EXECUTIVE SUMMARY
Recommendation to authorize expenditures for the sole source purchase of certain laboratory
parts, supplies and services from IDEXX Distribution, Inc., in an amount not to exceed $150,000
per year, for a period of five (5) years.
OBJECTIVE: To secure necessary laboratory supplies required by the County’s compliance
laboratories for Water, Wastewater and Pollution Control, as well as other County divisions, through an
approved sole source vendor for parts, supplies, and services.
CONSIDERATIONS: Collier County Water, Wastewater and Pollution Control compliance laboratories
currently test for drinking and environmental water quality to identify the presence of microorganisms to
determine whether there is any health threat to the public. IDEXX Distribution, Inc.’s, a wholly owned
subsidiary of IDEXX Laboratories, Inc. (collectively “IDEXX”), patented method and products for this
type of testing has been proven to provide a quicker and more accurate test result for bacteria, such as e-
coli, fecal coliform, enterococcus, and others. IDEXX's products for water testing are not available
through any United States distribution network, but only directly from its factory in Memphis, Tennessee.
It is in the County’s best interest to utilize IDEXX products to maintain the current level of service for our
laboratory compliance. These tests are utilized on a routine basis and on an increased basis in the event of
extraordinary or natural disasters. The County’s investments in testing equipment and staff training are
jeopardized when non-IDEXX supplies are used.
Section Eleven: Procurement Methods, subsection 10 of Collier County Ordinance No. 2017 -08, as
amended, allows for the sole source procurement of goods and services from one particular su pplier, to
the exclusion of all others, on the basis of a lack of competition, proprietary technology, copyright,
warranty, or a supplier’s unique capability. Staff has attached to this Executive Summary its Waiver
Request Form supporting the procurement of products from IDEXX as a sole source vendor. IDEXX
satisfies the prerequisites of being a sole source vendor since it is the only authorized vendor for this
product, there are no comparable products available for purchase, and the products offered are proprietary
and held under several U.S. patents.
Pursuant to the attached Waiver, the County divisions will purchase IDEXX drinking and environmental
water testing supplies and related materials from IDEXX as a sole source US vendor through the end of
fiscal year 2024. Thereafter, staff will conduct a thorough review of competitors, peer counties, and
prepare a cost to benefit analysis to determine if the County should continue with IDEXX or migrate to a
different vendor.
FISCAL IMPACT: Annual expenditures for Water, Wastewater and Pollution Control laboratories,
together with potential use by other County divisions, and/or extraordinary need as a result of a natural
disaster will potentially range up to $150,000 per year. Funds are budgeted in the Public Utilities
Operations Fund 408 and Pollution Control Fund 114.
GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated with this
action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority
vote for Board approval.-SRT
RECOMMENDATION: To approve sole source purchases from and expenditures to IDEXX for certain
laboratory parts, supplies and services, and related products as set forth in the attached Waiver.
