EXECUTIVE SUMMARY
Recommendation to adopt an ordinance amending Ordinance No. 2013-33, as amended, the Collier
County Animal Control Ordinance, codified in Chapter 14, Article II of the Code of Laws and
Ordinances, in order to regulate pet shops and breeders and Ordinance No. 2013-55, as codified in
Chapter 14, Article IV of the Code of Laws and Ordinances, relating to the standards of care for
animal-related businesses, animal-related organizations, commercial breeders, non-commercial
breeders, and rodeos.
OBJECTIVE: To amend the Collier County Animal Control Ordinance to regulate pet shops and
breeders and implement recommendations made by the Animal Services Advisory Board.
CONSIDERATIONS: On May 14, 2013, the Board of County Commissioners (Board) adopted
Ordinance No. 2013-33, which repealed and replaced the County’s prior animal control ordinance. The
Board subsequently amended the Ordinance through its adoption of Ordinance No. 2018-33.
On September 24, 2013, the Board adopted Ordinance No. 2013-55, establishing standards of care for
animal-related businesses, animal-related organizations, and breeders.
On October 8, 2019, the Board voted to have the Animal Services Advisory Committee work with
community leaders, Humane Society Naples, and animal-related businesses to develop an ordinance to
regulate animal retail businesses.
On December 19, 2019, the Animal Services Advisory Board held a workshop to discuss and review
regulatory language to amend the existing Collier County Animal Control Ordinance to better regulate pet
shops and breeders. Representatives from Petland, the community, and the Humane Society Naples
participated in the workshop. Regulatory language from Palm Beach County, § 828.29, Florida Statutes,
Cook County, IL, and Petland were discussed.
On January 21, 2020, the Animal Services Advisory Board voted to recommend changes to the
regulations for animal-related businesses (pet shops) and breeders.
The proposed Ordinance incorporates the recommended changes approved by the Anim al Services
Advisory Board.
The following is a high-level summary of the proposed changes to the ordinance:
• Update definitions to include defining pet shops, pet stores, cat, and dog.
• Adding language to regulate breeders from selling, giving away, or otherwise conveying
animals without a permit on public property or parking lot.
• Eliminate notification requirements for quarterly breeder inspections.
• Establish language that warrants denial, suspension, or revocation of a permit.
• Change Non-Commercial Breeder to Hobby Breeder.
• Relevant language for pet shops was removed from section six, regulations for breeders and
pet shops, and added to section four, regulations for animal -related businesses and
organizations.
• Add regulatory language for pet shops and breeders.
• Add operations standards for pet shops and pet dealers.
• Add language from Florida State Statute 828.29, dogs and cats transported or offered for sale;
health requirements; consumer guarantee.

ADVISORY BOARD RECOMMENDATION: On January 21, 2020, the Animal Services Advisory
Board voted 4-1 in favor of the proposed changes and recommending an Ordinance incorporating those
changes to be considered by the Board.
FISCAL IMPACT: The proposed changes to the ordinance are expected to increase the workload for
staff. The level of impact is not yet fully known; however, it is estimated that 1.5 FTEs may be needed.
Based on current budgeted costs, adding 1.5 FTEs would equate to approximately $105,000 independent
of any operating expense impact. The cost to advertise the proposed Ordinance is approximately $600.
GROWTH MANAGEMENT IMPACT: There is no Growth Management impact.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this Item and approved it as
to form and legality. Majority vote of the Board is required for approval. -KLN
RECOMMENDATION: To adopt the attached ordinance amending Ordinance No. 2013-33, as
amended, the Collier County Animal Control Ordinance.
