LOCATION SE Q2 I t�0 +,6 13 14 •a e-- t- ` 12 a Petition Number: PL20180003557 Zoning Map PURPOSE/DESCRIPTION OF PROJECT: The purpose of the petition is to request a side yard setback variance from the required 30 feet to 11.86 feet on the westerly side of the property in order to accommodate a garage behind the existing home at 2400 White Blvd. The property is primarily comprised of the Golden Gate Canal, which greatly decreases the buildable width of the lot. The single-family home on the property was built in 1977 and does not conform to current Estates Zoning setback requirements. The requested variance is consistent with the existing 11.86 -foot westerly side yard setback of the single-family residential principal structure which has been in existence since the late 1970s. The proposed garage would be behind the home and maintain the same side lot setback. The proposed garage will provide shelter for a commercial vehicle as well as a non-commercial vehicle. The following is a breakdown of unique existing property and structural features: ➢ Lot width: 193.75 feet ➢ Less Canal: 120.00 feet ➢ Buildable Area: 73.75 feet ➢ Width of Structure: 42.44 feet ➢ Westerly Side Yard Setback: 11.86 feet Staff has researched the Estates Zoning District Development Standards dating back to 1975 as well as conducted research for evidence of issued building permits. The documents associated with Attachment B shed some clarity on the following points: ➢ The Building Permit Application associated with the property (# 76-2503) requests a side yard setback of 10 to 23 feet. ➢ The Inspection Record Card indicates a Certificate of Occupancy date of 2/14/1977; which is consistent with the property details portion of the Collier County's Property Appraiser's Office. ➢ Building Permits 76-2499 through 76-2515 were not available at the time of filming (i.e. saving paper documents onto microfilm). ➢ The Estates Zoning District Development Standards dating back to 1975 for side are consistent with current standards. Based on this information, it is clear that although complete records associated with the issuance of a building permit for the principal structure are not available, a land development hardship was identified that would have limited the use of the property in a comparable manner as other properties in the area with same zoning designation. It is important to note that the applicant has received letters of no objection from the neighbors, has committed to providing a landscape buffer VA-PL20180003557 (2400 White Blvd.) Page 3 of 9 October 24, 2019 on the western side of the proposed garage, and expressed valid safety concerns regarding safe egress and ingress when discussing a reconfiguration. A. through H. (in bold font below). Staff has analyzed this petition relative to these provisions and offers the following responses: a. Are there special conditions and circumstances existing, which are peculiar to the location, size, and characteristics of the land, structure or building involved? Yes, the primary condition is a narrow buildable lot width. The property easterly side yard is mostly comprised of the Golden Gate Canal. The requested variance would be consistent with the setback associated with the existing single-family home and would allow for safe ingress and egress of vehicle (s) sheltered within the garage. b. Are there special conditions and circumstances, which do not result from the action of the applicant such as pre-existing conditions relative to the property, which are the subject of the Variance request? Yes, as previously noted, the narrow -limited buildable lot width makes it so that building the proposed garage to existing code is not feasible without the granting of the requested variance. C. Will a literal interpretation of the provisions of this zoning code work an unnecessary and undue hardship on the applicant or create practical difficulties for the applicant? Yes, denial of the variance request would adversely impact the property owner's ability to benefit from constructing a garage that meets the same setback as the property's primary structure (a Single -Family Residential Home). A literal interpretation is not possible as the majority of the property's easterly's side yard setback is within the Golden Gate Canal. d. Will the Variance, if granted, be the minimum Variance that will make possible the reasonable use of the land, building or structure and which promote standards of health, safety, and welfare? Yes, given the aforementioned encumbrances and as presented in the application, the requested would be the minimum variance for the construction of a safe and functional garage. Will granting the Variance confer on the applicant any special privilege that is denied by these zoning regulations to other