EXECUTIVE SUMMARY
Recommendation to approve three (3) mortgage satisfactions for the State Housing Initiatives
Partnership loan program in the combined amount of $10,500 and approve an associated Budget
Amendment for $3,000.
OBJECTIVE: To support the affordability of housing in Collier County through the State Housing
Initiatives Partnership (SHIP) down payment, and emergency repair, and/or rehabilitation assistance
programs.
CONSIDERATIONS: SHIP, a state affordable housing program, aids first time homebuyers for use
toward a portion of the required down payment and emergency repairs to the newly acquired home. As a
condition of award, the homeowner must repay the assistance provided upon sale, refinance, or loss of
homestead exemption.
Community and Human Services (CHS) staff has recently completed a comprehensive review of County-
issued SHIP loans. Through this process, staff has identified two (2) of the mortgages where the
homeowners, Lilia and Rene Lozano, a husband and wife, and Miguel Nino and Maria Guadalupe Nino,
are entitled to have their original down payment assistance forgiven. Section 95.281(1)(b) 2019 F.S.
allows this debt to be forgiven if the mortgage is more than twenty (20) years old and the final maturity of
an obligation secured by the mortgage is not ascertainable or previously set forth in the mortgage. Under
such circumstances, the mortgage is considered terminated and for record purposes, the down payment
amount may be forgiven.
Therefore, due to the length of time of the mortgage, the two (2) homeowners, Lozano and Nino, have
met the obligation and the loan should be forgiven. SHIP Ordinance No. 93-19 did not establish a
maturity date for these loans.
Also, CHS staff received a payoff request and the associated payment for Hugo A. Soriano in the amount
of $3,000. This payment represents full repayment and as such should be satisfied.
The following table provides details regarding the associated mortgages that have met their obligation. As
such, satisfactions of mortgages are required.

Approval of these items will authorize the Chairman to sign the aforementioned satisfactions of mortgage
and the executed documents shall be recorded in the Public Records of Collier County, Florida.
FISCAL IMPACT: For the first (1st) mortgage above (Hugo A. Soriano) the repaid amount of $3,000

satisfies the mortgage amount due to the recapture provision noted above. The repayment is considered
program income. $3,000 was deposited in SHIP Grant Fund (791), Project 33613. Deposited funds will be
used for eligible SHIP activities. The Budget Amendment recognizes $3,000 in program income, of
which five percent (5%) will be used as Administrative funds and is available in SHIP Grant Fund (791),
Project 33613. The $10 recording fee was paid by the party.
For the remaining two (2) mortgages above (Lilia & Rene Lozano and Miguel Nino and Maria Guadalupe
Nino) there is no Fiscal impact associated with the Satisfaction of Mortgage. The funds received July 31st,
1996 and July 29, 1999, for the original down payment assistance are forgiven based on Section
95.281(1)(b) 2019 F.S. The $10 recording fee will be paid by SHIP Grant Fund (791), Project 33613.
LEGAL CONSIDERATIONS: This Item is approved for form and legality and requires a majority vote
for Board approval. -JAB
GROWTH MANAGEMENT IMPACT: SHIP housing programs help the County meet some of the
goals and objectives of the Housing Element of the Growth Management Plan.
RECOMMENDATION: To approve and authorize the Chairman to sign three (3) mortgage satisfactions
for the State Housing Initiatives Partnership loan program in the combined amount of $10,500 and
approve an associated Budget Amendment for $3,000.
