EXECUTIVE SUMMARY
Request to approve the renewal of Contract #03-3445, "Vanderbilt Beach
Concession" with Day-Star Unlimited, Inc. d/b/a Cabana Dan's.
OBJECTIVE: That the board of County Commissioners approve the renewal of the contract
with Day-Star Unlimited, Inc, d/b/a Cabana Dan's (Cabana Dan's) for an additional five years.
CONSIDERATION: Collier County has been under contract with Cabana Dan's for the
operations of the food and beverage concession (i.e.; selling chips, snacks, beverages and
related sundries) at Vanderbilt Beach for the past five (5) years. The current agreement will
expire on March 11, 2008. Per Amendment #1, approved by the Board of County
Commissioners on February 12, 2008, Agenda Item 10.E. the contract allows for a renewal
period of an additional five (5) years with Commission approval. Staff and Cabana Dan's are
agreeable to renew this agreement under the same terms and conditions for an additional five
years.
As part of the discussion with the Board at the February 12'h meeting, staff incorrectly stated
that the RFP issued in 2003 specified that the original contract period would be for five years. In
fact, the RFP called for an initial contract period of three years with an option to renew the
contract for one additional two year period. Both the executive summary to award the contract
and the actual contract referenced a five year initial contract period. The change to the five year
- term was made by staff during the contract negotiation phase prior to bringing the original
contract to the Board in order to align the agreement with standard practice for most
concessionaire agreements.
Staff recommends that the Board authorize the renewal for the following reasons:
1. The concessionaire has provided excellent service to the residents and visitors of Collier
County under the agreement.
2. The renewal terms are in accordance with other, similar concession agreements.
3. The County's list of prospective bidders for this service is limited due to site and service
constraints at the Vanderbilt Beach Location. In light of that and as was discussed on
February 12'h, soliciting proposals at this time would mean that the County would be
potentially operating under new, less favorable terms and conditions.
FISCAL IMPACT: Under the terms of the existing agreement, the County shall receive
eighteen percent (18%) per month for gross revenues or a minimum monthly payment of
$700.00, which ever is greater. The minimum annual revenues received under the terms of the
agreement would be $8,400.00. Historically, however, actual annual revenues have ranged
between $14,000.00 and $24,000.00.
LEGAL CONSIDERATIONS: It is the position of the Purchasing Department and the Office of
the County Attorney that the Board retains the authority under its purchasing policy to renew the
agreement for an additional five year period.
