EXECUTIVE SUMMARY
Recommendation for the Board of County Commissioners to direct staff to
provide a refund of a portion of the petition fee received for a recently withdrawn
2006 Cycle Growth Management Plan Amendment petition
OBJECTIVE: For the Board of County Commissioners (BCC) to consider directing staff
to issue a partial fund to Faith Bible Church, the petitioner, for a recently withdrawn
Growth Management Plan (GMP) amendment.
CONSIDERATIONS: It has been concluded, after recent staff and petitioner review of
the petition filed by Faith Bible Church, that the planned expansion of the Faith Bible
Church can be accommodated under the GMP using a different approach rather than
amending the GMP as part of the 2006 Cycle of Growth Management Plan
amendments. The following is a summary of events leading to this recommendation:

o Staff met with the applicant during a pre-application conference and received a
non-refundable $250 fee.
o The petition for the GMP amendment was received with the $16,450 payment for
the balance of the $16,700 application fee.
o Staff spent approximately 10 hours processing and reviewing the petition at an
approximate cost of $450.
. Staff met with the petitioner and decided, upon review, that a different avenue is
available to the petitioner to pursue the church expansion project which does not
require a GMP amendment.
o Staff has no objection to refunding to the petitioner $16,000 ($16,700 petition fee,
less the $450 of staff review costs and the $250 pre-application fee).
FISCAL IMPACT: The fiscal impact to Collier County will consist of refunding to Faith
Bible Church $16,000 from Fund 131. Please note that two receipts totaling $16,450
were found while the third receipt for $250 was not found. Staff does have in its file a
lellerto the applicant indicating receipt of the full $16,700.
LEGAL CONSIDERATIONS: There is no legal consideration as this is a policy decision
of the Board.
GROWTH MANAGEMENT IMPACT: There is no impact.
STAFF RECOMMENDATION: Staff has no objection, nor has any authority to issue this
refund and request that the BCC give direction relative to the issuance of the requested
$16,000 refund.

Dear Mr. Weeks:
As a follow up to our meeting regarding the Comprehensive Plan Amendment CP-2006-3, Faith Bible
Church filed in the 2006 Amendment Cycle, you requested that I write a letter to you about scheduling
a public petition before the acC. By copy of this letter to be followed by a letter to the County
Manager requesting the same, I am requesting a refund in the amount of $ I 6,200 for our application
filing fee less any minimal time that you have spent reviewing the petition to date. We are to
reimbwse the county from our initial filing fee for the minimal time you have spent as you suggested.
After further county staff review of the petition, you were able to make some suggestions on how the
amendment could be withdrawn while still achieving the church's goal of expanding the facility that is
located at the western comer of Oaks Blvd. and Immokalee Road. At the time the application was
filed, after our pre-application meeting, it was assumed that an amendment to the Golden Gate area
Master Plan would be required.
If you could be so kind as to write a letter of your support to accompany our request before the acc, it
would be greatly appreciated.
