Agenda 12/10/2019 Item #16F12 (RFP #19-7667 - Miles Partnership, LLLP)16.F.12 12/10/2019 EXECUTIVE SUMMARY Recommendation to award Request for Proposal No. 19-7667, "Website Design and Development for the Collier County Office of Business and Economic Development," to Miles Partnership, LLLP, authorize the Chairman to sign the attached agreement, and authorize necessary budget amendment. OBJECTIVE: To authorize the design and build of an integrated economic development website for Collier County Office of Business and Economic Development, along with the required annual website maintenance. CONSIDERATIONS: Currently, economic development information regarding County and partnership programs is stored on several different websites with no thematic integration. All websites contain important information regarding the economic development programs offered here in Collier County but lack similar branding and consolidation that would be important to businesses or to the relocation and site selection business community. In addition, multiple websites are more difficult to manage and can contain outdated information that should be streamlined and consolidated. The County's economic development program has three priorities: (1) business retention and expansion; (2) business attraction; and (3) entrepreneurship through incubation and acceleration. In addition to internal division programs, the County's economic development program accomplishes its priorities through active management and supervision of a performance-based financial incentives program. All the services, information and data that assist in marketing the County as a business -friendly and feasible relocation destination, needs to be publicly available and actively promoted. Using a website that leverages the established tourism branding of ParadiseCoast.com achieves the necessary synergy to reduce cost and improve outcomes associated with both the economic development program and tourism. The new site will maintain the general look and feel of ParadiseCoast.com but it will be designed specifically to serve the needs of business owners looking to build, expand or relocate their enterprises in Collier County. The objective is to create budgetary efficiencies where possible by replicating as much of the front-end styling already created for ParadiseCoast.com, while customizing features set to fit the unique needs of the economic development audience. On September 19, 2019, the Procurement Services Division issued Request for Proposal No. 19-7667 to 5,607 vendors for Website Design and Development for the Collier County Office of Business and Economic Development. Interested parties downloaded one hundred twenty-seven (127) solicitation packages, and the County received eight (8) proposals by the October 21, 2019 deadline. The County deemed Granicus, LLC and Sigma Solve, Inc. as non-responsive due to the failure to submit required forms. Proposals were based on set criterion, including Project Approach, Cost of Services to the County, Experience and Capacity of the Firm, and Specialized Experience of Team Members. FISCAL IMPACT: The initial cost of the website build is $157,760. Funds are available in the Economic Development Program Fund 007, with revenue received from the local government share of gaming proceeds pursuant to the agreement between the State of Florida and the Seminole Tribe. Annual maintenance/hosting services for the website will cost $19,320 for the first three years (the initial term) of the Agreement; thereafter, if the Contractor can establish that the costs for providing that service has increased by at least 10% the Parties may negotiate an increase if they agree to exercise the two one-year renewal terms of the Agreement. A budget amendment that realigns existing budget into a separate economic development website development project budget is necessary. GROWTH MANAGEMENT IMPACT: This request is consistent with Objective 3 of the Economic Element of the Collier County Growth Management Plan which states: "Collier County will support programs which are designed to promote and encourage the recruitment of new industry as well as the expansion and retention of existing industries in order to diversify the County's economic base." The site must also make content easily accessible to all devices to meet the demands of mobile traffic. Miles and the Collier County Office of Business & Economic Development (OBED) have worked hand-in-hand planning the design and development of a forward -thinking, industry-leading website that will successfully serve the needs of the OBED and its stakeholders, reaching business owners across all devices and reflecting the Paradise Coast brand seamlessly. In July 2019, we developed an initial Project Brief and Build Plan together with OBED to provide a roadmap for moving forward. This document, and your resulting RFP for a website design and development partner, do a great job of defining our focus for the new CollierEDO.com: Our overarching objective is, together, to create a simple, scalable and flexible platform using the Drupal 8 CMS that addresses the core functions of a modern economic development website, while planning further iterations of the feature set post -launch as part of a maintenance and evolution phase. The planned features list we recommend represents a mix of core elements and enhancements in an effort to improve the site's usability, navigability, discoverability of its content and overall UX. Each feature outlined below contributes to the site's overarching goal to encourage commercial growth opportunities