EXECUTIVE SUMMARY
Recommendation to approve the proposed Collier County State and Federal Legislative
and Administrative Priorities for 2020 and adopt the attached resolutions.

OBJECTIVE: To formalize and endorse Collier County’s State and Federal Legislative and
Administrative Priorities for 2020 and adopt an additional support resolution.
CONSIDERATION: Each year, prior to the convening of the State Legislature in Regular Session, staff
prepares a proposed list of State and Federal Legislative and Administrative Priorities for the upcoming
year for consideration and subsequent endorsement by the Board of County Commissioners (Board).
Each member of the Board has previously been provided the attached 2020 Priorities document for
review. One support resolution on a joint project with the City of Naples is also attached for approval.
The Collier County Legislative Delegation is scheduled to conduct its public hearing for local bills and
local budget requests on Wednesday, October 30, 2019, at 9 a.m., at the North Collier Regional Park
located at 15000 Livingston Road, Naples, FL 34109. Applicable issues from the 2020 Priorities
document will be presented at that meeting.
This year, the State Legislature convenes on January 14, 2020, and concludes its Regular Session on
March 13.
FISCAL IMPACT: This executive summary has no immediate fiscal impact.
GROWTH MANAGEMENT IMPACT: This executive summary has no immediate growth
management impact.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal
issues, and requires majority vote for Board action. -JAK
RECOMMENDATION: That the Board of County Commissioners approves the proposed Collier
County State and Federal Legislative and Administrative Priorities for 2020 and adopt the attached
resolution.

INTRODUCTION
This document was produced based on prior Board direction, legislative and project needs
identified by County staff in support of Board -approved programs and projects, ongoing or
unresolved legislative and administrative issues from 2019, and legislative p riorities shared with
the Florida Association of Counties (FAC) and the National Association of Counties (NACo).
Our state and federal contract lobbyists provide valuable input throughout this process and
work very hard to continually identify and monitor legislative trends, issues, administrative
activity, and funding opportunities throughout the year.
Once reviewed and approved by the Board of County Commissioners,
the County’s legislative and administrative priorities guide all advocacy efforts in Tallahassee,
FL, and Washington, DC, for the upcoming year.

PRIORITIES: LEGISLATIVE & ADMINISTRATIVE
ADA Website Compliance Safe Harbor
Summary: Local governments across the country have seen a wave of lawsuits filed by
plaintiffs’ attorneys regarding website compliance with the Americans with Disabilities Act
(ADA). Due to the amount of information required to be posted to local governmental websites
to comply with various state and local transparency provisions, it is doubtful that any local
governmental website is fully compliant with the ADA.
Action: BILL/AMENDMENT (FEDERAL) – In 2018, the House of Representatives passed the ADA
Education and Reform Act of 2017 that forced prospective plaintiffs to provide to public
accommodations that operate public websites written notice of noncompliance prior to filing
suit. The company would have then had a 60-day safe harbor to come up with a plan to address
the plaintiff’s concerns. The bill passed the House on a split vote but died in the Senate. NACo
and the Florida League of Cities have previously coalesced around the issue regarding local
governmental website compliance with the ADA. New, similar legislation to the Reform Act of
2017 is needed to provide compliance guidelines to local governments and an adequate safe
harbor or cure period from legal action while working to comply with the ADA website
provisions.

America’s Transportation Infrastructure Act of 2019
Summary: In late July, the Senate Environmental and Public Works Committee released its five-
year, $287 billion surface transportation bill. The House is not expected to start working their
version before the end of the year. Any transportation infrastructure package needs to include
two key components: Highway Trust Fund solvency and permit process streamlining.
Construction costs, increased fuel efficiency, and electric vehicles have combined to ensure that
more money is leaving the Highway Trust Fund than entering. Solvency of the trust fund needs
addressed to provide sustainable infrastructure project funding. In 2018, a dozen federal
agencies signed the One Federal Decision Memorandum of Understanding (MOU), establishing a
coordinated process for environmental reviews of major infrastructure projects with a goal of
review completion within two years. This transparent, coordinated, and streamlined process
will reduce cost and delay of future projects of importance to Collier County.
Action: BILL/ADVOCACY (FEDERAL) – Lobby the Southwest Florida congressional delegation to
include measures to ensure Highway Trust Fund solvency and incorporation of the One Federal
Decision MOU in any agreed-to surface infrastructure package.

