EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners approve a budget
amendment in the amount of $150,000 for Outside Counsel fees and $40,000 for
Other Contractual Services (used for experts and consultants).
OBJECTIVE: For the Board to approve a budget amendment in the amount of
$150,000 for outside counsel and $40,000 for Other Contractual Services (used for
experts and consultants),
CONSIDERATIONS: As part of the policy cuts to the budget during last year's budget
workshops, the County Attorney's outside counsel budget for Fiscal year 2007-2008
was decreased from $100,000 to $82,700, From this budget approximately $45,500
has been expended to provide specialized assistance with the Collier County vs. Brock
cases, Additionally, to-date approximately $20,000 was used to pay for the
investigation requested by the Board of County Commissioners for the Richland
(Pebblebrooke) and Olde Cypress PUDs.
At the time the budget was set for this fiscal year, it was anticipated that the Collier
County v, Brock case would go to trial prior to the end of FY 2006-07 fiscal year. As the
Board is aware, there have been scheduling changes and unexpected delays and
hearings in this case as well as multiple complications necessitating additional attorney
time and increased expenditures to move the case forward and legally provide for the
county's interests.
As aiways, the County Attorney budgeted conservatively for the year noting to the
Board that a further budget request may be required upon changed circurnstances,
such as the Board's request for outside counsel investigative reports for land use
development issues, Additional outside counsel costs are being incurred on the Clerk's
appeal of the county's successful judgment in the Ochopee / Quo Warranto litigation.
Extensive pre-trial hearings and preparation are preceding the March 17, 2008 trial date
for the budget officer / interest issues litigation.
FISCAL IMPACT: A budget amendment in the amount of $150,000 for outside
counsel (001-100520-631100) and $40,000 for other contractual services (001-100510-
634999) will be needed, Funds are available in general fund reserves to be transferred
to the Office of the County Attorney's budget, Fund 001, Any money not expended
through the fiscal year will be returned to the general fund,
GROWTH MANAGEMENT IMPACT: None.
RECOMMENDATION: For the Board to approve a budget amendment in the amount
of $150,000 for outside counsel and $40,000 for Other Contractual Services (used for
experts and consultants).