in Collier County. While the site will maintain the general look and feel of ParadiseCoast.com, it will be designed specifically to serve the needs of the business owner hoping to build, expand or relocate their enterprise in Collier County. Another important objective is to create budgetary efficiencies by replicating as much of the front-end styling already created for ParadiseCoast.com where possible, while customizing the features set and back -end to fit the unique needs of the OBED's audience. Due to the variance in content and features, we recommend that these sites remain in place during phase 1 of the build. Landing pages will be created to house foundational information and link off to the existing freestanding sites, leveraging the foundation laid in phase 1 of the build. Any additional features and content migration efforts required to support each of these will be included in a secondary phase scoped and prioritized separately upon completion of the initial build. Let's take a closer look at some of the key elements of the site: Information Architecture & Site Structure Miles worked closely with OBED to develop a reimagined sitemap that is clean, simplified and supports an evolving information architecture that can accommodate future migrations and emerging trends. We believe this is the right approach for OBED because of Drupal's strength in handling complex content workflows such as modular page builds and integrations in a seamless, intuitive and easily trainable way. Because Drupal is an open -source platform, you can take comfort in knowing that you will not be locked into a hard -to -manage proprietary system that depends on a small team of in-house developers to evolve, but will be able to take advantage of new developments and improvements that are constantly being supplied by the Drupal community. The Drupal CMS is the best choice for your "future -proof' website platform. It is intuitive to use and easy to customize, so whether you need to update an article, place new content or build a form, all of those actions can be easily accomplished. Our developers provide enterprise -level CMS tools that enable your staff control over pertinent areas of the site. Your staff (ours, too) can easily make updates to the new site because each page has a record in the CMS that can be edited by anyone with password -protected access and minimal web experience. When that form is submitted, the data can be stored locally or integrated with any third -party service that provides an API to accept that data. One example of this is email newsletter forms, which can be set up to automatically post new subscribers into a designated list in your email campaign platform, which can in turn be configured to send a welcome email to new subscribers. As email has potential for driving high-quality traffic to the site, this is an opportunity to build these email lists and grow email as a referral source through webforms. To do this, Miles will conduct a thorough content audit of both sites looking at content quality, merge strategy and potential tagging structure. Key objectives include: o Ensuring businesses know the OBED exists o Educating businesses about the opportunities available in Collier County o Making connections and referrals We believe the website goals to support these objectives include increasing website traffic, content engagement and leads. To effectively measure success against the stated goals, specific metrics were identified and outlined in the chart below. This results -focused approach includes the setup of a wide range of goals in Google Analytics, including custom events and integrated link tracking. The critical goals we will set up are based on our research and the continued validation of your most important goals. We can also use Advanced Segmentation to better understand the site behaviors and navigation of your most qualified users—those who complete one or more of these conversions—and how we can better engage and convert them. Now let's take a look at the specific tasks we'll undertake to make it all happen. Planning & Management Specific tasks and deliverables include: Sprint Schedule: Detailed sprint schedule that visually outlines the Design, Build and Launch Phases of this project. Build Team Scheduled Communications: This covers all sprint kickoffs, scrums and sprint review meetings inclusive of five participants per sprint (developers, art director, content manager and interactive producer). One kickoff, two scrums and one internal review per sprint across an estimated 11 sprints. Interactive Producer: Technical project management over the life of the build. Functions include backlog management, task assignment and day-to-day team and client communications, status reporting, and tracking on schedule board. Project Manager: Ad hoc calls with client and team, scheduling resources, responding to client questions and emails. Estimating -1 hour/week over the life of the build. Weekly Client Status Meetings: Weekly meetings with client to discuss status of the project, inclusive of 26 meetings at three hours / week (includes prep and follow-up) with two people on every call. Response Team Introduction & Training: Site walk-through for Response team, the team responsible for responding to urgent site requests after the website launches. GDPR Documentation Page & Site Review: A survey of the site for GDPR compliance, accompanied by documentation of what PH is housed where and who has access to it. Miles keeps this on file in case privacy requests are made. Content Services Specific tasks and