EXEClITlVE SUMMARY
Recommendation to authorize the County Attorney to file a lawsuit, on behalf of the
Collier County Board of Commissioners, against Edward Cafone, Jr., in Connty Court
Small Claims in and for Collier County, Florida, to recover repair costs incurred in the
approximate amount of $1,500.00.
OBJECTIVE: For the Board of County Commissioners' to authorize the County Attorney to
file a lawsuit, in the County C01ll1 Small Claims in and for Collier County, Florida against
Edward Cafone, Jr., (hereinafter "Cafone") to recover repair costs and administrative fees,
incurred by the County in the approximate amount '1f$I,500.00.
CONSIDER<\. nONS: On February 21. 2007. a County employee driving a County vehicle
was backing out of County Collier County Governmental parking lot when Cafone drove his
vehicle into the rear passenger side of a County owned vehicle. The Collier County Sheriffs-
Officer issued Cafone a citation for "no proof of insurance" The County Attorney's Office and
Risk Management have made numerous unsuccessful attempts to recover the total costs incurred.
The County has no other recourse for recovery of the costs incurred as the result of Cafone's
negligence than to proceed with litigation.

FISCAL IMPACT: Funds are budgeted and available in the Risk lVlanagement Property &
Casualty Fund.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this item.
LEGAL CONSIDERA nONS: Both the County Attorney and the Risk Management Director
opine that the County has no other ,'ecollrse 1elr recover) of the costs incurred, in the approximate
amount 01'$1.500.00.
RECOMMENDATION: That the 13oa,.d oC County CommissionCi's authori/c the County
Attorney \0 file a lawsuit against Fdward Calc'!lc. .II'.. in COllnly Court Small Claims in and for
Collier County. Florida. to rccover $1.500.(I() for the cosb incurred and costs of suit.
