Agenda 01/14/2020 Item #16C4 (Sale of County Property - 343 Saint Andrews Blvd)01/14/2020 EXECUTIVE SUMMARY Recommendation to surplus County-owned property located at 343 Saint Andrews Boulevard, advertise the property for sale pursuant to the provisions outlined in Section 125.35(1)(c), Florida Statutes, and set a minimum bid of $126,583. OBJECTIVE: To declare the County-owned property located at 343 Saint Andrews Boulevard as surplus and accept bids. CONSIDERATIONS: On July 24, 2012, Agenda Item 16.C.7, the Board approved the purchase of property located at 343 Saint Andrews Boulevard for the purposes of future infrastructure improvements and the relocation of sub-master pumping station 300.06. On April 23, 2019, Agenda Item 16.C.8, Board direction was to sell County-owned Lot 16, Block 20, of Lely Golf Estates, St. Andrews East to the Lely Homeowners Association (HOA) at a price at or near market value, but not less than $67,500. The HOA requested an “assignment clause” be added to the Real Estates Sales Agreement to allow a designee cash buyer, to buy the property, rather than the HOA. This request was inconsistent with previous Board direction. Since the intent of the HOA was to sell it to be developed as a single -family home and not retain it as open space, it is incumbent on the County to dispose of the lot consistent with the law. Staff is recommending that the property be advertised for sale as a single-family parcel, as currently zoned, pursuant to Section 125.35(1)(c), Florida Statutes which requires that no sale of any real property shall be made unless notice thereof is published once a week for at least two weeks in some newspaper of general circulation published in the County. The minimum bid price represents the average of two independent State certified in-house valuations by Roosevelt Leonard and Harry Henderson at $98,000 and $125,000, respectfully and the Property Appraiser’s Land Value/Market Value of $156,751. Copies of the valuations and Property Appraiser data sheet are attached for reference. A Location Map is attached for reference. FISCAL IMPACT: If the property is sold, all proceeds including the cost of advertising will be deposited in Wastewater User Fee Capital Fund 414. GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan at this time. LEGAL CONSIDERATION: This item has been reviewed by the County Attorney, is approved as to form and legality, and requires majority vote for approval. -JAK RECOMMENDATION: That the Board of County Commissioners surplus County-owned property located at 343 Saint Andres Boulevard, authorize the property be advertised for sale pursuant to the provisions of F.S. 125.35(1)(c) setting a minimum bid of $126,583, and bring back the bids received for further action by the Board.
