Recommendation to reject RFP No. 08-4199 for "Construction Manager at Risk for Oil Well Road" and to authorize staff to re-solicit the project, Project # 60044. OBJECTIVE: That the Board of County Commissioners rejects RFP No. 08-4 I 99 for use by the Transportation Engineering & Construction Management Department (TECM), Transportation Services Division for the Construction of certain segments of Oil Well Road. CONSIDERATIONS: Oil Well Road is designed to be constructed in three segments. The first segment is a four lane urban section with curb, gutter, sidewalks and bicycle lanes. It will be constructed from Immokalee Road to just east of Everglades Boulevard. The second section to be constructed is a six lane urban section with curb, gutter, and a twelve foot trail on the north side, This section extends from Oil Well Grade Road to Camp Keais Road. The third segment to be constructed is a six lane urban section between Everglades Boulevard and Oil Well Grade Road. The first segment is scheduled to go to construction in March of 2008. According to Paragraph 9 of the Ave Maria Developer Contribution Agreement, the County has committed to constructing the second segment "within a commercially reasonable time after award of contract". There is approximately $58 million currently available for construction. - RFP No. 08-4199 For "Construction Manager at Risk for Oil Well Road" was posted on October 15, 2007. A total of78 Vendors requested RFP packets. Firms were asked to submit their proposals in two envelopes; I) technical proposal, and 2) price offer. Three (3) firms (Kraft, Wright and Balfour Beatty) submitted their technical proposal by the November 14, 2007, due date. Subsequently one of those responders failed to submit their price proposal (Balfour Beatty). The Selection Committee reviewed the two remaining proposals received. One of the proposers misinterpreted the Price Evaluation Process and was therefore considered non-responsive. This left a single proposal, and without previous CM@Risk projects for road construction, no price comparisons could be made. Therefore, staff recommends to reject RFP No. 08-4199 For "Construction Manager at Risk for Oil Well Road". Staff believes with the current down turn in the construction industry and falling construction prices that a traditional bidding process may yield a better value. Hence, staff intends to re-solicit the project under an invitation to bid. FISCAL IMPACT: There is no fiscal impact in the approval of this Executive Summary. GROWTH MANAGEMENT IMP ACT: There is no Growth Management Impact associated with this Executive Summary. RECOMMENDATION: That the Board of County Commissioners reject RFP No. 08-4199 for "Construction Manager at Risk for Oil Well Road", and authorize the Purchasing Department to re-bid the project utilizing the most appropriate bidding process. - Prepared By: Kevin H.
