Agenda 11/12/2019 Item #16A25 (Rural Fringe Mixed Use District's)11/12/2019 EXECUTIVE SUMMARY Recommendation to direct Staff to extend the Rural Fringe Mixed Use District’s (RFMUD) “Early Entry” bonus Transfer of Developments Rights (TDR) credit, as provided for in the Future Land Use Element (FLUE) of the Collier County Growth Management Plan (GMP) and in the Land Development Code (LDC). OBJECTIVE: To have the Board provide direction for staff to initiate amendments to the GMP and LDC to extend the RFMUD’s Early Entry bonus TDR credit for an additional four years, until September 27, 2022. CONSIDERATIONS: The Early Entry TDR bonus credit was first introduced into the RFMUD through Ordinance No. 05-25, which provided for its availability for three years from the date of the implementing Land Development Code amendment to September 27, 2008. Subsequently, the expiration date has been included in the GMP and the date in both the GMP and LDC has been extended multiple times. The present expiration date in the GMP is September 27, 2018. At the February 10, 2015 Board meeting, the Board allocated additional funding to the Zoning Division to provide for the initiation of the structural review of four sub-areas of the GMP, primarily east of Collier Boulevard, including the RFMUD. Within that review of the RFMUD, the appropriateness of the Early Entry bonus TDR credit will be evaluated, with specific recommendations anticipated regarding the duration of that TDR bonus. Based upon this recognition, staff is seeking direction from the Board to extend the Early Entry bonus TDR credit for an additional four years, to allow for the public planning process to arrive upon the best recommendation regarding its long-term availability. FISCAL IMPACT: There are no unaccounted for costs associated with extending the Early Entry bonus TDR credit for an additional four years; staff time to prepare the amendments, and costs associated with advertising the ordinances, have been budgeted within the current fiscal year allocation. GROWTH MANAGEMENT IMPACT: There are no direct GMP impacts associated with this Executive Summary. If the requested direction is provided, the Board would ultimately hold hearings to consider adopting GMP and LDC amendments. LEGAL CONSIDERATIONS: The extension of the Early Entry bonus TDR credit will be effective when the Ordinance amendments to the GMP and LDC become effective. This item is approved as to form and legality. It requires a majority vote for approval.