County Funding Streams
Summary: Full funding of grants and continued appropriations for programs or funds applicable
to Collier County, including by not limited to, Payment in Lieu of Taxes (PILT), Community
Development Block Grant (CDBG), Home Investment Partnerships Program (HOME), Institute
of Museum and Library Services (IMLS), Airport Improvement Program (AIP), Emergency
Management Performance Grants (EMPG), Stafford Act, Fire Management Assistance Grant
Program (FMAGP), Rainy Day Fund, Local Housing Trust Fund, Sadowski Act, State
Housing Initiatives Partnership (SHIP), the Land Acquisition Trust Fund (LATF), and the Rural
Development Grant Program.
Action: (STATE/FEDERAL) - Advocate for full funding of grants and continued appropriations for
programs or funds applicable to Collier County and oppose state or federal actions that would
utilize moneys for other purposes than originally intended. Monitor the newly-funded DEP
grant program for septic-to-sewer conversion and wastewater treatment as the program is
designed and launched.

Emergency Shelter Registration Lists – Public Records Exemption
Summary: Counties are taking more responsibility for operating emergency shelters from the
Red Cross. Where registration information, as gathered by the Red Cross, remains confidential,
county registration and other disaster-related forms and software that may contain personal
information may be subject to Florida public records laws. Hesitance to have their personal
information made public might dissuade some from seeking shelter in an emergency and
needlessly put first responders and others in jeopardy. The information gleaned from a
sweeping records request could place residents in a vulnerable state by providing unscrupulous
individuals and businesses with addresses of evacuated properties and damage assessment
information.
Action: BILL/AMENDMENT (STATE) – In 2018, language was submitted by Collier County to FAC
which was subsequently adopted into their 2019 FAC Legislative Action Plan to protect/exempt
county-operated emergency shelter registration lists, damage assessments, and WebEOC
database information from Florida public records laws. A meeting was held in June at our EOC
with Jared Moskowitz, Director of FDEM, where he expressed his intent to address information
security in their legislative package for the 2020 Regular Session. Our primary goal will be to
seek inclusion in that departmental package. Otherwise, our efforts will be to secure sponsors
and advance a stand-alone bill.

FEMA Remapping
Summary: To expedite FEMA approval for Collier County flood remapping which is five years
behind schedule. Two-thirds of Collier’s population is represented by outdated maps. Of the

two Physical Map Revisions (PMR) pending completion for this update, PRM1 will be completed
by late 2020.
Action: ADMINISTRATIVE (FEDERAL) – Engage agency officials and congressional delegation to
prompt FEMA approval for Collier flood remapping completion. Support increases in funding for
the Flood Hazard Mapping and Risk Analysis Program which was funded at $188 million in FY19.
This was a significant decrease from the $262 million provided in FY18, effectively returning
funding to FY17 levels.

Immokalee Readiness Center
Summary: In 2007, the Florida Army National Guard proposed the construction of a military
Readiness Center on 26 acres of land at the Immokalee Regional Airport (IMM). In 2009, the
BCC approved a 25-year lease agreement with the National Guard. However, due to the
economic downturn and change of presidential administrations, the lease was voided as
construction did not commence in accordance with the performance milestones outlined in the
lease. In 2018, after discussions with Airport Authority staff, the National Guard included the
Readiness Center in its Long Range Construction Plan, subject to congressional appropriation. It
is currently in the top six projects for the Guard with the potential to be accelerated given the
Guard’s updated plan to station a special supports battalion at IMM.
Action: ADMINISTRATIVE (FEDERAL) – Work with both the Army National Guard and the
congressional delegation to accelerate the Readiness Center on the Long Range Construction
Plan and ensure adequate appropriation for its construction at the earliest opportunity.

