Executive Summary
Recommendation to Approve a Mediated Settlement Agreement and a Stipulated Final
Judgment to be drafted incorporating the same terms and conditions as the Mediated
Settlement Agreement in the amount of $165,000.00 for the acquisition of Parcels 108FEE and
108TCE in the Lawsuit styled Collier County, Florida v. Michael L. McEndree, et al., Case No.
07-4335-CA (Santa Barbara Boulevard Extension Project #60091). (Fiscal Impact:
$82,700.00)
OBJECTIVE: That the Board approve a Mediated Settlement Agreement and a Stipulated Final
Judgment to be drafted incorporating the same terms and conditions as the Mediated Settlement
Agreement as full and final compensation to be paid for the acquisition of Parcels 108FEE and
108TCE in the lawsuit styled Collier County, Florida v. Michael L. McEndree, et al., Case No. 07-
4335-CA (Santa Barbara Boulevard Extension Project #60091).
CONSIDERATIONS: Collier County seeks to condemn a 25-foot wide strip of right-of-way from
home owners, Francisco and Elizabeth Lovos. An Order of Taking hearing was held on March 17,
2008 and the County will be depositing the sum of $135,400 into the Court Registry. Through
mediation, the parties agreed to a total compensation in the amount of$165,000 plus attorney's fees
and expert fees and costs.

*Owners' attorney agreed to accept a reasonable fee which was less than the benefit under Section
73.091, F.S.
Attached is the Mediated Settlement Agreement providing for the above-stated funds.
FISCAL IMPACT: Funds in the amount of $82,700.00 will come from the Transportation
Supported Gas Tax Fund and Impact Fee Funds. Source of funds are Gas Taxes and Impact Fees.
GROWTH MANAGEMENT IMPACT: None.
RECOMMENDATION: That the Board of County Commissioners:
I. Approve the Mediated Settlement Agreement;
2. Approve the Stipulated Final Judgment which incorporates the terms and conditions
of the Mediated Settlement Agreement to be presented to the Court for entry; and
3. Approve the expenditure and disbursement of funds as stated.

Agreement:
