HEX Transcripts 10/10/2019October 10, 2019 HEX Meeting TRANSCRIPT OF THE MEETING OF THE COLLIER COUNTY HEARING EXAMINER Naples, Florida October 10, 2019 LET IT BE REMEMBERED, that the Collier County Hearing Examiner, in and for the County of Collier, having conducted business herein, met on this date at 9:00 a.m., in REGULAR SESSION at 2800 North Horseshoe Drive, Room 609/610, Naples, Florida, with the following people present: HEARING EXAMINER MARK STRAIN ALSO PRESENT: Raymond V. Bellows, Zoning Manager Tim Finn, Principal Planner Sally Ashkar, Assistant County Attorney Page 1 of 3 October 10, 2019 HEX Meeting PROCEEDINGS HEARING EXAMINER STRAIN: Good morning, everyone. Welcome to the October 10th meeting of the Collier County Hearing Examiner's Office. If everybody will please rise for Pledge of Allegiance. (The Pledge of Allegiance was recited in unison.) HEARING EXAMINER STRAIN: And there is no members of the public here other than the applicant, their team, and staff members, so I'm not going to go through any housekeeping items today. We'll move right into the only petition on today's public hearing. It's Petition No. PDI-PL20190001616, Livingston Professional Center, LLC. Anyone wishing to testify on this item, please rise to be sworn in by the court reporter. (The speakers were duly sworn and indicated in the affirmative.) HEARING EXAMINER STRAIN: Disclosures on my part: I've had several conversations with the applicant's representatives, and I've read the files, and that's about it. And since I have read the files and there is no members of the public here, Bob, unless you have additional items you want to put on record, we'll just go to a couple comments I've got to make. MR. MULHERE: That's fine; yep. HEARING EXAMINER STRAIN: Okay. And the only thing I wanted to note is you have worked with the neighborhood in the area. You've got a letter of no objection, it's a reduction in a setback by a couple of feet, and it's a result of a surveying error. You've already progressed with the projects -- project area to the north of this particular location, and this was discovered as you were moving south towards this southern property line. Is that an accurate portrayal of what's going on? MR. MULHERE: Unfortunately, yes, that's a correct description. HEARING EXAMINER STRAIN: Okay. It's pretty straightforward. I have no questions. If you have anything you want to add to the record, you're more than welcome to. MR. MULHERE: No. HEARING EXAMINER STRAIN: Okay. Is there anybody here wishing to comment on this item? (No response.) HEARING EXAMINER STRAIN: Is there a staff report? MR. FINN: For the record, I'm Tim Finn, principal planner. The project is compliant with the GMP and LDC; therefore, staff recommends approval. HEARING EXAMINER STRAIN: Thank you, Tim. And I have no questions of staff. With that, we will close the public hearing. A decision will be rendered within 30 days; most likely next week. And I appreciate all your time. Thank you for coming today. And that takes us to the -- MR. MULHERE: Thank you. HEARING EXAMINER STRAIN: -- other business. There is none. Any public comments?
