OBJECTIVE: Present to the Board of County Commissioners a summary of the Impact Fee Deferral Agreements recommended for approval in FY08, including the total number of Agreements approved, the total dollar amolU1t deferred and the balance remaining for additional deferrals in FY08. CONSIDERATIONS: Article IV of Chapter 74 of the Code of Laws and Ordinances established a program to defer impact fees for qualified affordable housing, For FY08, Collier COlU1ty has committed $2,835,500 for the defennent of Impact Fees for eligible owner occupied affordable housing, This number represents 3% of the total Impact Fees collected in the prior Fiscal Year. Additionally, Collier County has committed $750,000 for the deferment of Water System Impact Fees and Sewer System Impact Fees. The Ordinance also allows for the deferral of Impact Fees on a total of 225 rental apartment lU1its per fiscal year. A Summary ofImDact Fee Deferral Agreements on the Januarv 29,2008 Agenda: . Dollar AmOlU1t of Rental Unit Impact Fee Deferrals on today's agenda: o $0 (excluding Water and Sewer) o $0 Water and Sewer FISCAL IMPACT: Although it is expected that the COlU1ty will ultimately collect these deferred fees (generally upon the sale of the residence), there is no guarantee as to if, or when, this would occur. GROWTH MANAGEMENT IMPACT: None. LEGAL CONSIDERATIONS: The proposed Agreements are fully consistent with the intent and purpose ofScction 74-401 of the Code of Laws and Ordinances of Collier COlU1ty. STAFF RECOMMENDATION: That the Board accept this summary of the Impact Fee Deferral Agreements recommended for approval in FY08, including the total number of Agreements approved, the total dollar amolU1t deferred and the balance remaining for additional deferrals in FY08.
