Resolution 2000-056A 17D . ....., '1 RESOLUTION NO. 2000-56A RELATING TO PETITION NUMBER ST-99-2 FOR SPECIAL TREATMENT DEVELOPMENT PERMIT TO ALLOW CONSTRUCTION OF A NATURE CENTER WITH AMPHITHEATER!lNSTRUCTlONAL BUILDING, ADMINISTRATION BUILDING, BOARDWALK, PARKING AND DOCKS ON A PORTION OF THE PROPERTY WITH A SPECIAL TREATMENT (ST) OVERLAY HEREINAFTER DESCRIBED IN SECTION 21, TOWNSHIP 48 SOUTH, RANGE 25 EAST, COLLIER COUNTY, FLORIDA. WHEREAS, the Legislature ofthe State of Florida in Chapter 125, Florida Statutes has conferred on Collier County, the power to establish, coordinate and enforce, zoning and such business regulations as necessary for the protection of the public health, safety and welfare; and WHEREAS, the County pursuant thereto has adopted Ordinance 91-102 as amended which establishes regulations for the zoning of particular geographic divisions of the County; and WHEREAS, the Collier County Commissioners, being the duly elected constituted board of the area hereby affected, has held a public hearing after due notice as in said regulations made and provided, and has considered the advisability of allowing the construction of a nature center with amphitheater/instructional building, administration building, boardwalk, parking and docks on a portion of the property having an "ST" overlay, as shown on the attached plan, Exhibit "A", and has found as a matter of fli\Ct that satisfactory provision and arrangement has been made concerning all applicable matters required by said regulations and is in accordance with Section 2.2.24 of the Land Development Code for the unincorporated area of Collier County; and WHEREAS, all interested parties have been given opportunity to be heard by this Board in public meeting assembled and the Board having considered all matters presented. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that Petition ST-99-2 filed by Jason Williams of Johnson Engineering, Inc., representing Cocohatchee Nature Center, with respect to the property hereinafter described as: Exhibit "B" which is attached hereto and incorporated by reference herein. be approved for a Special Treatment Development Permit allowing the construction of a nature center with amphitheater/instructional building, administration building, boardwalk, parking and docks as shown on he attached plot plan, Exhibit "A", in an A-ST zoning district wherein said property is located, subject to the following conditions: 1) Permits from the U.S. Army Corps of Engineers (USACOE), South Florida Water Management District (SFWMD) and the Florida Department of -1- 170 Environmental Protection (FDEP) shall be presented prior to final site plan/construction plan approval. 2) An exotic vegetation removal, monitoring and maintenance plan for the site, with emphasis on the ST area, shall be submitted to Current Planning Section staff for review and approval prior to final site plan/construction plan approval. 3) The Planning Services Director may approve minor changes to the site plan. BE IT FURTHER RESOLVED that this Resolution relating to Petition Number ST -99-2 be recorded in the minutes ofthis Board. This Resolution adopted after motion, second and majority vote.
