EXECUTIVE SUMMARY
Recommendation to select among the options presented for creation of a Complete Count
Committee in conjunction with the upcoming 2020 United States Census.

OBJECTIVE: To consider three options in the creation of a Complete Count Committee in
conjunction with the upcoming 2020 United States Census.
CONSIDERATION: Per the U.S. Constitution, every 10 years since 1790, a census has been
conducted to count population and households, provide the basis for reapportioning
congressional seats, redistricting, and annually distributing more than $675 billion in federal
funds to support state, county, and community programs impacting housing, education,
transportation, employment, health care, and public policy. The next U.S. Census takes place
starting on April 1, 2020, with state population totals and resulting congressional apportionment
delivered to the President by December 31, 2020.
Complete Count Committees (CCC) are volunteer committees established by tribal, state, and
local governments, community leaders or organizations to increase census awareness and
motivate residents to respond to the census.
During the September 10, 2019, Board of County Commissioners meeting, staff was instructed
to conduct research on Florida counties’ approach to creation of CCCs. Staff conducted
independent research and was assisted by the Florida Association of Counties (FAC) with a
survey dispatched to County Administrators and County Attorneys. Staff will present details on
the following three CCC constructs used by various Florida county governments:
- Private Sector Option;
- Complete Count Coordinator Option (Staff); and,
- BCC-Created Option.
FISCAL IMPACT: This executive summary has no immediate fiscal impact. A Census potential
lost revenue value to the County can be estimated based on Census Bureau population numbers
from FY 15, applying a George Washington University study for the same period that found a
Florida per capita impact value of $1,445, and apply it to Pew Research Center estimates of U.S.
unauthorized immigrant populations by metro area (Naples-Immokalee-Marco Island). Based on
30,000 unauthorized immigrants estimated for this metro area in 2016, had the Census been
officially conducted that year, the potential lost revenue to the Collier County area in federal
assistance would have been $43.35 million.
GROWTH MANAGEMENT IMPACT: This executive summary has no immediate growth
management impact.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney. One of
the issues underlying a Complete Count Committee is whether the Committee would be subject
to the Sunshine Law. Broadly speaking, advisory boards or committees that are created by local
governments are subject to the Sunshine Law if they have been delegated decision-making

authority and are not subject to the Sunshine Law if they are simply gathering information or
engaged in fact-finding. Having attended a number of “fact-finding” committees over the years,
it is my experience that human nature being what it is, once established, a “fact-finding”
committee will often expand its limited role and engage in decision-making activities. In
addition, the very nature of this Committee may very well be decision-making, as my
understanding is the Committee does not actually count anyone but engages in public outreach
and marketing activities which require decisions as to what course of action is best, including the
best use of any funding sources. Accordingly, to protect the members of the Complete Count
Committee from allegations of Sunshine violations (both real and imagined), it is the County
Attorney’s recommendation that if the Board wishes to create a Complete Count Committee, it
do so pursuant to the Board’s Advisory Board Ordinance as an Ad Hoc Committee, expressly
subject to the Sunshine Law. With that noted, this item is approved as to form and legality, and
requires majority vote for action. -JAK

United States Census.

THREE APPROACHES TO INCREASE CENSUS
AWA RENESS:
•PRIVAT E SECTOR OPTION –CCC is not created by a BCC. The BCC does not hear
recommendations from the CCC. BCC members are free to create or participate on
the CCC outside of the County confines.
•COMPLETE COUNT COORDINATOR OPTION (STAFF) –The BCC instructs the
County Manager/Administrator to increase awareness and participation in the 2020
Census via applicable County staff, functions, resources, and programs.
•BCC-CREATED OPTION –The BCC creates the CCC. The BCC hears
recommendations from the CCC. BCC members may participate and chair the CCC.