deliverables include: Content Audit & Strategy: Estimated 60 pages to be thoroughly reviewed for quality updates, merge strategy and potential tagging structure (if a tagging structure is deemed necessary). Implementation of the strategy and recommendations will be the responsibility of OBED. Miles 10 16.F.12.a Packet Pg. 3066 Website Design and Development Proposal for Collier County Office of Business and Economic Development Content Migration: After OBED finishes writing editorial and collecting/editing photo and video assets, Miles will load content for all landing pages identified in the sitemap (estimated 20 pages) while OBED loads all property pages, info pages and news pages. This process allows both parties to simultaneously load content and expedite the timeline and migration process. Miles will create a tracking spreadsheet that will be shared with the OBED team for mutual updating and progress tracking. CMS Training & Reference Guide: One recorded training session in preparation for handing the site over to OBED for content migration efforts, and recorded spot -training for new features completed and handed over to editors after this point. Miles will also provide a CMS reference guide after the site is launched. 301 Redirects: OBED to pull top 50 pages from each site by organic search volume in the last six months and share list of old vs. new URLs as part of the migration plan. This list should be submitted to Miles in advance of launch so Miles can load these redirects into the site. Miles will also work with OBED to re -point DNS and configure domain -level redirects. 404 Monitoring: Includes GA report creation and weekly report setup, as well as 301 -redirect creation as needed for four weeks following launch. Overarching Design Services Specific tasks and deliverables include: Element Collage: Similar to a style tile, a designer will outline the anticipated elements included in the build plan and design options around what those elements could look like. This is less comprehensive than a fully executed design comp, but more robust than a mood board. This document will help inform base styles and front-end theme and will give the OBED team and the designer enough visual direction before the development of detailed design comps. Iconography Set: Icon set for predefined data points identified in the forthcoming content audit. Used to help break up the text and make the content easier to scan. Logo: Three versions of an OBED logo designed with two rounds of refinements. Logo would leverage existing Paradise Coast brand elements. Includes delivery of asset(s). If brand guidelines are desired, additional scope is required. Exact direction will be determined during design phase; capabilities to reside within this scope (i.e. we will not propose something that will go above and beyond this estimate). Dev Site Deployment and Front -End Setup: Set up dev environment, install Drupal, begin custom theme. Core Modules and Structure: Module and structural configuration, including menus, taxonomies, pathing plan and config, Metatag, 301 Redirect, XML Sitemap, Media, Linklt, CKEditor, Pathauto, Transliteration, Global Redirect, Webform and any other required modules to support the core site buildout as planned. Base Styles, Online Style Guide and Favicon: Boilerplate CSS and front-end framework. Centrally located in the Midwest within a day's drive of one-third of the US population, Branson's popularity has expanded nationally and internationally in recent years. The website needed to speak to all of these audiences in a way that was both inspiring and practical. DHS reserves the right to conduct Form I-9 compliance inspections, as well as any other enforcement or compliance activity authorized by law, including site visits, to ensure proper use of E-Verify. 9. The Employer is strictly prohibited from creating an E-Verify case before the employee has been hired, meaning that a firm offer of employment was extended and accepted and Form I-9 was completed. The Employer agrees to create an E-Verify case for new employees within three Employer business days after each employee has been hired (after both Sections 1 and 2 of Form I-9 have been completed), and to complete as many steps of the E-Verify process as are necessary according to the E-Verify User Manual. If E-Verify is temporarily unavailable, the three-day time period will be extended until it is again operational in order to accommodate the Employer's attempting, in good faith, to make inquiries during the period of unavailability. 10. The Employer agrees not to use E-Verify for pre-employment screening of job applicants, in support of any unlawful employment practice, or for any other use that this MOU or the E-Verify User Manual does not authorize. 