EXECUTIVE SUMMARY
Recommendation to recognize the Memorandum of Agreement with the Collier County
Community and Human Services Division under the Community Development Block Grant for
Naples Manor Stormwater Improvements Phase 1 in the amount of $80,000 and authorize necessary
budget amendment (Project No. 33649).
OBJECTIVE: To receive approval from the Board of County Commissioners to authorize the necessary
Budget amendment for the Community Development Block Grant Memorandum of Agreement from the
Collier County Community and Human Services Division to fund the Naples Manor Stormwater
Improvements Phase 1 Study.
CONSIDERATIONS: The Collier County Community and Human Services provides grants through the
U. S. Department of Housing and Urban Development (HUD) Community Development Block Grant
(CDBG) for projects that address the needs of low and moderate-income persons and families. According
to HUD, 63.90 percent of residents in Naples Manor are in the low to moderate-income bracket. The
stormwater drainage system throughout Naples Manor is over 50 years old and generally consists of
roadside swales and driveway culverts with mostly corrugated metal pipes.
On March 12, 2019, (Item 16.A.17) the Collier County Board of County Commissioners provided after-
the-fact approval for the submittal of a CDBG grant application to Collier County Community and
Human Services for a Preliminary Engineering Study for stormwater improvements in Naples Manor in
the amount of $80,000.
On March 20, 2019, Capital Project Planning, Impact Fees and Program Management received notice of
award from Collier County Community and Human Services (CHS). On July 27, 2019, a Memorandum
of Understanding was signed by CHS and Capital Project Planning, Impact Fees and Program
Management.
FISCAL IMPACT: A budget amendment will be required to appropriate grant funds in the amount of
$80,000 to GMD Grant Fund 711, Project 33649 for the Preliminary Engineering Study for Naples
Manor. Source of funds are federal HUD grant funds passed through CHS.
LEGAL CONSIDERATIONS: The general rule is that a written agreement between County Divisions
is not enforceable and not legally necessary to achieve a mutual objective or project because both
Divisions are part of the same local government.
This item is the limited exception to that rule. 24 CFR 570.503 requires that there be a written agreement
in place with each sub-recipient of CDBG funds. Accordingly, for monitoring purposes, a Memorandum
of Understand has been drafted containing the minimum requirements set forth in 24 CFR 570.503 using
Capital Project Planning, Impact Fees & Program Management Division as the sub-recipient on behalf of
the County.
This item is approved for form and legality and requires a majority vote for Board action. - JAB
RECOMMENDATION: To approve the authorization of the budget amendment necessary for the
Memorandum of Agreement from the Collier County Community and Human Services Division under the
Community Development Block Grant in the amount of $80,000.
