EXECUTIVE SUMMARY
Recommendation to authorize the County Attorney to file a lawsuit, on behalf of the
Collier Count)' Board of Commissioners, against Felipe Hernandez in the Twentieth
Judicial County Small Claims in and fOI' Collier Connt)', Florida, to recover repair costs
incurred in the approximate amount of $3,000.00.
OBJECTIVE: For the Board of County Commissioners to authorize the County Attomey to tile
a lawsuit. in the Twentieth Judicial County Small Claims in and for Collier County, Florida
against Felipe Hernandez (hereinafter "Hernandez") to recover repair costs and administrative
fees, incurred by the County in the approximate amount of $3.000.00.
CONSIDERA TIONS: On June 7, 2006. Hemandez was driving a truek on Airport Road,
Naples, Florida. Hernandez made a left into the parking lot of Collier County Tax Collectors
when he ran ovcr a "Drivers Licenses (Arrow)" sign, causing damage io the sign and bollards.
As a result of this accident, damages anJcosts were incurred in the approximate amount of
$2,921.08. Hernandez' auto insurance company has paid the County $188.68 for the damages to
the sign, leaving an outstanding balance of S2, 732.40.

The County Attorney's Office and Risk Management have made numerous attempts to recover
the total costs incurred. The Coul11y has no other recourse for recovery of costs incurred as the
result off lernandez' negligence. than 10 proceed with litigation.
FISCAL IMPACT: Funds are budgeted and available in the Risk Management Propelty &
Casualty Fund.
GROWTH MANAGEMENT 1\1 PACT: There is no grc)\\ th management impact associated
with this item.
LEGAL CONSIDER"- nONS: Roth the County Attorney and the Risk Management Director
opine that the County has no other recourse for recovery of the costs inclIITed, in the approximate
sum 01'$3.000.00.
RECOMMENDA TION: That the Board of County Commissioners authorize the County
Attorney to file a lawsuit against Felip,: ] lemandez. in the Twentieth Judicial County Small
Claims in and for Collier County. Florida. to recover $3.000.00 fill' costs incuITed as a result of
