Recommendation to authorize an Offer of Judgment for Parcel 136 by Collier County to
property owner, Vilma Patel in the lawsuit styled CC v. ROllell Grazialli, el al., Case No. 06-
0548-CA (Santa Barbara Boulevard Project No. 62081)(Fiscal Impact: If accepted,
$168,157).
OBJECTIVE: That the Board of County Commissioners authorize and approve a
proposed Offer of Judgment for Pureel 136 by Collier County to propel1y owner, Vilma Patel, in
the lawsuit styled CC v. Ronen Gr{ciani. ('I al.. Case No. 06-0548-CA
CONSIDERA nONS: On July 18, 2006, Collier County deposited the sum of $165,700
and acquired a right-of-way easement from a residence on the corncr or Painted Leaf and Santa
Barbara designated as Parcel 136. As a result of the taking, the setback to the home has been
reduced from 75 feet to ] I feel. rhe parties mcdiated the case on December 14, but reached an
impasse. The owner has valued the parcel and damages to his home in excess of $1.000.000.
At mediation, the County's best and final otkr was $285,000. This matter will proceed to trial in
2008. The County Attomey Oftice would like to make an Offer of Judgment in the amount of
$290,000 for Parcel 136, which will expire in 30 days unless extended by the County or
accepted. ]1' the 0\\11er fails to recover an amount equal to or greater than these sums at trial, he
will be responsible for his costs aner the olTer expires. This will require that the owner carefully
assess his case. Attached is the proposed Offer of Judgment by County to the owner.
If approved, and accepted by the owner, the County will pay the fedlowing costs:

claims of Respondent arising out or the taking of Parcel 136 in the total an1llunt of Two
Hundred Ninety Thousand and No/IOO Dollars ($290,000.00), which includes the amount or
$165,700 which was deposited pursuant to the Order of Taking dated .lull' 18,2006.
There are no non-monetary terms or other relevant conditions to this ofTer. except that
this offer is exclusivc ofattorney's fees and costs.
The construction plans and specifications for the project on which the ofrer is based have
been previously and continue to he available for the Respondenfs review upon reasonahle notice
o rsuch a req uest.