11. The Employer must use E-Verify for all new employees. The Employer will not verify selectively and will not verify employees hired before the effective date of this MOU. Employers who are Federal contractors may qualify for exceptions to this requirement as described in Article II.B of this MOU. 12. The Employer agrees to follow appropriate procedures (see Article III below) regarding tentative nonconfirmations. The Employer must promptly notify employees in private of the finding and provide them with the notice and letter containing information specific to the employee’s E-Verify case. The Employer agrees to provide both the English and the translated notice and letter for employees with limited English proficiency to employees. The Employer agrees to provide written referral instructions to employees and instruct affected employees to bring the English copy of the letter to the SSA. The Employer must allow employees to contest the finding, and not take adverse action against employees if they choose to contest the finding, while their case is still pending. The Employer agrees to comply with Title VII of the Civil Rights Act of 1964 and section 274B of the INA as applicable by not discriminating unlawfully against any individual in hiring, firing, employment eligibility verification, or recruitment or referral practices because of his or her national origin or citizenship status, or by committing discriminatory documentary practices. The Employer understands that such illegal practices can include selective verification or use of E-Verify except as provided in part D below, or discharging or refusing to hire employees because they appear or sound “foreign” or have received tentative nonconfirmations. The Employer further understands that any violation of the immigration-related unfair employment practices provisions in section 274B of the INA could subject the Employer to civil penalties, back pay awards, and other sanctions, and violations of Title VII could subject the Employer to back pay awards, compensatory and punitive damages. Violations of either section 274B of the INA or Title VII may also lead to the termination of its participation in E-Verify. The Employer agrees that it will use the information it receives from E-Verify only to confirm the employment eligibility of employees as authorized by this MOU. The Employer agrees that it will safeguard this information, and means of access to it (such as PINS and passwords), to ensure that it is not used for any other purpose and as necessary to protect its confidentiality, including ensuring that it is not disseminated to any person other than employees of the Employer who are authorized to perform the Employer's responsibilities under this MOU, except for such dissemination as may be authorized in advance by SSA or DHS for legitimate purposes. 16. The Employer agrees to notify DHS immediately in the event of a breach of personal information. Breaches are defined as loss of control or unauthorized access to E-Verify personal data. All suspected or confirmed breaches should be reported by calling 1-888-464-4218 or via email at E-Verify@dhs.gov. Please use “Privacy Incident – Password” in the subject line of your email when sending a breach report to E-Verify. 17. The Employer acknowledges that the information it receives from SSA is governed by the Privacy Act (5 U.S.C. § 552a(i)(1) and (3)) and the Social Security Act (42 U.S.C. 1306(a)). Any person who obtains this information under false pretenses or uses it for any purpose other than as provided for in this MOU may be subject to criminal penalties. 18. The Employer shall not make any false or unauthorized claims or references about its participation in E-Verify on its website, in advertising materials, or other media. The Employer shall not describe its services as federally-approved, federally-certified, or federally-recognized, or use language with a similar intent on its website or other materials provided to the public. Entering into this MOU does not mean that E-Verify endorses or authorizes your E-Verify services and any claim to that effect is false. 20. The Employer shall not state in its website or other public documents that any language used therein has been provided or approved by DHS, USCIS or the Verification Division, without first obtaining the prior written consent of DHS. 21. The Employer agrees that E-Verify trademarks and logos may be used only under license by DHS/USCIS (see M-795 (Web)) and, other than pursuant to the specific terms of such license, may not be used in any manner that might imply that the Employer’s services, products, websites, or publications are sponsored by, endorsed by, licensed by, or affiliated with DHS, USCIS, or E-Verify. 22. The Employer understands that if it uses E-Verify procedures for any purpose other than as authorized by this MOU, the Employer may be subject to appropriate legal action and termination of its participation in E-Verify according to this MOU. B. RESPONSIBILITIES OF FEDERAL CONTRACTORS 1. If the Employer is a Federal contractor with the FAR E-Verify clause subject to the employment verification terms in Subpart 22.18 of the FAR, it will become familiar with and comply with the most current version of the E-Verify User Manual for Federal Contractors as well as the E-Verify Supplemental Guide for Federal Contractors. 2. In addition to the responsibilities of every employer outlined in this MOU, the Employer understands that if it is a Federal contractor subject to the employment verification terms in Subpart 22.18 of the FAR it must verify the employment eligibility of any “employee assigned to the contract” (as defined in FAR 22.1801). Once an employee has been verified through E-Verify by the Employer, the Employer may not create a second case for the employee through E-Verify. a. An Employer that is not enrolled in E-Verify as a Federal contractor at the time of a contract award must enroll as a Federal contractor in the E-Verify program within 30 calendar days of contract award and, within 90 days of enrollment, begin to verify employment eligibility of new hires using E-Verify. The Employer must verify those employees who are working in the United States, whether or not they are assigned to the contract. Once the Employer begins verifying new hires, such verification of new hires must be initiated within three business days after the hire date. The Employer has