HEX Final Decision 2019-43 HEX NO. 2019—43 HEARING EXAMINER DECISION PETITION NO. VA-PL20180002576 — Kristine Mary Stewart Rattray and John Peacock, trustees of the Hurlburt Trust request a variance from the 25 foot minimum side yard setback for clustered buildings in SDP 89-142 in the Pelican Bay Planned Unit Development Ordinance Nos. 77-18, as amended, and 04-59, for a Residential Group 3 and 4 designated residential dwelling unit, to reduce the minimum side yard setback on the south side from 25 feet to 24.9 feet for the building and from 25 feet to 19 feet for the screen enclosure. The property is located in Carlton Place, a condominium, also described as 310 Carlton Place, in Section 4, Township 49 South, Range 25 East, Collier County, Florida. DATE OF HEARING: October 24, 2019 STAFF RECOMMENDATION: Approval. FINDINGS: Based on the applicant's written petition, testimony at the hearing of the applicant and the recommendation of staff, the Hearing Examiner finds that each of the criteria set forth in Section 9.04.03 of the Land Development Code has been met and the petition should be approved. ANALYSIS: The residential unit and pool were built and issued certificates of occupancy in 1993. During hurricane Irma in 2017, the pool cage was destroyed. In attempting to replace the pool cage in the same location it was discovered that the pool cage and the adjoining residence were encroaching into the required 25-foot setback, the pool cage by approximately 6 feet and the residence by 0.1 foot. This variance request will allow the pool cage to be rebuilt and clarify the setback adjustment of 0.1 foot to the primary residence. The applicant's representative provided a detailed explanation and no members of the public expressed concern. DECISION: The Hearing Examiner hereby approves Petition No. VA-PL20180002576 filed by James Morey of Bond, Schoeneck & King, PLLC, on behalf of Kristine Mary Stewart Rattray and John Peacock, trustees of the Hurlburt Trust, for a variance from the Pelican Bay Planned Unit Development Ordinance, to reduce the minimum side yard setback on the south side of the parcel from 25 feet to 24.9 feet for the existing residence, and from 25 feet to 19 feet for the screen enclosure, on property located at 310 Carlton Place, Naples, Florida, and further described herein, as shown in the Survey Sketch attached as Exhibit "A", and as subject to the condition(s) set forth below.