Long-Term, Transparent National Flood Insurance Program (NFIP) Reauthorization
Summary: To seek the long-term reauthorization of the NFIP to provide housing market
stability while ensuring transparency and fairness in rate setting.
Action: BILL/ADVOCACY (FEDERAL) – Support legislation that provides for a minimum five-year
reauthorization, freezes interest payments on NFIP debt, provides low interest loans for
homeowner mitigation projects, and provides additional funding for current mitigation
assistance grant programs.

Offshore Drilling
Summary: Unless Congress acts, in 2022, the moratorium on offshore oil and gas drilling within
125 miles of Florida’s Gulf Coast is set to expire. This has the potential to negatively impact
Florida’s coastal environment, tourism, and military operations in the 100,000 square mile Gulf
of Mexico Range Complex. The U.S. Department of the Interior has temporarily postponed its
plans to push for expanded drilling along coastal waters. During the 2019 session, the Florida

Legislature passed resolutions calling for an indefinite extension to the moratorium.
Action: BILL/ADVOCACY (FEDERAL) – Support HR 205 – Protecting and Securing Florida’s
Coastline Act of 2019, sponsored by Rep. Francis Rooney and co-sponsored by Rep. Diaz-Balart
and 17 other bipartisan members of Congress to permanently extend the moratorium.

RESTORE Act Debt Financing
Summary: To pass legislation authorizing the Secretary of the Treasury to use debt instruments,
as part of the RESTORE Act, to be financed by $20 billion in BP Oil civil penalties, providing more
immediate access to moneys for restoration and program/project improvements that would
otherwise take years to accumulate. Collier County is one of 15 “non-disproportionately”
affected counties eligible for project grants under RESTORE.
Action: AMENDMENT/ADVOCACY (FEDERAL) – Continue to advocate for debt financing
legislation during the 116th Congress that mirrors HR 2923, co-sponsored during the 115th
Congress by Rep. Diaz-Balart.

Southwest Florida Promise Zone / Opportunity Zones
Summary: To actively support the mission of the Southwest Florida Promise Zone (SFPZ) in
improving economic opportunity through education, crime prevention, infrastructure
improvement, and economic development; to monitor and support Opportunity Zones/Funds
applicable to Collier County as additional federal guidelines are produced and released by the
U.S. Treasury Department and the Internal Revenue Service.
Action: ADMINISTRATIVE (FEDERAL) - Mobilize elected officials to support specific initiatives
from the SFPZ, including congressional passage of federal tax incentives for employers,
prompting participation of the U.S. Dept. of Transportation in Promise Zone grant preference
benefit, and to address any concerns with applicable agencies that may arise from future
Opportunity Zones/Funds guidelines.

State Veterans’ Nursing Home
Summary: Though Collier County was ranked at the top of a needs-based study for the
construction of a new State Veterans’ Nursing Home, at the conclusion of the 2014 site
evaluation process, St. Lucie County was ultimately awarded the new facility. Since that time,
the Florida Department of Veterans’ Affairs (FDVA) has commented to the Legislature that the
State is at least five years from accumulation of funds necessary for the 35% mandated state
construction match to qualify for federal priority consideration for the next awarding of a new
State Veterans’ Nursing Home. During the 2018 legislative session, Commissioners and staff
met with FDVA to inquire as to a county’s ability to provide the State’s match for federal

construction funds. This was confirmed by the former Executive Director of FDVA, Glenn
Sutphin, and the U.S. Department of Veterans’ Affairs which only requires a completed
certification affirming that the state has the construction match, even if that match is provided
by a county. Another meeting was held during the 2019 legislative session after the passage of
the temporary one-cent sales tax to talk about potential site locations.
Action: ADMINISTRATIVE (STATE/FEDERAL) - Using a portion of the temporary one-cent sales
tax revenues as a funding stream for the local construction match, and with the recent
acquisition of the Golden Gate Golf Course property serving as a potential location, staff will
continue to work with the Florida Department of Veterans’ Affairs and the U.S. Department of
Veterans Affairs on next steps for securing a State Veterans’ Nursing Home for Collier County.