reviewed the Form I-9 information either in person or in communications with the employee to ensure that the employee’s Section 1, Form I-9 attestation has not changed (including, but not limited to, a lawful permanent resident alien having become a naturalized U.S. citizen). f. The Employer shall complete a new Form I-9 consistent with Article II.A.6 or update the previous Form I-9 to provide the necessary information if: i. The Employer cannot determine that Form I-9 complies with Article II.A.6, ii. The employee’s basis for work authorization as attested in Section 1 has expired or changed, or iii. SSA agrees to update SSA records as necessary if the employee who contests the SSA tentative nonconfirmation visits an SSA field office and provides the required evidence. If the employee visits an SSA field office within the eight Federal Government work days from the date of referral to SSA, SSA agrees to update SSA records, if appropriate, within the eight-day period unless SSA determines that more than eight days may be necessary. In such cases, SSA will provide additional instructions to the employee. If the employee does not visit SSA in the time allowed, E-Verify may provide a final nonconfirmation to the employer. Note: If an Employer experiences technical problems, or has a policy question, the employer should contact E-Verify at 1-888-464-4218. D. RESPONSIBILITIES OF DHS 1. DHS agrees to provide the Employer with selected data from DHS databases to enable the Employer to conduct, to the extent authorized by this MOU: a. DHS agrees to provide to the Employer with access to E-Verify training materials as well as an E-Verify User Manual that contain instructions on E-Verify policies, procedures, and requirements for both SSA and DHS, including restrictions on the use of E-Verify. 4. DHS agrees to train Employers on all important changes made to E-Verify through the use of mandatory refresher tutorials and updates to the E-Verify User Manual. Even without changes to E-Verify, DHS reserves the right to require employers to take mandatory refresher tutorials. 5. DHS agrees to provide to the Employer a notice, which indicates the Employer's participation in E-Verify. DHS also agrees to provide to the Employer anti-discrimination notices issued by the Office of Special Counsel for Immigration-Related Unfair Employment Practices (OSC), Civil Rights Division, U.S. Department of Justice. 6. DHS agrees to issue each of the Employer’s E-Verify users a unique user identification number and password that permits them to log in to E-Verify. 7. DHS agrees to safeguard the information the Employer provides, and to limit access to such information to individuals responsible for the verification process, for evaluation of E-Verify, or to such other persons or entities as may be authorized by applicable law. Information will be used only to verify the accuracy of Social Security numbers and employment eligibility, to enforce the INA and Federal criminal laws, and to administer Federal contracting requirements. 8. DHS agrees to provide a means of automated verification that provides (in conjunction with SSA verification procedures) confirmation or tentative nonconfirmation of employees' employment eligibility within three Federal Government work days of the initial inquiry. 9. DHS agrees to provide a means of secondary verification (including updating DHS records) for employees who contest DHS tentative nonconfirmations and photo mismatch tentative nonconfirmations. This provides final confirmation or nonconfirmation of the employees' employment eligibility within 10 Federal Government work days of the date of referral to DHS, unless DHS determines that more than 10 days may be necessary. In such cases, DHS will provide additional verification instructions. ARTICLE III REFERRAL OF INDIVIDUALS TO SSA AND DHS A. REFERRAL TO SSA 1. If the Employer receives a tentative nonconfirmation issued by SSA, the Employer must print the notice as directed by E-Verify. The Employer must allow employees to contest the finding, and not take adverse action against employees if they choose to contest the finding, while their case is still pending. 2. The Employer agrees to obtain the employee’s response about whether he or she will contest the tentative nonconfirmation as soon as possible after the Employer receives the tentative nonconfirmation. Only the employee may determine whether he or she will contest the tentative nonconfirmation. 3. After a tentative nonconfirmation, the Employer will refer employees to SSA field offices only as directed by E-Verify. The Employer must record the case verification number, review the employee information submitted to E-Verify to identify any errors, and find out whether the employee contests the tentative nonconfirmation. The Employer will transmit the Social Security number, or any other corrected employee information that SSA requests, to SSA for verification again if this review indicates a need to do so. 4. The Employer will instruct the employee to visit an SSA office within eight Federal Government work days. SSA will electronically transmit the result of the referral to the Employer within 10 Federal Government work days of the referral unless it determines that more than 10 days is necessary. 5. While waiting for case results, the Employer agrees to check the E-Verify system regularly for case updates. 