Agenda 01/14/2020 Item #11D (Vanderbilt Beach Road Expansion)01/14/2020 EXECUTIVE SUMMARY Recommendation to adopt a resolution superseding Resolution No. 2008-387 and authorizing the acquisition by gift or purchase of fee simple parcels and easements necessary for the construction of roadway, drainage and utility improvements required for the expansion and extension of Vanderbilt Beach Road from Collier Boulevard to 16th Street NE and Massey Street from Vanderbilt Beach Road to south of Mockingbird Drive (Project No. 60168). Estimated fiscal impact: $33,321,305. OBJECTIVE: To adopt a resolution extending the limits of fee simple and easement acquisition for the expansion and extension of Vanderbilt Beach Road from Collier Boulevard to 16th Street NE and Massey Street from Vanderbilt Beach Road to south of Mockingbird Drive (“Project”), thereby repealing Resolution No. 2008-387, which only authorized fee simple and easement acquisition for Vanderbilt Beach Road from Collier Boulevard to the Corkscrew Canal and did not include improvements along Massey Street. CONSIDERATIONS: On December 16, 2008, the Board of County Commissioners (“the Board”) adopted Resolution No. 2008-387, delegating administrative settlement authority to the County Manager or his designee to approve the purchase of real property interests necessary for construction of roadway, drainage and utility improvements required for the construction of the Vanderbilt Beach Road Extension Project from Collier Boulevard to the Corkscrew Canal. Since the adoption of said Resolution, the corridor for this segment of the Project has been extended from the Corkscrew Canal to 16th Street NE and on October 22, 2019, the Board approved the alignment of the Project. On December 10, 2019, the Board added the proposed improvements to Massey Street from Vanderbilt Beach Road to just south of Mockingbird Drive to this Project. In addition, current Board policy requires that sample agreements be attached to gift and purchase resolutions. Sample agreements were not attached to Resolution No. 2008 - 387 but are attached to today’s Agenda item. Construction of the Project is currently scheduled for the first quarter of fiscal year 2022. The adoption of the attached resolution will provide staff with the Board’s authority to secure title work, obtain independent real estate appraisals and negotiate for the purchase of the real property interests (fee simple parcels, including the acquisition of entire properties, both improved and unimproved, permanent easements for road right-of-way, drainage, utility, and boat ramp purposes, and temporary easements for construction and driveway restoration purposes) required for the construction of the Project. Five properties improved with homes must still be acquired in full. Gift and Purchase Resolutions delegate to the Chairman and to the County Manager, or his designee, certain ministerial authorities that streamline the acquisition process and preclude the necessity to return to the Board for the approval of each and every purchase. In addition to the direct cost of the parcels required for construction, the County is also required to pay severance damages and/or costs to mitigate damages to remaining properties (“cost -to-cure” expenses) caused as a result of the loss of the part taken to construct the Project, or caused as a result of the construction of the proposed improvements, business damages, all expenses for title work, real estate appraisals, and those expenses related to condemnation when necessary, such as property owner attorney fees and expert witness fees and costs, according to Sections 73.091 and 73.092, F.S. To the extent settlements are achieved in lieu of litigation, these costs may be reduced significantly. FISCAL IMPACT: The fiscal impact associated with this item is estimated to be $33,321,305. The primary funding source for the acquisition of right-of-way is impact fees. Should impact fees not be sufficient within a particular project, the secondary funding sources will be gas tax and sales tax. 11.D Packet Pg. 387 01/14/2020 No maintenance costs are anticipated until such time as the Project is constructed. GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the Long-Range Transportation Plan and the Collier County Growth Management Plan. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote for Board approval. - CMG RECOMMENDATION: Adopt the attached Resolution with attachments; Authorize the Board’s Chairman to execute same on behalf of the Board; and Authorize any budget amendments that may be necessary to implement the collective will of the Board as evidenced by the adoption of the attached Resolution and approval of this Executive Summary.
