EXEClJTIVE SUMMARY
Recommendation to authorize an Offer of .Iudgment for Parcels 134 and 135 by Collier
County to property owners, Ronen and Leeanne Graziani in the lawsuit styled CC v. Ronen
Graziani. et of., Case No. 06-0548-CA (Santa Barbara Boulevard Project No. 62081)(Fiscal
Impact: If accepted, $180,005). '
OBJECTIVE: That the Board of County Commissioners authorize and approve proposed
Offers of Judgment for Parcel 134 and Parcel 135 by Collier County to property owners, Ronen
and Leeanne Graziani, in the lawsuit styled CC ", Ronen Graziani, (I aI., Case No. 06-0548-CA
-
CONSIDERATIONS: On July 18, 2006. Collier County acquired two right-of-way
easements designated as Parcels 134 and 135 by depositing $130,700 and $39,100, respectively,
or a total of $169.800. The parties mediated the case on December 13 and 14. but reached an
impasse. The owners claim that the home and adjacent lot have been damaged by a reduced
setback and location (If both properties in the after-condition on a 10-lane intersection of Santa
Barbara and Golden Gate Parkway. The owners valued the take and damages to the remainder
property at $347,400 for Parcel 134 and $138.500 for Parcel 135. At mediation, the County's
best and final offer was $295.000 f,)r both parcels. This matter will proceed to trial in 2008. The
County Attomey Office would like to make an OfTer of Judgment in the amount 01'$250,600 for
Parcel 134 and in the amount of $49.400 I,)r Parcel 135, which will expire in 30 days unless
extended by the County or accepted. Ifthc owner fails to recover an amount equal to or greater
than thcse sums at trial, they will be responsible for thcir costs after the offer expires. Attached
are the proposed Offers of Judgment by County to the owners. I f approved. and accepted by the
OWl1ers, the County will pay the following costs:

RECOMMENDA TION: That the Board of County Commissioners approve the making of
the attached Offers of Judgment for Parcels 134 and 135 to Ronen and Leeanne Graziani, and
authorize the payment of funds, iforfcr is accepted.