lands, buildings, or structures in the same zoning district? Yes, by definition, a variance bestows some dimensional relief from the zoning regulation specific to a site. However, the LDC Section 9.04.02 provides relief through the variance process for any dimensional standard, such as the requested; a reduced side yard setback. As such other properties facing a similar hardship would be entitled to make a similar request and would be offered equal consideration on a case by case basis. f. Will granting the Variance be in harmony with the general intent and purpose of this Land Development Code, and not be injurious to the neighborhood, or otherwise detrimental to the public welfare? Yes, as referenced LDC Section 4.02.03(c) the requested variance would be in harmony with the intent of the LDC. In an effort to minimize the potentiality of creating a detrimental impact on the property to the west, the applicant is willing to provide landscaping (Areca Palms), on the western side of the proposed garage. g. Are there natural conditions or physically induced conditions that ameliorate the goals and objectives of the regulation such as natural preserves, lakes, golf courses, etc.? No, the granting of the requested variance will not improve on the existing non -conforming 11.86 -foot side yard setback. Should the requested variance be granted, the applicant has offered to mitigate adverse impacts to the adjacent property by providing Areca Palms on the westerly side of the structure. The Areca Palms would be placed at 6 -feet from center along the westerly side. The proposed lands scape buffer would improve the visual impact of a garage. h. Will granting the Variance be consistent with the Growth Management Plan (GMP)? Yes, approval of this variance is consistent with the GMP. ENVIRONMENTAL ADVISORY COUNCIL (EAQ RECOMMENDATION: This project does not require Environmental Advisory Council (EAC) review, as this project did not meet the EAC scope of land development project reviews as identified in Section 2-1193 of the Collier County Codes of Laws and Ordinances. It has also been established that the subject property is within Carlton Place, a multi -family residential project. The current owner purchased the subject property around May 4, 2011. Three Building Permits have been identified relating to the subject property: No.: 930002909 issued on 03/15/1993 for a single-family attached residence; No.: 930004871 issued on 04/26/1993 for a swimming pool; and No.: 930005142 issued on 04/29/1993 for a pool screen enclosure. Upon satisfying permit requirements, each permit received a Certificate of Occupancy on 06/07/1993. The pool screen enclosure was subsequently destroyed during Hurricane Irma and removed. Upon attempting to replace the pool screen enclosure in its prior location it was discovered that said enclosure encroached into the required 25 -foot minimum setback. As the destroyed structure was removed prior to permitting any non -conforming protections afforded by the LDC were lost. The survey that was obtained to establish the location of the pool screen enclosure further served to reveal that the residence itself was only setback 24.9 feet from the south side property line resulting in a 0.1 - foot encroachment into the required 25 -foot minimum setback. SURROUNDING LAND USE AND ZONING: North: Carlton Place, a single-family condominium project, within Groups 3 and 4 of the Pelican Bay PUD East: Club of Pelican Bay Golf Course within the Pelican Bay PUD South: Club of Pelican Bay Golf Course within the Pelican Bay PUD West: Pelican Bay Boulevard (Right -of -Way) followed by the Claridge, a +/- 21 -story multi -family condominium within Group 2 of the Pelican Bay PUD VA-PL20180002576; 310 Carlton PI Page 3 of 8 October 4, 2019 Collier County GIS GROWTH MANAGEMENT PLAN (GMP) CONSISTENCY: The subject property is located within the Urban Residential Subdistrict of the County's Future Land Use Map (FLUM) of the Future Land Use Element (FLUE) of the GMP. The GMP does not address individual Variance requests but deals with the larger issue of the actual use. As previously noted, the petitioner seeks a variance requesting a reduction of the side yard setback to allow for the continued existence of a single-family dwelling unit and to allow for the replacement of a pool screen enclosure that was destroyed by Hurricane Irma. The subject uses are consistent with the FLUM of the GMP. The requested variance does not have any impact on this property's consistency with the County's GMP. ZONING DIVISION ANALYSIS: Zoning staff has researched the Pelican Bay PUD, Ordinance 77-18, as amended, and found that Carlton Place was developed as a clustered development in accordance with Section 2.05 of the PUD, as established by the approval