EXECUTIVE SUMMARY
Recommendation to authorize the County Manager’s designee from Fleet Management Division to
transfer duplicate titles to the purchaser of County vehicles previously sold at auction on April 29,
2017, and to approve a Hold Harmless and Indemnity Agreement whereby the purchaser agrees to
hold harmless and indemnify the County for any potential claims relating to those purchased
vehicles since the date of sale.
OBJECTIVE: To transfer duplicate titles to the purchaser of vehicles previously sold at a County
auction, and to approve the execution of a Hold Harmless and Indemnity Agreement that insures the
County against any claims pertaining to the purchase of the vehicles since the date of sale.
CONSIDERATIONS: An agent on behalf of McGregor Motor Sports, Inc. (“McGregor”) contacted the
Fleet Management Division on February 13, 2019, requesting assistance in acquiring titles for nine (9)
County vehicles McGregor purchased from the County at auction on April 29, 2017, as follows:

McGregor’s agent informed staff that the original title transfers were lost on the above vehicles, and the
vehicles could not be utilized or sold until it acquired new titles. Staff verified that the County sold the
above vehicles at auction to McGregor and the Collier County Tax Collector Motor Vehicles Office
confirmed that the nine vehicles were still titled to the Collier County Board of County Commissioners.
McGregor agreed to provide payment for the issuance of the duplicate titles and provided a check issued
by its agent Elsie Title Services of Southwest Florida, LLC covering the cost to obtain duplicate titles.
The receipt and payment of that check has since been processed. Fleet Management payed for the
duplicate titles via P-card, which is standard procedure for all title requests.
Because the sale of the vehicles occurred so long ago, and have remained titled under the County (both as
the vehicles were originally titled at the time of auction and by virtue of the issuance of the Duplicate
titles), the County Attorney’s Office also recommended: (1) that McGregor execute the attached Hold
Harmless and Indemnity Agreement (see signed copy attached), (2) that staff from the Fleet Management
Division confirm the existing mileage on the vehicles located on McGregor’s Fort Myers property, and
(3) subject to confirmation of the presence of the vehicles and mileage, that staff complete the execution
of the Duplicate Titles transferring legal title from the County to McGregor, with the County Manager’s
designation of an agent from Fleet Management Division to complete that ministerial task. There are
currently no moneys owed to the County with respect to the sale of these vehicles at auction and this
request is merely sought so that McGregor can obtain the benefit of its purchase of the vehicles.

GROWTH MANAGEMENT IMPACT: No Growth Management Impact is associated with this
action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority
vote for Board approval. -SRT
RECOMMENDATION: To authorize the County Manager’s designee from Fleet Management
Division to transfer duplicate titles to the purchaser of County vehicles previously sold at auction on April
29, 2017, after confirming the presence and mileage of the vehicles on the purchaser’s property, and to
approve and authorize the Chairman to sign the attached Hold Harmless and Indemnity Agreement.