Strategic Intermodal System Long Range Cost Feasible Plan
Summary: Currently, the 2018 Edition of the Florida Department of Transportation (FDOT)
Strategic Intermodal System Long Range Cost Feasible Plan for FY 2029-2045 does not provide
for any construction of capacity improvements for I-75 or SR 29 in Collier County. The Systems
Implementation Office updates the SIS CFP every 3 to 5 years to adjust the planning horizon
consistent with the long-range planning needs of FDOT and MPOs throughout the state.
Action: ADMINISTRATIVE (STATE) – Work with FDOT District 1 representatives, applicable
adjacent counties and coalitions, and local legislative delegation members to encourage an
FDOT update to the Long Range Cost Feasible Plan that incorporates capacity improvements for
I-75 and SR 29 in Collier County

STATE APPROPRIATIONS PROJECT REQUESTS
Cocohatchee River Critical Dredge Project
Summary: The Cocohatchee River has accumulated considerable amounts of sediment,
particularly east and west of the US 41 Cocohatchee River bridge. This greatly impedes
stormwater conveyance within the county as well as flows from Bonita Springs and Estero in Lee
County. These areas were significantly impacted by flooding in 2017, pre and post Hurricane
Irma. This project will provide for removal and disposal of the silt and restore the original river
bottom to support the restoration of the Stormwater System which will help prevent potential
flooding and property damage.
Action: (STATE) - Request $600,000 in State appropriations for the Cocohatchee River Critical
Dredge Project. (There is a local match of $600,000 available for this project.)

Freedom Park to Gordon River Greenway Park Pedestrian Crossing
Summary: Gordon River Greenway Park and Freedom Park, located in the heart of Naples,
encompasses 190 acres of combined recreational space. The two parks are bisected by Golden
Gate Parkway, a busy six-lane road. Ultimately, this project will connect the two public parks by
providing safe bicycling and pedestrian infrastructure over the arterial roadway.
Action: (STATE) - Request $500,000 in State appropriations for the survey and design of the
Freedom Park to Gordon River Greenway Park Pedestrian Crossing.

Golden Gate City Water Resource Protection/Restoration Master Plan
Summary: This is the first critical step of a large-scale infrastructure project including the
conversion of septic to sewer, well to municipal water, rehabilitation of the stormwater system
to improve flood protection and water quality, and installation of sidewalks to enhance mobility.
Action: (STATE) - Request $500,000 in State appropriations for the Golden Gate City Water
Resource Protection/Restoration Master Plan. (There is a local match of $500,000 available for
this project.)

Golden Gate City Outfall Restoration Project – Phase I
Summary: The Golden Gate City Stormwater System is composed of 103 miles of swale,
collecting runoff that feeds into 780 drainage structures, with 135 outfalls draining into a ten-
mile network of canals. Silt has accumulated in the canal network to the point that it greatly
restricts or completely clogs the discharging of stormwater via the outfall pipes. This project will

perform a hydrographic survey to determine the depth of silt that has accumulated and
determine the cost to restore the canals to their original bottom elevation. This is a critical first
step of a large-scale infrastructure project including the rehabilitation of aging stormwater,
water and sewer assets, as well as transportation and mobility enhancements.
Action: (STATE) - Request $200,000 in State appropriations for the Golden Gate City Outfall
Restoration Project – Phase I. (There is also a local match of $200,000 available for this project.)

Goodland Drive Rehabilitation Project
Summary: This project will reconstruct and elevate nearly a mile of the existing rural roadway.
This two-lane road is the sole ingress and egress between the island of Goodland and the
mainland. It will also alleviate flooding during extreme tides and storm events and restore
historical tidal exchanges between the east and west mangrove stands by adding cross drainage
at suitable locations along the corridor.
Action: (STATE) - Request $1 million in State appropriations for the Goodland Drive
Rehabilitation Project. (There is a local match of $1 million available for this project. $500,000
was received in FY 2017-18 from the State for the design of the Goodland Drive project.)

