Agenda 01/29/2008 Item #16B10 Agenda Item No. 16810 January 29, 2008 Page 1 of 10 EXECUTIVE SUMMARY Recommendation that the Board of County Commissioncrs approve a Rcsolution ccrtifying the dedication and acceptance of a portion of W cstclox Strect, west of Carson Road, in Immokalee, to Collier County pursuant to Section 95.361, Florida Statutcs, by \lrtuc ofthe County's continuous and uninterrupted maintenance of the roadway, and authorize the filing of the appropriate map(s) with the Clerk ofthc Circuit Court, OBJECTIVE: To formalize the dedication and acceptance of 2,608.51+/- feet of Westclox Street, west of Carson Road, in Immokalee, to Collier County pursuant to Section 95.361, Florida Statutes, by virtue of County's continuous and uninterrupted maintenance of the roadway, and authorize the certification and filing of the appropriate map(s) with the Clerk of the Circuit Court. CONSIDERATIONS: Section 95,361, Florida Statutes, provides in part: "2) In those instances where a road has been constructcd by a nongovenunental entity, or where the road was not constructed by the entity currently maintaining or repairing it, or where it cannot be detennined who constructed the road, and when such road has been regularly maintained or repaired for the immediate past 7 years by a county, a municipality, or the Department of Transportation, whether jointly or severally, such road shall be deemed to be dedicated to the public to the extent of the width that actually has been maintained or repaired for the prescribed period, whether or not the road has been formally established as a public highway." ,- The portion ofWestclox Street at issue appears on the 1969 plat of Mobile Manor as Westclock Road, Staff is unable to determine who originally constructed this 60-foot wide right-of-way west of Carson Road; however, the County's Road Maintenance Departmcnt did coniim1 that it has continuously maintained Westclox Street for the last ten (10) years. A copy of the Affidavit of David Doman, Senior Field Supervisor of the Collier County Road Maintenance Dcpartment is included in this agenda item's backup material, Since this section ofWestclox Street is immediately adjacent to the proposed Collier County Elementary School "K", the County's formal acceptance of the statutory dedication will document its ownership in the public rccords and help to facilitate the School District's objectives for school-related in1provements, such as sidcwalks, within the area of historical maintenance, Additionally, staff has provided notice and a copy of the proposed Resolution to all owncrs of property fronting this section ofWestclox Street. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive SUll1ll1ary, FISCAL IMPACT: Payment of the recording fees will be from Transportation Fund 101 within the Planning Services budget, cost center 1636 I 2, LEGAL CONSIDERATIONS: The proposed Resolution was prepared by the Office of the County Attorney and is legally sufficient for consideration by the Board of County Commissioners.