6. The Employer agrees not to ask the employee to obtain a printout from the Social Security Administration number database (the Numident) or other written verification of the SSN from the SSA. B. REFERRAL TO DHS 1. If the Employer receives a tentative nonconfirmation issued by DHS, the Employer must promptly notify employees in private of the finding and provide them with the notice and letter containing information specific to the employee’s E-Verify case. The Employer also agrees to provide both the English and the translated notice and letter for employees with limited English proficiency to employees. The Employer must allow employees to contest the finding, and not take adverse action against employees if they choose to contest the finding, while their case is still pending. 2. The Employer agrees to obtain the employee’s response about whether he or she will contest the tentative nonconfirmation as soon as possible after the Employer receives the tentative nonconfirmation. Only the employee may determine whether he or she will contest the tentative nonconfirmation. 3. The Employer agrees to refer individuals to DHS only when the employee chooses to contest a tentative nonconfirmation. 4. If the Employer finds a photo mismatch, the Employer must provide the photo mismatch tentative nonconfirmation notice and follow the instructions outlined in paragraph 1 of this section for tentative nonconfirmations, generally. 6. The Employer agrees that if an employee contests a tentative nonconfirmation based upon a photo mismatch, the Employer will send a copy of the employee’s Form I-551, Form I-766, U.S. Passport, or passport card to DHS for review by: a. Scanning and uploading the document, or b. Sending a photocopy of the document by express mail (furnished and paid for by the employer). 7. The Employer understands that if it cannot determine whether there is a photo match/mismatch, the Employer must forward the employee’s documentation to DHS as described in the preceding paragraph. The Employer agrees to resolve the case as specified by the DHS representative who will determine the photo match or mismatch. 8. DHS will electronically transmit the result of the referral to the Employer within 10 Federal Government work days of the referral unless it determines that more than 10 days is necessary. 9. While waiting for case results, the Employer agrees to check the E-Verify system regularly for case updates. ARTICLE IV SERVICE PROVISIONS A. NO SERVICE FEES 1. SSA and DHS will not charge the Employer for verification services performed under this MOU. The Employer is responsible for providing equipment needed to make inquiries. To access E-Verify, an Employer will need a personal computer with Internet access. ARTICLE V MODIFICATION AND TERMINATION A. MODIFICATION 1. This MOU is effective upon the signature of all parties and shall continue in effect for as long as the SSA and DHS operates the E-Verify program unless modified in writing by the mutual consent of all parties. 2. TERMINATION 1. The Employer may terminate this MOU and its participation in E-Verify at any time upon 30 days prior written notice to the other parties. 2. Notwithstanding Article V, part A of this MOU, DHS may terminate this MOU, and thereby the Employer’s participation in E-Verify, with or without notice at any time if deemed necessary because of the requirements of law or policy, or upon a determination by SSA or DHS that there has been a breach of system integrity or security by the Employer, or a failure on the part of the Employer to comply with established E-Verify procedures and/or legal requirements. The Employer understands that if it is a Federal contractor, termination of this MOU by any party for any reason may negatively affect the performance of its contractual responsibilities. Similarly, the Employer understands that if it is in a state where E-Verify is mandatory, termination of this by any party MOU may negatively affect the Employer’s business. 3. An Employer that is a Federal contractor may terminate this MOU when the Federal contract that requires its participation in E-Verify is terminated or completed. In such cases, the Federal contractor must provide written notice to DHS. If an Employer that is a Federal contractor fails to provide such notice, then that Employer will remain an E-Verify participant, will remain bound by the terms of this MOU that apply to non-Federal contractor participants, and will be required to use the E-Verify procedures to verify the employment eligibility of all newly hired employees. 4. The Employer agrees that E-Verify is not liable for any losses, financial or otherwise, if the Employer is terminated from E-Verify. ARTICLE VI PARTIES A. Some or all SSA and DHS responsibilities under this MOU may be performed by contractor(s), and SSA and DHS may adjust verification responsibilities between each other as necessary. By separate agreement with DHS, SSA has agreed to perform its responsibilities as described in this MOU. B. Nothing in this MOU is intended, or should be construed, to create any right or benefit, substantive or procedural, enforceable at law by any third party against the United States, its agencies, officers, or employees, or against the Employer, its agents, officers, or employees. C. The Employer may not assign, directly or indirectly, whether by operation of law, change of control or merger, all or any part of its rights or obligations under this MOU without the prior written consent of DHS, which consent shall not be unreasonably withheld or delayed. Any attempt to sublicense, assign, or transfer any of the rights, duties, or obligations herein is void. D. Each party shall be solely responsible for defending any claim or action against it arising out of or related to E-Verify or this MOU, whether