of $41,209.20, for payment of $3,000 in relation to Code Enforcement Board Case No's. CELU20180006133, CEV20180006947 and CEV20180009971. CONSIDERATIONS: When the subject property was owned by Jessica and Jennifer Thompson, the Code Enforcement Special Magistrate ordered the imposition of three code liens on the property, due to various code violations. The first lien was for code violations consisting of outside storage of interior furniture, lamps, rugs, plastic bags and containers, aluminum gutters, wood, and other debris at the residence. The lien was recorded on November 7, 2018, at O.R. Book 5569, Page 2868. The current lien amount is $23,711.85, based on 236 days of accrued fines ($100 per day from September 3, 2018, through April 26, 2019) totaling $23,600, plus $111.85 in operational costs. The property was brought into compliance with these violations on April 19, 2019. The second lien was for code violations consisting of commercial vehicles with equipment and materials attached and extending beyond the length of the vehicle parked at the residence. The lien was recorded on November 7, 2018, at O.R. Book 5569, Page 2866. The current lien amount of $223.80 is based on operational costs of $112.05, plus an additional $111.75 in operational costs. The property was abated on August 3, 2018. The third lien was for code violations consisting of commercial vehicles parked at the residence. The lien was recorded on April 24, 2019, at O.R. Book 5621, Page 1691. The current lien amount is $17,273.55, based on 168 days of accrued fines ($100 per day from September 3, 2018, through April 26, 2019) totaling $16,800 plus $223.55 in operational costs and a civil penalty of $250. Robert A. and Marion G. Gilkerson re-acquired the property via General Warranty Deed, foreclosure recorded on July 10, 2019. Pursuant to Resolution No. 2012-46, a request for reduction of fines may be considered, in part, when a lien encumbers property under new ownership and the new owner has diligently pursued abatement and achieved compliance and/or when payment of the lien would impose a severe financial hardship on the owner. The new owners took title to this property with uncorrected violations after the satisfaction of mortgage was surrendered by the payors, Jessica and Jennifer Thompson. There was a substantial amount of time and money spent for clean-up, repairs and legal expense for the property. Mr. Gilkerson’s health is declining and a substantial amount of time is needed to recover from the required treatments. The property is actively maintained, and the owner has paid $3,000 in settlement of fines and requesting the remaining $38,209.20 in accrued fines be waived. There are no known code violations remaining on the property. FISCAL IMPACT: Payment of $3,000 in settlement of fines has been received. If approved by the Board accrued fines in the amount of $38,209.20 would be waived. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution 2012-46.