of a Site Development Plan (SDP -89-142, as amended). Both Group 3 and Group 4 Minimum Yard Requirements, PUD Sections 6.04.03 and 7.04.03, allow for yard requirements other than those noted in conjunction with a SDP. The approved SDP reveals applicable setbacks to be 25 -feet from tract boundary lines and 15 -feet between detached structures. Staff further notes that the subject SDP reveals a "20 -foot Private Access Easement" along the south side and across to the north leading to a lake. Staff has researched this easement and finds that it was not recorded; what was recorded is an easement for similar purpose between VA-PL20180002576; 310 Carlton PI Page 4 of 8 October 4, 2019 Villas 20 and 21 (OR 2603, PG 2840-2843) that is not shown on said SDP; it is staff's opinion this easement was re -located as it does not show on any surveys attributable to the subject property, Villa 30. With respect to the 0.1 -foot encroachment of the principal structure; staff finds that per LDC Section 9.04.04.B.1. the residence would be deemed compliant absent the pool screen enclosure issue, the applicant seeks a variance solely for the purposes of a clear title. With respect to the pool screen enclosure, no setbacks are noted on the permit itself and the accompanying site plan is apparently not to scale, the referenced 13 -foot measure from the south property line appears to be inaccurate (see attachments); it is Staff's opinion that said permit was issued in error. The petitioner desires to reduce the south side setback from 25 feet to 19 feet to allow the structure to be built in its prior location and to allow for some leeway during construction. The decision to grant a variance is based on the criteria in LDC Section 9.04.03. Staff has analyzed this petition relative to these provisions and offers the following responses: a. Are there special conditions and circumstances existing, which are peculiar to the location, size and characteristics of the land, structure or building involved? Yes. Minimum yard requirements within the Pelican Bay PUD are atypical as they do not facilitate traditional front, side, and rear yards; rather, setbacks are from tract boundary lines, right-of-way lines, and the edge of gutter of private roads. In this case the side yard is created by the tract boundary line and is adjacent to a golf course. b. Are there special conditions and circumstances, which do not result from the action of the applicant such as pre-existing conditions relative to the property, which are the subject of the Variance request? Yes. The single-family attached dwelling unit and the pre-existing pool screen enclosure were permitted by persons other than the existing owner and Certificated of Occupancy were granted by the County. The applicant desires to replace the screen pool enclosure in the same location as that which was destroyed. C. Will a literal interpretation of the provisions of this zoning code work unnecessary and undue hardship on the applicant or create practical difficulties for the applicant? Yes. There is no other viable option to allow for the continued existence of the single-family detached dwelling unit. Additionally, application of the required setback would deprive the applicant of a pool enclosure as said setback reaches to the center of the previously permitted and constructed swimming pool. d. Will the Variance, if granted, be the minimum Variance that will make possible the reasonable use of the land, building or structure and which promote standards of health, safety and welfare? Yes. The requested variance from 25 feet to 24.9 feet for the existing residential structure is the minimum variance needed to continue use of the residence. It is notable that the roof VA-PL20180002576; 310 Carlton PI Page 5 of 8 October 4, 2019 overhang is not greater than 2.9 feet and thus the total overhang of the roof will be within the permitted 3 -foot allowance. The requested 25 feet to no less than 19 -feet for the pool screen enclosure is the minimum needed to replace the screen enclosure in the same location in which it previously stood and to make the enclosure and pool area useable in their current state. e. Will granting the Variance confer on the applicant any special privilege that is denied by these zoning regulations to other lands, buildings, or structures in the same zoning district? By definition, a Variance bestows some dimensional relief from the zoning regulations specific to a site. LDC Section 9.04.02 allows relief through the Variance process for any dimensional development standard. Other properties facing a similar hardship would be entitled to make a similar request and would be conferred equal consideration on a case by case basis. E Will granting the Variance be in harmony with the general intent