South Florida Regional Emergency Shelter & Continuing Operations Center
Summary: Collier County is centrally located two hours south of Tampa and west of Palm
Beach, Broward, and Miami-Dade counties, making it a suitable location for regional evacuation
from the southeastern coast and the Gulf’s central/southern coastal counties. Currently, the
County is developing 180 acres of property where north/south I-75 bends into east-west
Alligator Alley. As part of that development, a multi-use field house will be designed to exceed
existing codes and include additional hardening and resiliency features to satisfy all safety
standards for continuity of operations during an emergency or storm event. Additional funds
are necessary to complement existing local revenues to construct and augment the field house
structure to enhanced storm safety standards, provide emergency power, support facilities, and
extended stay capabilities.
Action: (STATE) - Request $8 million in State appropriations for the South Florida Regional
Emergency Shelter & Continuing Operations C

RESOLUTIONS OF SUPPORT
Design of Phase II – Naples Bay Red Tide Septic Tank Mitigation Program
Summary: The Naples Bay Red Tide Septic Tank Mitigation Program is a partnership between
the City of Naples and Collier County to convert 930 failing septic tanks within the US
41/Goodlette Road corridor to a centralized sanitary sewer system while enhancing the
stormwater system to improve water quality to reduce nutrient loading in the impaired waters
of Naples Bay. The estimated design cost is $2.2 million. The City is requesting $1.1 million in
State funds.
Action: ADOPT A RESOLUTION IN SUPPORT of a City of Naples State appropriations request of
$1.1 million for Design of Phase II – Naples Bay Red Tide Septic Tank Mitigation Program.
ISSUES TO MONITOR
Autonomous Vehicles
Any proposed legislation that would impact local regulation of safety standards for autonomous
vehicles and related technology. (STATE/FEDERAL)

Clerk of the Circuit Court Funding
Any proposed legislation that will provide a sustainable, full funding solution for the Clerk of
the Circuit Courts and provide for execution of their extensive statutory and constitutional
duties. (STATE)

RESOLUTION NO. 2019 - ______
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, SUPPORTING THE CITY OF NAPLES
STATE APPROPRIATION REQUEST FOR THE DESIGN OF PHASE II -
NAPLES BAY RED TIDE SEPTIC TANK MITIGATION PROGRAM.
WHEREAS, the City of Naples (City) and Collier County (County) have partnered to
convert septic tanks to a centralized sanitary sewer system to improve water quality by reducing
nutrient loading in the sensitive, impaired waters of the Gordon River Extension that flows into
Naples Bay and enters the Gulf of Mexico; and
WHEREAS, although Karenia brevis (red tide) blooms naturally offshore, once close to
the coastline, many scientists believe that the red tide blooms may use both human -contributed
and natural nutrients as fuel; and
WHEREAS, the project would remove nutrients and other pollutants generated from 930
aging septic tanks in a low to moderate income neighborhood which historically floods; and
WHEREAS, to minimize disruption to the area, as the construction of the sanitary sewer
collection system is occurring, the County will make stormwater management improvements on
multiple streets between Goodlette Frank Road and U.S. 41; and
WHEREAS, the joint project is in unincorporated Collier County but within the water and
sewer service area of the City of Naples; and
WHEREAS, the City has established a Special Assessment District to assess the property
owners for the septic tank abandonment and service to central sewer; and
WHEREAS, the City is requesting a legislative appropriation to subsidize the cost of the
design of a central sanitary sewer system.
NOW, THEREFORE, BE IT RESOLVED BY BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, to support an application by the City of Naples for up to
$1,100,000 in State appropriations for the Design of Phase II – Naples Bay Red Tide Septic Tank
Mitigation Program.
THIS RESOLUTION ADOPTED after motion, second and majority vote on this the 8th
day of October, 2019.
