Agenda 01/29/2008 Item #16A 3 Agenda Item No. 16A3 January Z9, Z008 Page 1 of 8 EXECUTIVE SUMMARY Recommendation to grant final approval of the roadway (private) and drainage improvements for the final plat of Grey Oaks Unit Nineteen, roadway and drainage improvements will be privately maintained OBJECTIVE: To grant final approval of the infrastructure improvements associated with that subdivision known as Grey Oaks Unit Nineteen. CONSIDERATIONS: 1. On September 4, 2001, the Board of County Commissioners granted preliminary acceptance of the roadway and drainage improvements in Grey Oaks Unit Nineteen. 2. On September 12, 2000, the Board entered into a Construction and Maintenance Agreement with the developer. The developer has fulfilled his obligations with respect to the Construction and Maintenance Agreement. ,- 3. The roadway and drainage improvements will be maintained by the project's homeowners association. 4. The required improvements have been constructed in accordance with the Land Development Code. The Engineering and Environmental Services Department has inspected the improvements and is recommending final acceptance of the improvements. 5. A resolution for final acceptance has been prepared and approved by the County Attorney's Office. A copy of the document is attached. 6. This PUD has been found to be in substantial compliance. A letter from the Home Owner's Association is attached. The developer has not provided a letter from a resident of the subdivision, stating that the Master Association is responsible for maintenance of all common improvements. FISCAL IMPACT: ,,-. The roadway and drainage improvements will be maintained by the project's homeowners association. LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed and approved the Resolution. RECOMMENDATION: That the Board of County Commissioners grant final acceptance of the roadway and drainage improvements in Grey Oaks Unit Nineteen and release the maintenance security. 1. Authorize the Chairman to execute the attached resolution authorizing final acceptance. 2. Authorize the release of the maintenance security. ~. Mudd Board of County Commissioners County Manager Date County Manager's Office 1/20/200812:10 PM Agenda Item No, 16A3 January 29, 2008 Page 5 of 8 RESOLUTION NO. 08-_ A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA AUTHORIZING FINAL ACCEPTANCE OF CERTAIN ROADWAY AND DRAINAGE IMPROVEMENTS IN GREY OAKS UNIT NINETEEN, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 35, PAGES 47 THROUGH 48; RELEASE OF THE MAINTENANCE SECURITY; AND ACCEPTANCE OF THE MAINTENANCE RESPONSIBILITY FOR THE ROADWAY AND DRAINAGE IMPROVEMENTS THAT ARE NOT REQUIRED TO BE MAINTAINED BY THE GREY OAKS HOMEOWNERS' ASSOCIATION WHEREAS, the Board of County Commissioners of Collier County, Florida, on September 12, 2000 approved the plat of Grey Oaks Unit Nineteen for recording; and WHEREAS, the Developer has constructed and maintained the roadway and drainage improvements in accordance with the approved plans and specifications as required by the Land Development Code (Collier County Ordinance No, 04-41, as amended); and WHEREAS, the Developer is requesting final acceptance of the roadway and drainage improvements and release of his maintenance security; and WHEREAS, the Engineering Services Section of the Development Services Department has inspected the roadway and drainage improvements, and is recommending acceptance of said facilities. NOW, THEREFORE. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORJDA, that final acceptance is hereby granted for those roadway and drainage improvements in Grey Oaks Unit Nineteen, pursuant to the plat thereof recorded in Plat Book 35, pages 47 through 48, and the Clerk is hereby authorized to release the maintenance security. BE IT FURTHER RESOLVED AND ORDERED that the County accept the future maintenance and other attendant costs for those roadway and drainage improvements that are not required to be maintained by the Grey Oaks Homeowners' Association. Re: Grey Oaks Units of Development 16 and 19 Dear Stan, " '< Please be advised that I represent the Grey Oaks MEter Property Owners Association the owner of all improvements included in the abovementionCld Grey Oaks Units of Development 16 and 19, the residential communities of Majestic Isle and Isle Royale within Grey Oaks The control of the Grey Oaks Master Property OwnllrS Association maintains with the developer Halstatt Partnership and all improvements include4 in these Units of Development including roadways, storm drainage, streetlights, and signaget landscaping and irrigation are owned and maintained by the Grey Oaks Master Property Owners Association. The improvements induded in these units of development where completed in 2005 and final inspection and certification of the County inspec~rs punch list was completed by Wilson Miller, the project engineers, in November of 2007. As President of the developer controlled Grey Oaks Master Property Owners Association I hereby certify that this Association is responsible for all maintenance of the roads, stormwater management system, sidewalks and all other plat dedicated improvements and additionally that the residents of Grey Oaks will be fully informed of the responsibility of the Master Association prior to its turnover to their control. We respectfully that the performance Bonds posted with the County by the developer for the installation of the above stated Unit of De velopment 16 and 19 improvements be released.
