EXECUTIVE SlJMMARY
Recommendation to authorize the County Atto.-ney to file a lawsuit, on behalf of the
Collier County Board of Commissioners, against Daniel W. Snook and/or Mary Nicole
Meister in County Court Small Claims in and for Collier County, Florida, to recover repair
costs incnrred in the approximate amount of $5.000.00.
OBJECTIVE: For the Board of County Commissioners' to authorize the County Attorney to
file a lawsuit, in the County Court Small Claims in and for Collier County, Florida against
Daniel W. Snook (hereinafter "Snook") and/or Mary Nicole Meister (hereinafter "Meister"') to
recover repair costs and administrative fees. incurred by the County in the approximate amount
of$5.000.00.
CONSIDERA nONS: On May 3, 2007. Meister was driving a vehicle owned by Snook.
Meister was driving northbound on Immokalee Road whcn another vchiclc traveling southbound
turnedle1\, violating l\1eister's right-of-way. Meister lost control of the vehiele she was driving
and crashed into a County owned ut ility pole. The County Attorney's Office and Risk
Management have made numerous attempts to recover the total costs incurred. The County has
no other recourse for recovery of the costs tllclIl to proceed with litigation.

FISCAL IMPACT: Funds are budgeted and available in the Risk Management Property &
Casualty Fund.
GROWTH MANAGEME"IT IMPACT: There is no gro\\1h managcment impact associated
with this item.
LEGAL CONSIDERA nONS: Both the COllilty Attorney and thc Risk !vlanagement Director
opine that the County has no other recourse for recovery oflhe $5,000.00 costs incurred.
RECOM'\IEl\:DA nON: That the Goard 01' County Commissioners authorize thc County
Attorney to file a lawsuit against Daniel W. SnooK and/or Mary Nicole Meister in County Court
Small Claims in and for Collier Counlv, I'loricia. to recover $5.000.00 Illr costs incurred as a
result of the damages to the County's utility pole and costs of suit.