civil or criminal, and for any liability wherefrom, including (but not limited to) any dispute between the Employer and any other person or entity regarding the applicability of Section 403(d) of IIRIRA to any action taken or allegedly taken by the Employer. E. The vendor, at a minimum, must achieve the requirements of the Specifications or Scope of Work stated. The Division seeks a website that will be designed specifically to serve the needs of business owners hoping to build, expand, or relocate their enterprise in Collier County. The website will include customized features suited to the unique needs of the economic development audience. Historically, County departments have spent approximately $150,000 annually; however, this may not be indicative of future buying patterns. The results of this solicitation may be used by other County departments once awarded according to the Board of County Commissioners Procurement Ordinance. BACKGROUND Currently, economic development information regarding County and partnership programs is stored on several different websites with no thematic integration. All websites contain important information regarding the economic development programs offered in Collier County but lack similar branding and consolidation of related information; which would be invaluable to businesses, including the relocation and site selection business community. By consolidating and streamlining the County’s economic development information into a single website, utilizing the same County branding used in developing the County’s Tourism website, staff will eliminate the inherent difficulties in managing multiple websites, such as removing outdated information from several platforms. All the services, information and data that assist in marketing Collier County as a business-friendly and feasible relocation destination, needs to be publicly available and actively promoted. Using a website that leverages the already established branding, similar to the County’s ParadiseCoast.com website, will achieve the necessary synergy to reduce cost and improve outcomes associated with both programs. TERM OF CONTRACT The contract term, if an award is made is intended to be for three (3) years with two (2) one (1) year renewal options. Prices shall remain firm for the initial term of this contract. Surcharges will not be accepted in conjunction with this contract, and such charges should be incorporated into the pricing structure. The County Manager, or designee, may, at his discretion, extend the Agreement under all of the terms and conditions contained in this Agreement for up to one hundred eighty (180) days. The County Manager, or designee, shall give the Contractor written notice of the County's intention to extend the Agreement term not less than ten (10) days prior to the end of the Agreement term then in effect. All goods are FOB destination and must be suitably packed and prepared to secure the lowest transportation rates and to comply with all carrier regulations. In addition to internal division programs, Collier’s economic development program accomplishes its priorities through active management and supervision of a financial incentives program. The project goal will be to integrate and consolidate the existing Office of Business & Economic Development (OBED) websites into one website, utilizing the established branding of the Naples, Marco Island, Everglades, Convention and Visitors Bureau (CVB) website under the administration of the Collier County Tourism Division. Examples of current economic development websites are listed below. In addition, the County website contains outdated information that can be eliminated. Integration of select information from both sites into the existing architecture of the paradisecoast.com website would present a way to consolidate the important information into one place and offer a solution to the lack of cohesive branding by utilizing the already recognizable brand established by the CVB. The proposed new website will maintain the general look and feel of ParadiseCoast.com. The website will be designed specifically to serve the needs of business owners hoping to build, expand or relocate their enterprise in Collier County and will include customized features to be suited to the unique needs of the economic development audience. The objective is to create budgetary efficiencies by replicating as much of the front-end styling already created for ParadiseCoast.com where possible while customizing the features set and back-end to fit the unique needs of OBED’s audience. The objective of this project is to create a simple, scalable and flexible platform for OBED that addresses the core functions of a modern economic development website, while planning further iterations and evolution of the feature set post-launch as part of a maintenance and evolution phase. The planned features list represents a mix of core elements and enhancements in an effort to improve the site’s usability, navigability, discoverability of its content, and overall UX. The vendor should construct a proposal to design, build and maintain the proposed integrated economic development website to sustain a branding integrity that will instill a familiarity to both persons seeking tourism related sites and business opportunities in Collier County. Guiding Principles 1. Present information in a way that is clear, scannable and supports the dual readership path — The writing and formatting of website content should be done in a way that supports reading preferences for two types of readers: the analytical reader (reading from beginning to end) and the scanner/skimmer (looking for something that catches their eye). Use landing pages to introduce and inform — There is a wealth of information that exists on single pages between both existing sites. To provide users with a quicker path to get to the information they are looking for without needing to dig around the site or solely use site search to find what they are looking for, website should use teasing or introducing content on topic- specific landing pages which then link to info pages that provide more details and/or programming related to that specific subject matter. 