APPOINTMENT OF MEMBER(S) TO THE BA YSHORE BEAUTIFICATION MSTU
ADVISORY COMMITTEE
OBJECTIVE: To appoint 2 members to scrve 4 year terms, expiring on March 3, 2012, to the
Bayshore Beautification Advisory Committee.
CONSIDERATIONS: The Bayshore Beautification MSTU Advisory Committee has 2
terms expiring on March 3, 2008. This 5 member advisory committee was created on Decernber
16, 1997, by Ordinance No. 97-82 to provide curbing, watering facilities, plantings and
maintenance of the median strips of roadways within the MSTU; provide traffic calming
improvements; and, beautification and maintenance of other areas within the MSTU. Members
will also prepare and recommend an itemized budget to the Board of County Commissioners.
Members must be permanent residents or owners of commercial property within the MSTU
boundaries. A list of the current membership is included in the backup.
The terms for Maurice Gutierrez and Bill L. Neal will expire on March 3, 2008. A press release
was issued and resumes were received from the following 3 interested citizens:

NOTE: Section Seven (B) of Ordinance 2001-55 states "Terms of office for Board members
shall be limited to two consecutive terms of service on anyone Board.. ." Under (D) of the
same section, it is noted that "By a unanimous vote of the Commission, the limitations set forth
in subsection (B) above may be waived". According to available records, Bill Neal and Maurice
Gutierrez have served 2 or more terms. Should the Board wish to re-appoint Mr. Neal and Mr.
Gutierrez, the limitations on two consecutive ten11S will nced to be waivcd.

RECOMMENDA nON: That the Board of County Commissioners consider the
recommendation for appointment, appoint 2 members, and direct the County Attorney to prepare
a resolution confirming the appointments.

SUBJECT: Recommendation to the BOCC for filling its two vacancies in the Bayshore MSTU.
The Bayshore Beautification MSTU has received and reviewed three applications by the prescribed deadline for
its two vacancies. The Applicants were evaluated based on the potential contributions to the Committee. All three
applicants meet the criteria required to be eligible for the committee and reside within the MSTU's district
boundary.
Mr. Bill Neal has served in this committee for 12 years and had 7 excused absences. Maurice Gutierrez
has served in this committee for 10 years and had 5 excused absences. The Committee recommends both Mr.
Bill Neal and Mr. Maurice Gutierrez for Re-appointment .