and purpose of this Land Development Code, and not be injurious to the neighborhood, or otherwise detrimental to the public welfare? Yes. The subject property is located in a residential neighborhood and the encroachment is not interfering with the adjacent property owners use of their properties. The variances, if granted, will not negatively impact the neighborhood or its residential use. The homeowner's association board has approved the replacement of the pool screen enclosure. The encroachments for which variances are being sought existed on the property, through no fault of the current owner, without any issue. g. Are there natural conditions or physically induced conditions that ameliorate the goals and objectives of the regulation such as natural preserves, lakes, golf courses, etc.? Yes. The adjoining property is a golf course. h. Will granting the Variance be consistent with the Growth Management Plan? Yes. Approval of this Variance will not affect or change the requirements of the GMP with respect to density, intensity, compatibility, access/connectivity, or any other applicable provisions. ENVIRONMENTAL ADVISORY COUNCIL [EAC] RECOMMENDATION: The EAC does not normally hear variance petitions. Since the subject variance doesn't impact any preserve area, the EAC did not hear this petition. A. The Owner purchased the subject property around May 4, 2011. A copy of the Owner's deed is attached hereto. The residence, pool and pool cage located on the property was built in 1993 according to permit 93-5142. Additional building permits relating to the residence, pool and lanai screen cage for the original construction are as follows: 932909 and 93-4871_ The lanai enclosure was destroyed during Hurricane Irma and was removed. While looking to replace the enclosure, it was discovered that the original enclosure was setback approximately 20 feet, not the required 25 feet set forth in SDP 89-142. The Owner is requesting a variance from 25 feet to no less than 19 feet to replace the lanai pool enclosure and to locate it in the same location, at the edge of the lanai pavers, where it stood prior to Hurricane Irma. The Owner is requesting a no less than 19 foot setback because while it is believed the actual pool cage will be set back 20 or 20.5 feet from the side yard, the structure is not actually installed yet and leeway of 1 foot is requested. The Pelican Bay Association has approved the pool cage to be installed in the original location. A copy of its letter of approval is attached hereto and referred to below as well. R Additionally, it was discovered that the residential structure on the southern side is setback at 24.9 feet, instead of 25 feet, A variance is also requested to allow for the slight discrepancy in the side yard setback for the residence. #ill/tel aj The lot is adjacent to a preserve and golf course area. The shorter set back will not affect a neighboring residence. 67C932,2 b) The structure, lanai enclosure, and the wall were all existing structures at the time the homeowner purchased the property. The lanai enclosure would be rebuilt in the same location as the previous enclosure. c) If the variance were denied, the homeowner would have to demolish the existing lanai and remove the existing pool, as the setback reaches to the middle of the pool, in order to comply with the current zoning code. Likewise, the existing residential structure variance of 9.1 feet does not negatively impact the neighborhood and the owner would experience significant hardship if the variance is not granted. d) The requested variance from 25 feet to no less than 19 feet for the lanai enclosure is the minimum needed to replace the enclosure in the same location in which it previously stood and to make the enclosure and pool area usable in their current state. The requested variance from 25 feet to 24.9 feet for the existing residential structure is the minimum variance needed to continue use of the residential structure. It is notable that the roof overhang is not more than 2.9 feet and thus the total overhang of the roof will be within the allowed 3 feet into the side yard. e) The requested variances do not confer on the owner any special privilege. f) The subject property is located in a residential neighborhood and the encroachment is not interfering with the adjacent property owner's use of their properties. The variances, if granted, will not negatively impact the neighborhood or its residential use. The homeowner's association board has already approved the replacement of the lanai enclosure. A copy of such approval is attached hereto. The requested variances previously existed on the property, through no fault of the current owner, without any issue. g) The subject property does back up to the Pelican Bay Golf Course.