3. Optimize meta data – Well optimized meta data and structured data are key factors for influencing not only ranking in search, but also presentation of the site’s content in search results. All existing and new pages should include custom, unique meta data. Website will set up dynamic rules to ensure all pages contain meta data, however for pages that are important for search, if possible, write/edit their meta data before content migration takes place, then load the optimized meta data when migrating content to the site. Site Architecture 1. OBED intends to leverage the already established branding and similar architecture of the County’s Tourism website, paradisecoast.com. Property data for dynamic listing pages should be featured on the site. 2. Below is some of the information that needs to be included on a new website. The vendor should suggest additional areas for inclusion. The following major sections should be included from the existing websites: • Incentives – to include consolidated listing of the different economic zones available in the County (i.e. Opportunity Zones, Innovation Zones, etc.) • Site Selection Tools – to include Certified Sites, permitting, and development processes) • A collection of relevant data points from the existing site • Partner and organizational information • Economic and demographic data • Workforce development information • Partner and organization information 3. Administration access to content, file uploads and blog posting s must be available to OBED for making changes and updates to the site. 4. The vendor shall be responsible for performing a content audit of existing sites and providing migration services for all data being moved to the new website. Data Collection and Management 1. Collier County and OBED will maintain ownership of data generated by the website. Design 1. The design of the economic development site should integrate and utilize the same type of branding currently on the existing www.paradisecoast.com site. 2. Vendor shall design an element collage, iconography set, and new logo for OBED. 3. Tagging structure, if necessary, to be identified as part of the content audit. Features 1. The vendor shall suggest features necessary for an integrated website. Maintenance/Hosting 1. Include an annual maintenance plan for regular updates and hosting of the website. REQUEST FOR PROPOSAL (RFP) PROCESS 1.1 The Proposers will submit a qualifications proposal which will be scored based on the criteria in Evaluation Criteria for Development of Shortlist, which will be the basis for short-listing firms. The Proposers will need to meet the minimum requirements outlined herein in order for their proposal to be evaluated and 16.F.12.e Packet Pg. 3132 Attachment: 19-7667 Solicitation (10965 : 19-7667 OBED Website Design and Development) 5 scored by the COUNTY. The COUNTY will then score and rank the firms and enter into negotiations with the top ranked firm to establish cost for the services needed. The COUNTY reserves the right to issue an invitation for oral presentations to obtain additional information after scoring and before the final ranking. With successful negotiations, a contract will be developed with the selected firm, based on the negotiated price and scope of services and submitted for approval by the Board of County Commissioners. 1.2 The COUNTY will use a Selection Committee in the Request for Proposal selection process. 1.3 The intent of the scoring of the proposal is for respondents to indicate their interest, relevant experience, financial capability, staffing and organizational structure. 1.4 The intent of the oral presentations, if deemed necessary, is to provide the vendors with a venue where they can conduct discussions with the Selection Committee to clarify questions and concerns before providing a final rank. 1.5 Based upon a review of these proposals, the COUNTY will rank the Proposers based on the discussion and clarifying questions on their approach and related criteria, and then negotiate in good faith an Agreement with the top ranked Proposer. 1.6 If, in the sole judgment of the COUNTY, a contract cannot be successfully negotiated with the top-ranked firm, negotiations with that firm will be formally terminated and negotiations shall begin with the firm ranked second. If a contract cannot be successfully negotiated with the firm ranked second, negotiations with that firm will be formally terminated and negotiations shall begin with the third ranked firm, and so on. The COUNTY reserves the right to negotiate any element of the proposals in the best interest of the COUNTY. RESPONSE FORMAT AND EVALUATION CRITERIA FOR DEVELOPMENT OF SHORTLIST: 1.7 For the development of a shortlist, this evaluation criterion will be utilized by the COUNTY’S Selection Committee to score each proposal. The tie breaking procedure is only applied in the final ranking step of the selection process and is invoked by the Procurement Services Division Director or designee.
